HomeMy WebLinkAbout005 - 10/26/1945 - AMENDING ORDINANCE NO 030, 1924, AS AMENDED, RELATING TO THE BUILDING CODE, PROVIDING RULES AND REGU ORDINANCE NO 5 1945 BEING AN EMERGENCY ORDINANCE AMENDING ORDINANCE NO 30, 1924, AS AN!ENIDED, RELATING TO THE BUILDING CODE FOR TM; CITY OF FORT COLLINS, PROVIDING RULES AND REGULATIONS THEREUNDER, PENALTIES FOR VIOLATION THEREOF, AND REPEALING ALL ORDINANCES AMID PARTS OF ORDINANCES IN CONFLICT HEREWITH i BE IT ORDAINED BY THE CITY COUNCIL OP THE CITY OF FORT COLLINS Section 1 That Section 2 of Ordinance No 30, 1924, as amenaed, is hereby amended by adding thereto the following definition 'Basement Apartment --A basement or cellar affording shelter or protection and designed for or used as a home or resiaence 11 Section 2 That Part III of Ordinance No 301 19242 as amended, be ana the same is hereby amenaed by adding thereto Section 28B, to read as follows, to-wit "Section 28B No basement apartment shall be con- structea, erected, enlarged, remodeled, altered, or repaired unless the same conforms with the following requirements, to-wit " (a) The maximum allowable depth below finished grade, or bottom of areaways , of the finished floor shall be not more than five and one-half feet " (b ) Areaways shall not be less than two feet in width, measured perpendicular to face of building wall This width shall be increased six inches for each six inches or fraction thereof in depth over two feet In no case shall the finished grade be above the head of the required windows. " (c ) The total glass area of requirea winaows in any habitable room shall not be less than ten per cent of the floor area of the room. s " (d) The total area of the ventilating portions of required windows in any habitable room shall be not less than four per cent of the floor area of the room " (e) At least two exits, with stairways remote from each other, each of not less than 36 inches in width and each with at least one handrail, shall be provided, and at least one of said exits shall lead directly to the exterior of the build- ing in wnich said basement apartment is established 't (f) Plumbing fixtures 1 Each living unit shall be provided with the following fixtures a A kitchen sink properly located to facil- itate food preparation, cooking, and dishwashing b A water closet , locatea either in the bathroom or in a separate toilet com- partment c A bathtub or shower, located in a bath- room or other equivalently ventilated space d A lavatory readily accessible to all rooms 2 Each of the plumbing fixtures shall be per- manently installed and connectea, in accord- ance with the City and State Plumbing Codes "(g) All partitions in basement apartments shall be of standard construction, consisting of 2 inch by 4 inch studding with a top ana bottom plate on 16 inch centers , with at least one fire stop between the floor and ceiling line These parti- tions shall be lathed with either metal, rock, or cellotex lath, and shall be plastered on both sides " 2 " (h) teach apartment in any building shall have a separate electric light meter and service switch " Section 3 That Paragraph (a) of Section 18OF of Ordinance No 9, 1937 , amending Ordinance No 30, 1924, as amended, be and the same is hereby amended to read as follows " (a) All electric wiring, including additions, exten- sions or changes in existing wiring, hereafter installed for transmission of electric current for light, heat or power in or on all buildings located within the corporate limits of the City of Fort Collins , shall be approved rigid conduit, electrical metallic tubing or metal moulding " Section 4 All ordinances and parts of ordinances in conflict herewith are hereby repealed Section 5 In the opinion of the City Council an emergency exists for the preservation of the public health, peace and safety, and this ordinance shall take effect upon its passage under and by virtue of the authority contained in Sections 6 and 7 of Article IV of the City Charter Introduced, read at length, and adopted by the unani- mous vote of all members of the City Council , at a regular meeting of the City Council, held this 26th day of October, A D 1945.
