HomeMy WebLinkAbout021 - 12/26/1930 - RELATING TO LICENSES FOR THE OPERATION OF BILLIARD AND POOL TABLES, BOWLING OR PIN AND BALL ALLEYS, � r • ORDINANCE NO. 21 , 1930 BUNG AN EMERGENCY ORDINANCE RELATING TO LICENSES FOR THE OPERATION OF BILLIARD AND POOL TABLES , BOWLING OR PIN AND BALL ALLEYS , SHOOTING GALLERIES, STRIKING MACHINES , RING GAMES , BALL AND PUPPET GAMES AND THE REGULATION OF THE SAME J BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS Section 1. That all persons are hereby prohibited from keeping for gain or hire any billiard or pool table, or any other kind of table or implement kept or used for a similar purpose, or any bowling or ball and pin alley, strik- ing machine, shooting gallery, ring game, ball and puppet game, cane rack, knife board or any other like game or device within the corporate limits of the City of Fort Collins, unless said person shall have first obtained a license or permit therefor as herein provided in this ordinance. Section 2 A license to keep for gain or hire any of the tables, alleys or galleries mentioned in Section 1 of this ordinance may- be granted by the City Council in its discretion to any person or persons who shall make application in writing therefor to the City Council, stating therein the room or place wherein such tables, galleries or alleys are to be kept and the number of such tables, galleries, or alleys pro- posed to be kept and shall execute to the City of Fort Collins a good and sufficient bona with at least two good sureties or a Surety Company bond, to be approved by the Commissioner of Safety and Ex-OffiGio Mayor of the City of Fort Collins in the penal sum of Five Hundred ($500.00) Dollars, conditioned that the person or persons so licensed shall observe and keep all of -1- the ordinances of the City of Fort Collins in force at the time of the issuing of said license, or that may be passed or adopted during the term of said license Said application shall be accompanied by the amount of money re- quired for the license fee Upon compliance with the foregoing require- ments, a license may, in the discretion of the City Council, be granted to the person or persons so applying, authorizing and permitting him or them to keep for gain or hire any of the tables, alleys or galleries hereinbefore mentioned, provided, the City Council may refuse to grant any such license where in its opinion the applicant is not a person of good moral char- acter, or for other good cause shown All licenses issued under this ordinance shall be signed by the Commissioner of Safety and Ex-Officio Mayor and attested by the City Clerk, and shall bear even date with the date of the meeting of the City Council at which said license is granted, and no license issued under this ordinance shall be transferable from the licensee except by and with the consent of the City Council of the City of Fort Collins and at its discretion and then only upon the filing of a new bond by the transferee as hereinabove provided, nor shall the licensee be permitted to operate under said license in any other place than that mentioned in the application and license without the consent of the said City Council Section 3 It shall be unlawful for any person or persons who shall have been granted a license under the provisions of this ordinance his or their clerk, agent or employee, to permit any games for money or other valuable thing -2- to be played upon the tables, alleys or galleries mentioned in Section 1 of this ordinance or to permit any gaming by means of cards dice or device for playing of games of chance, or skill and chance within or about the establishment where such tables or alleys are kept, or to permit any person under the age of eighteen (18) years to play upon any of said tables or alleys, or to loiter about or frequent the room or place where such tables or alleys are kept, except when accompanied by one of his parents, or to keep open, or permit any person or persons, except employees of said place, to enter the room or place where such table, alleys or galleries are kept, between the hours of 12 o 'clock P M and 5 o *clock A 14 of the succeeding day, or upon Sunday, or to permit any playing upon the said tables or alleys, or shooting in such galleries, between the hours of 12 o 'clock P M and 5 o*clock Ar 1'4 of the succeeding day, or upon Sunday It shall be unlawful for any person under the age of eighteen (18) years to frequent any billiard hall pool hall or bowling alley or participate in any game in any such billiard hall, pool hall or bowling alley or to loiter about or frequent the room or place where any billiard tables or alleys are kept and licensed in the corporate limits of the City of Fort Collins Section 4 Any license issued or granted under the provisions of this ordinance may be revoked by the City Council whenever it shall be made to appear to the City Council that the person or persons to whom such license was issued, his or their agent or employee has directly or indirectly violated any of the conditions of his bond or any of the provisions of this ordinance or any ordinance of this City relating to the sale of intoxicating liquors -3- • Section 5 All licenses issued or granted under the provisions of Section 2 of this ordinance shall be paid for at the following rates for each of the tables above named the sum of 010 00 per year for each pin and ball alley the sum of $15 00 per year, for each shooting gallery the sum of $80 00 per year No license shall be issued or granted for a longer period than six (61 months, nor until the whole price for such license shall have been paid Section 6 A permit to keep for gain or hire any striking machine, ring games, ball or puppet games, cane racks, knife boards or any other game or games of the same nature may be granted by the Commissioner of Safety and Ex- Officio Mayor of the City of Fort Collins in his discretion to any person or persons who shall make application in writing therefor to the said Commissioner of Safety and Ex-Officio Mayor All permits issued or granted under the provisions of Section 6 of this ordinance shall be paid for at the rate of one dollar per day for each day that the said game or device shall be kept for use within the corporate limits of said City No permit shall be granted until the applicant shall have paid the sum of one dollar for each day of the time for which said permit shall be granted Said device shall not be used upon any of the streets avenues or alleys of said City It shall be unlawful for any person or persons who have been granted a permit as above provided, to use, or permit to be used, any such game or device upon the first day of the week commonly called Sunday -4- • 1 M � Section 7 Any person or persons who shall violate any of the provisions of this ordinance, shall, upon conviction thereof, be fined for such offense in a sum not less than $5 00 nor more than 6300 00 or may be imprisoned in the City Jail not to exceed ninety (90 ) days and pay the costs of suit Section 8 Ordinances No 5 - 1890 No 1 - 19109 No 11 - 1911 No 17- 1913, No 9 - 1924 and all ordinances or parts of ordinances in conflict with this ordinance, are hereby repealed Section 9 In the opinion bf the City Council an emergency exists for the preservation of the public healt1, peace and safety, and this ordinance shall take effect upon its passage and publication under and by virtue of the authority contained in Sections 6 and 7 of Article IV of the City Charter Introduced, read at length and duly proposed and read at length at a regular meeting of the City Council held on the 26th day of December, A D 1930, and was duly adopted and ordered published in the Fort Collins Express- Courier, a daily newspaper and the official newspaper of the City of Fort Collins, by the unanimous vote of all mbmbers of the City Council, as an emergency ordinance, in accordance with the provisions of Sections 6 and 7 of Article IV of the City Charter, and thereafter, on to-wit the 29th day of T)Pcember A D 1930 , said Ordinance No 21 was duly published in the Fort Collins Express-Courier, a daily
