HomeMy WebLinkAbout010 - 11/18/1932 - RELATING TO THE PREVENTION OF FIRES, THE DISPOSITION OF ASHES AND OTHER MATERIALS (EMERGENCY ORDINAN ORDINANCE NO 10 , 19329 BEING AN EMERGENCY ORDINANCE RELATING TO THE PREVENTION OF FIRES , THE DISPOSITION OF ASKS AND OTHER MATERIALS AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT TIEREWITH BE IT ORDAINED BY TIE CITY COUNCIL OF THE CITY OF FORT COLLINS Section 1. It shall be the duty of the owner of every building within the City of Fort Collins and of the agent having the same in charge, to furnish an ashpit or container constructed as herein provided, for receiving ashes when taken outside of said building, and said owner or the occupant of said building shall be required to remove all ashes from said ashpit or container when the same is filled. No ashes shall be deposited or kept outside of any building in any part of the City of Fort Collins in anything other than an ashpit or container, constructed of brick, stone, concrete or metal or other fireproof material of approved design and substantial construction, which said ashpit or container snall at all times be kept in good repair, and securely closed except when necessary to put ashes therein or clean out the same. Section 2. The Commissioner of Safety shall approve the construction and design of all ashpits and containers and shall have authority to compel the proper construction, repair and replacement of any ashpit or container not of proper design and substantial construction or not in good repair or securely closed. When any ashpit or container at any time fails to meet the requirements of this ordinance as to -1- construction or condition thereof, the Commissioner of Safety shall give written notice to the owner of the property, or to his agent, personally or by registered mail addressed to such owner or agent at the last known address of such owner or agent, concerning the unlawful and improper condition, or the absence of any ashpit or container, and said owner shall, within ten (10) days from the date of such personal service or mailing of said notice, comply with the terms of this ordinance. Each day of the continuance of the unlawful condition or absence of any ashpit or container after the ten day period above provided, shall constitute a separate offense. Section 3 No materials of any kind shall be burned in any ashpit or container which will cause noxious odors to escape therefrom. Section 4. No ashes except such as have been thoroughly wet and all fire extinguished therefrom, shall be kept within any building within the City of Fort Collins and no such wet ashes shall be piled upon or against any combustible material within any such building. Section 5. It shall be unlawful for any person to set fire to any rubbish, debris or waste material of any kind upon any street, alley or lot within the fire limits of this City as the same are now established, or may hereafter be established by ordinance. It shall be unlawful for any person to set fire to or burn any such material within forty (40) feet of any building, outside of such fire limits within the City of Fort Collins, and then only when some person over the age of sixteen (16) years shall be present during the time when said fire is burning. All fires which may be lighted for the burning of such material outside of said fire limits, shall be extinguished or caused to be extinguished -2- by the person lighting the same before 00 o 'clock P. M. upon the same day upon which said fire was lighted. Section 6. Any person, firm, or corporation who shall violate any provision of this ordinance, upon conviction shall be fined in any sum not less than Two ($2.00) Dollars nor more than One Hundred ($100.00) Dollars and costs of suit . Section 7. Ordinance No, 5, 1926 and Section 831 of the Code of the City of Fort Collins and all other ordinances and parts of ordinances in conflict with this ordinance, are hereby repealed. Section 8. In the opinion of the City Council an emergency exists for the preservation of the public health, peace and safety, and tnis ordinance shall take effect upon its passage and publication, under and by virtue of the authority contained in Sections 6 and 7 of Article IV of the City Charter Introduced, read at length and adopted by the unanimous vote of all the members of the City Council, this 18th day of November, A. ROSENOW, City Clerk of the City of Fort Collins, do hereby certify and declare that the aforesaid Ordinance, consisting of eight (8) sections, was duly proposed and read at length at a regular meeting of the City Council held on the 18th day of November, A. D. 1932, and was duly adopted and ordered published in the Fort Collins Express- Courier, a daily newspaper and the official newspaper of the City of Fort Collins, by the unanimous vote of all members of the City Council, as an Emergency Ordinance, in accordance with the provisions of Sections 6 and 7 of Article IV of the City Charter, and thereafter and on to-wit the 22nd day of November, A. D. 1932, said Ordinance No. 10 was duly published in the Fort Collins Express-Courier, a daily newspaper published in the City of Fort Collins, Colorado.
