BEING AN EMERGENCY ORDINANCE AMENDING ORDINANCE NO 39 OF THE
SERIES OF 1923 AS HERETOFORE AMENDED, BEING AN ORDINANCE RELATING
TO THE SALE OF MILK AND ITS PRODUCTS WITHIN THE CORPORATE LIMITS
OF THE CITY OF FORT COLLINS, COLORADO
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS
Section 1, That Ordinance No 39 of the Series
of 1923 as amended by Ordinance No 29 of the Series of 1929 and
Ordinance No 10 of the Series of 1930 , being an ordinance relating
to the sale of milk and its products within the corporate limits
of the City of Fort Collins, be and the same is hereby amended by
adding thereto the following
"Section 19 (b) That on and after May 1 , 1934,
no person shall sell or offer for sale or advertise the same for
sale within- the corporate limits of the City of Fort Collins , any
milk unless the same is pasteurized as provided in Ordinance No.
10 of the Series of 1930 , or shall have been derived from abortion
free herds The words "abortion free herds" shall be considered
to mean a herd in which there are no cows which react to the
agglutination test for abortion disease "
The Food Inspector is hereby given power to make
necessary regulations with respect to the determination of
abortion free herds by tests or otherwise
Section 2 All ordinances and parts of ordinances
in conflict with this ordinance are hereby repealed
Section 3 In the opinion of the City Council
an emergency exists for the preservation of the public health,
peace and safety, and this ordinance shall take effect upon its
passage and publication under and by virtue of the authority

contained in Sections 6 and 2 of Article IV of the City Charter
Introduced, read at length and adopted by the
unanimous vote of all the members of the City Council, this
day of April, A D 1934

aforesaid Ordinance , consisting of three (3) sections , was duly
proposed and read at length at a regular meeting of the City
Council held on the 6 "a day of April, A D 1934 , and was duly
adopted and ordered published in the Fort Collins Express-Courier,
a daily newspaper and the official newspaper of the City of Fort
Collins , by the unanimous vote of all members of the City Council,
as an Emergency Ordinance , in accordance with the provisions of
Sections 6 and 7 of Article 17 of the City Charter, and thereafter
and on to-wit the /o 0 day of April, A D 1934 , said Ordinance
No. .S was duly published in the Fort Collins Express-Courier,
a daily newspaper published in the City of Fort Collins , Colorado
