HomeMy WebLinkAbout012 - 12/15/1939 - RELATING TO THE ORGANIZATION OF THE POLICE DEPARTMENT AND REPEALING ORDINANCE NO. 002, 1935 AND ALL ORDINANCE NO _ 2 1939 BEING AIv E1VIERGENCY ORDINANCE RELATING TO THE ORGANIZATION OF TbE POLICE DEDARTMENT OF THE CITY OF FORT COLLINS AND REPEAL- ING ORDINANCE NO 22 1935 AND ALL OTHER ORDINANCES OP PAPTS OF ORDINANCES IN CONFLICT HEPE4ITH BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS Section 1 That the Police Department of the City of Fort Collins snall be under the immediate supervision and control of the City Manager, and shall be charged Vith the duty to enforce the penal laws of the State of Colorado, and all ordinances and regulations of the City of Fort Collins, and shall cooperate with State and Federal law enforcement officials Section 2 For the purpose of carrying on the work of said Police Department the City Council is hereby authorized and empowered to appoint, upon the recommendation of the City Manager one Chief of Police, one Assistant Chief of Police, one Police Clerk and such other police officers as may be necessary for the preservation of the peace and good order, and the health and safety of the citizens, and the protection of property, and in case of emergency or necessity the City Manager is authorized to appoint such special police officers for temporary, general or special duty as he may deem advisable and necessary for the public good All police officers shall be under the immediate direction and control of the Chief of Police, or in his absence, the Assistant Chief of Police, but both saia Chief of Police and all other police officers shall be at all times subject to the general control and direction of the City Manager Police officers may be assigned to such positions or special duties as the Chief and the City Manager may deem for the best interests of the Department The Chief of Police, Assistant Chief of Police, Police Clerk and other police officers shall receive such compensation as may be fixed by resolution of the City Council, and shall hold their respective offices or Pmployment at the pleasure of the City Council upon the recommendation of the City Manager, pursuant to the provisions of Article VI of the City Charter and Ordinance No 2 of the Series of 1939 Section 3 Ordinance No 2, 1935, and all other ordinances or parts of ordinances in conflict with this ordinance are hereby repealed Section 4 In the opinion of the City Council an emergency Pxists for the preservation of the public health, safety and peace and this ordinance shall take Pffect upon its passage, under and by virtue of the authority contained in Sections 6 and 7 of Article IV of the City Charter Introduced, read at lengtn and adopted by the unanimous vote of all members of the City Council this 15th day of December, A D 1939 Comma oner f SafPty and Ex-Officb Mayor ATTEST 7 City Clerk STATE OF COLORADO, ss County of Larimer I, MILES F HOUSE, City Clerk of the City of Fort Collins, do hereby certify and aeclare that the fore- going Ordinance, consisting of four (4) sections, was duly proposed and read at length at a regular meeting of the City Council, hold on the 15th day of December, A D 1939, and vas duly adopted and ordered published in the Fort Collins Leader, a weekly newspaper and the official newspaper of the City of Fort Collins, by the unanimous vote of all members of the Council, as an emergency ordinance, in accordance vith the provisions of Sections 6 and 7 of Article IV of the City Charter, and thereafter, and on to-wit the 21st day of December, 1939, was duly published in the Fort Collins Leader, a weekly newspaper published in the City of Fort Collins, Colorado IN WITNESS ViHEREOF, I have hereunto set my hand and affixed the seal of said City, this 21st day of December, A D 1939 City Clerk
