HomeMy WebLinkAbout011 - 12/15/1939 - RELATING TO THE ORGANIZATION OF THE FIRE DEPARTMENT AND REPEALING ORDINANCE NO. 001, 1925 AND ORDINA ORDINANCE NO 11 _, 1939 BLING AN EMERGENCY ORDINANCE RELATING TO THE ORGANIZATION OF THL FIRE DEPAFTMENT OF THE CITY OF FORT COLLINS AND REPEALING ORDINANCE NO 11 1925 AND ORDINANCE NO 11 1935, AND ALL OTHER ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS Section 1 That the Fire Department of the City of Fort Collins shall be under the immediate supervision and con- trol of the City Manager, and said Department shall be charged v�ith the duty of immediately and by proper means extinguishing any firm breaking out within the City of Fort Collins, and, so far as may be, of removing fire hazards and preventing fires from breaking out Section 2 For the purpose of carrying on the work of said Fire Department, the City Council is hereby authorized and ampove'red to appoint or designate, upon the recommendation of the City Manager, onm Pire Chief, one Assistant Firm Chief, one Firmman ivIaster !Mechanic, and such additional Firemen as may be nmcessary for thm proper organization of the Fire Department and protection against fires vithin the City All Firemen shall be under the immediatm direction and control of the Fire Chief, or in his absence, the Assistant Firm Chief, but said Fire Chief, Assistant Fire Chief and all Firemen shall be at all times subject to the general control and direction of the City Manager Said Fire Chief, Assistant Fire Chief and Firemen shall receive such compensation as may be fixed by resolution of the City Council, and shall hold their respective offices or employmmnt at the pleasure of the City Council, upon the recommendation of the City Manager, subject to thm provisions of Article VI of the City Charter, and Ordinance No 2 of the Series of 1939 Section 3 The Firp Chief, and in his absence the Assistant Fire Chief shall be responsible for the discipline, good order and proper conduct of the entire Fire Department, shall enforce all regulations pertaining thereto, see that all property of the Fire Department is given proper care and atten- tion and kept in good condition, and generally have and exercise the powers and authority of Chief of the Fire Department He shall have control of all persons present at fires, and to that and shall ex-officio be and exercise all the powers of a police- man and shall have the power, if need be, to summon any and all persons present to assist in extinguishing any fire, in removing property from any burning building, and in guarding the same, and any able-bodied person refusing to obey such summons snall be liable to arrest, and upon conviction may be fined not less than Five Dollars (�5 00) nor more than Fifty Dollars ($50 00) for each offense In the absence of the Fire Chief and Assistant Fire Chief, such person as may be designated by the Fire Chief shall have the powers and authority and be chargeable with the auties of the Fire Chief The Fire Chief shall make reports to the City Manager on or before the second Saturday in each month of all matters concerning the department and its activities, and showing a record of all fires, their date, cause, if known, the approximate loss and to whom, and such other facts as may be deemed of value, and he shall make such additional reports at such times as may be requested by the City Manager Section 4 It shall be unlawful for any person or persons to interfere with the officers or members of the Fire Department in the discharge of their duties at any time, or in any manner tamper with any of the Fire Department equipment, alarm system, or other apparatuq, o-r in any manner obstruct, interfere with or turn on any fire plug within the City limits And any person violating any provisions of this section shall, upon conviction, be fined not less than Five Dollars (�5 00) nor more than One Hundred Dollars (0100 00) for each offense Section 5 Ordinance No 1, 1925 and Ordinance No 1, 1935 and all other ordinances or parts of ordinances in conflict with this ordinance are hereby repealed Section 6 In the opinion of the City Council an emergency exists for the preservation of the public health, safety and peace and this ordinance shall take effect upon its passage, under and by virtue of the authority contained in Sections 6 and 7 of Article IV of the City Charter Introduced, read at length and adopted by the unanimous voto of all members of the City Council this 15th day of Decembar, A D 1939 Commiss ner of Safety ana Ex-Officio Mayor ATTEST City Clerk STATE OF COLORAD02 ) )) ss County of Larimer I. MILDS F HOUSE, City Clerk of the City of Fort Collins, do hereby certify and declare that the fore- going Ordinance, consisting of six (6) sections, was duly propoGed and read at langth at a regular meeting of the City Council, held on the 15th day of December, A D 19392 and was duly adopted and ordered published in the Fort Collins Leader, a weekly newspaper and the official newspaper of the City of Fort Collins, by the unanimous vote of all riombers of the Council, as an emergencl ordinance, in accordance with the provisions of Sections 6 and 7 of Article IV of the City Charter, and thereafter, and on to-wit the 21st day of December, 19392 was duly published in the Fort Collins Leader, a v�eekly newspaper published in the CitS of Fort Collins, Colorado IN NITNESS WHEREOF, I have hereunto set my hand end affixed the seal of said City, this 21st day of December, A D 1939 City Clerk
