HomeMy WebLinkAbout008 - 12/15/1933 - AMENDING ORDINANCE NO. 007, 1920, CONCERNING THE USE, HANDLING, STORAGE AND SALE OF INFLAMABLE LIQUI ,r ORDINANCN NO 8 , 1933, BEING AN EMERGENCY ORDINANCE AMENDING ORDINANCE NO 7 , 1920 , CONCERNING THE USE, HANDLING, STORAGE AND SALE OF INFLAM?RLE LIQUIDS AND PROVIDING LICENSES THEREFOR WITHIN THE LIMITS OF THE CITY OF FORT COLLINS BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS Section 1. That there be added to Section 1 of Ordinance No, 7 , 1920 , the following "It shall be unlawful to Deep any quantity of five (5) gallon or less of gasoline , naphtha or other inflemable liquids within the City of Fort Collins, except in an approved safety can bearing the under- writer'-s approval label It shall be unlawful for gasoline or other inflamable liquid to be unloaded from any truck, tank car or other container into another tank or container, except in the immediate presence of an attendant , who shall be personally- present at all times when gasoline is being so transferred from one container to another At any time when loading or unloading of gasoline is being carried on from one container to another, a suitable ground either by chain or wire shall be used All tank wagons or tanks upon trucks or wagons, or when placed upon- foundations, shall have an approved vent installed thereon It shall be unlawful to expose to the air within any building or part thereof, within the City of Fort Collins , any quantity of gasoline , naphtha or other inflamable liquids No storage tanks or pumps for the handling of inflamable liquids shall be installed without obtaining a permit and having inspection thereof , nor shall any replacements of the same be made without permit and inspection " Section 2 That Section & of said Ordinance No 79 1920 is amended to read as follows "Section 6 The provisions of this ordin- ance shall not be construed as applying to gasoline contained in tide reservoir or tanks of motor vehicles , and not to exceed ten (10) gallon in approved measuring pumps used for filling purposes , or to portable wheel -1- tanks for use in garages when not exceeding sixty (60) gallons capacity, and when constructed and used in accordance with the requirements of Section 15 of this ordinance " Section 3 That Section 18 of said Ordinance No. 71 1920 shall read as follows "Section 18 All tank wagons transporting gasoline or other inflamable liquids within the cor- porate limits of the City of Fort Collins must secure a license or permit in the same manner as is provided for securing permits for the installation of tanks and PUMPS Each application for a permit to operate a tank wagon for transporting gasoline or other inflamable liquids within the City of Fort Collins , shall be accom- panied by the sum of Twenty-five ($25 00) Dollars in payment of the annual license fee therefor Gasoline and other inflamable liquids shall not be transported within the City of Fort Collins , except in licensed tank wagons or in metallic drums of approved design Section 4 That Section 21 of said Ordinance No 79 1920 , shall be amended to read as follows "Section 21. Fees for permits and Occupation Tax The following fees shall be charged and collected under this Ordinance For each tank installed Five ($5 00) Dollars, For all curb pumps anf occupation tax, One Hundred ($100.00) Dollars per annum, For all other pumps Five ($5.00) Dollars per annum The schedule of fees for permits to operate filling stations shall be as follows For each tank installed 1n excess of one hundred (100) gallon, the fee shall be Five ($5 00) Dollars, For each pump installed the fee shall be Five ($5 00) Dollars In addition to the above , each pump shall pay an annual license fee of Ten ($10 00) Dollars." Section: 5 That there be added to Section 22 of said Ordinance No 7, 1920 , the following "All licenses required by this ordinance and amendments thereto , may be assigned only by making application to the City Council and securing its approval -2- and giving a corporate surety bond as provided therein for an original license No person, firm or corporation holding a license for a filling station or tank wagon under said ordinance, shall sell or lease the business or property used under said license without reporting the same to the City Clerk in writing within three (3) days of said sale or lease , and failure so to do shall be a violation of this ordinance " Section 6 That there be added to Section 23 of said Ordinance No 7, 1920 , the following "Said bond shall indemnify the City against the violation of any provision of Ordinance No 7 of 1920 and any amendments thereto " Section 7 That Section 27 of said Ordinance No, 71 1920 , shall be amended- to read as follows "Section 27 Storage of Kerosene by retail Merchants It shall be lawful for a retail merchant to keep in storage not to exceed one (1) barrel of kerosene in an approved pump type container, without any draw-off faucets or gage glasses, which shall be the limit of amount in one building, the same to be located away from any furnace room or any open heating device upon a permit to be granted by the City Council upon ap lication therefor and the payment of the sum of Two 42 00) Dollars as permit fee " Section 8 All ordinances and parts of ordinances in conflict with this ordinance are hereby repealed, save and except that all causes of actions accrued in favor of the City of Fort Collins by reason of any violation of said ordinances, prior to the taking effect of this repeal, shall be prosecuted as tho no repeal had been made Section 9 In the opinion of the City Council an emergency exists for the preservation of the public health, peace and safety, and this ordinance shall take effect upon its passage under and by ujrtue of the authority contained in Sections 6 and 7 of Article IV of the City Charter -3- Introduced, read at length and adopted by the unanimous vote of all members of the City Council at a regular meeting held this i5O day of December, A D 19�3 Commissioner or Saretyand - ff cio Mayor ATTEST City Clerk r N STATE OF COLORADO ) ss County of Larimer ) I, A J ROSENOW, City Clerk of the City of Fort Collins , do hereby certify and declare that the foregoing Ordinance, consisting of nine (9) sections , was duly proposed and read at length at a regular meeting of the City Council, held on the /S f1h day of December , A D 19339 and was duly adopted and ordered published in the Fort Collins Express-Courier, a daily newspaper and the official newspaper of the City of Fort Collins, by the unanimous vote of all members of the City Council as an emergency ordinance, in accordance with the provisions of Sections 6 and 7 of Article IV of the City Charter, and thereafter and on to-wit the day of December, A D 1933, said Ordinance No. 1933, was duly published in The Fort Collins Express-Courier, a daily newspaper published in the City of Fort Collins, Colorado IN WITNESS WHEREOF, I have hereunto � set my hand and affixed the seal of said City, this t _(� day of December, A D 1933 City Clerk
