HomeMy WebLinkAbout010 - 06/13/1930 - AMENDING ORDINANCE NO. 039, 1923, AS AMENDED BY ORDINANCE NO 029, 1929, RELATING TO THE SALE OF MILK ORDINANCE NO 10 1930 BEING AN EMERGENCY ORDINANCE AMENDING ORDINANCE NO 39 OF THE SERIES OF 1923 AS AMENDED BY ORDINANCE NO 29 OF THE SERIES OF 1929, BEING AN ORDINANCE RELATING TO THE SALE OF MILK AND ITS PRODUCTS WITHIN THE CORPORATE LIMITS OF THE CITY OF FORT COLLINS , C 0 LO RADO BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS Section 1 That Ordinance No 39 of the Series of 1923, as amended by Ordinance No 29 of the Series of 1929, being an ordinance relating to the sale of milk and its products within the corporate limits of the City of Fort Collins, be and the same is hereby amended by adding thereto the following Section 19 (a) That on and after August 1, 1930, no person shall sell or offer for sale or advertise the same for sale, within the corporate limits of the City of Fort Collins, any pasteurized milk, unless the same has been processed as fo l lows Every particle of such milk or milk products shall be heated to a temperature of not less than 1420 Fahrenheit, and holding the same at such temperature for not less than thirty (30) minutes in a pasteurization apparatus approved by the Food Inspector, provided, that such approval shall be limited to such apparatus which contains a combined holder and indicating thermometer temperature tolerance of not more than 1Q' Fahrenheit, as shown by official tests with suitable testing equipment, and provided that such apparatus shall be operated as directed by the Food Inspector, and the indicating thermometer and the recording thermometer charts both indicate a temperature of not less than 143j' Fahrenheit continuously throughout the holding period, provided, that nothing contained in this section -1- shall be construed as disbarring any other process which has been demonstrated as of at least equal efficiency, and is approved by the Food Inspector, all of said pasteurization charts above mentioned shall be kept on file for a period of one year and shall be signed at the time of the making thereof by the person in charge of the vat or vats, and all recording thermometers above mentioned are to be securely locked and no key therefor shall be in the possession of any person, except one to be designated by the said Food Inspector All charts shall be graduated to 10 within the limits of 1350 to 1500 Fahrenheit Section 2 All ordinances and parts of ordinances in conflict with this ordinance are hereby repealed Section 3 In the opinion of the City Council an emergency exists for the preservation of the public health, peace and safety, and this ordinance shall take effect upon its passage and publication under and by virtue of the authority contained in Sections 6 and 7 of Article IV of the City Charter Introduced, read at length and adopted by the unanimous vote of all the members of the City Council this 13th day of Tunp,A D 1930 Commissioner of Safety and Ex-Officio Mayor ATTEST City Clerk r � STATE OF COLORADO ) SS COUNTY OF LARIMER ) I, A J ROSENOW, City Clerk of the City of that Fort Collins, do hereby certify and declare/the foregoing ordinance, consisting of three (3) sections, was duly proposed and read at length at a regular meeting of the City Council held on the 13th day of June, A D 1930, and was duly adopted and ordered published in the Fort Collins Express-Courier, a daily newspaper and the official newspaper of the City of Fort Collins, by the unanimous vote of all members of the City Council, as an emergency ordinance, in accordance with the provisions of Sections 6 and 7 of Article IV of the City Charter, and thereafter and on to-wit the 17th day of June, A D 1930, said Ordinance No 10 was duly published in the Fort Collins Express-Courier, a daily newspaper published in the City of Fort Collins, Colorado IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of said City this 17th day of June, A D 1930 -Gity Clerk
