HomeMy WebLinkAbout007 - 12/28/1945 - RELATING TO THE FIXING OF SCHEDULE OF RATES TO BE CHARGED BY THE CITY (EMERGENCY ORDINANCE) a ORDINANCE NO. 7 , 1945 BEING AN EMERGENCY ORDINANCE RELATING TO THE FIXING OF SCHEDULE OF RATES TO BE CHARGED BY THE CITY OF FORT COLLINS, INCLUDING RULES AND REGULATIONS FOR ALL ELECTRIC SERVICE WITHIN THE CORPORATE LIMITS OF THE CITY OF FORT COLLINS AND UPON THE FRINGE LINES OUTSIDE THE CITY OF FORT COLLINS CON- NECTED WITH THE DISTRIBUTING SYSTEM OF THE FORT COLLINS LIGHT AND POWER DEPARTMENT, PURSUANT TO THE PROVISIONS OF SECTION 4 OF ARTICLE XVIII OF THE CITY CHARTER, AND RE- PEALING ALL ORDINANCES IN CONFLICT HEREWITH WHEREAS, the City of Fort Collins is the owner and operator of a Municipal Electric Light and Power System and has heretofore adopted a schedule of rates and rules and regulations as contained in Ordinance No. 8, 1935, as amended by Ordinance No. 29 1937, Ordinance No 5, 1938, and Ordinance No 2, 1940 and WHEREAS, the Commissioner of Works and Public Utili- ties and the City Manager have recommended that a new and revised schedule of rates be adopted and the City Council is of the opinion that the recommended changes are fair and reasonable and lower than the schedule of rates now in effect, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT C CLLINS Section 1. The City Council finds and determines that the proposed rates to be charged and collected by the City of Fort Collins are reasonable rates to be charged by the said City of Fort Collins at the present time, and which schedule of rates is hereinafter set forth and adopted as the lawful rates for the said City of Fort Collins to charge and collect from customers, both within and without the corporate limits of the City of Fort Collins upon its distribution system for .light, heat and power furnished to the consumers connected to the said municipal light and power distributing system in accordance with the terms and provisions of the schedule of rates hereinafter set forth in Section 20 together with general rules and regulations on file with the City Clerk, as shall be from time to time adopted by the City, which said rules and regulations shall govern and control in all respects in render- ing service and charging and collecting rates for the sale of all electrical energy, which schedule of rates is hereby accepted and adopted as controlling in the matter of the electrical service to be rendered until further modified by the City Council. Section 2. The following schedule of rates is hereby adopted and Ep proved, which shall be the lawful rates for the City of Fort Collins to charge and collect for all electrical service of every kind, both within and without the corporate limits of the City of Fort Collins for customers connected to the distributing system of the said City of Fort Collins, being the schedule of rates referred to in Section 1 of this ordinance Third Reduction SCIEDULE 1 RESIDENCE SERVICE APPLICABILITY Available in corporate limits of Fort Collins and Sub- urban fringe, provided lines are constructed near property to be served. RATE First 35 KWH used per month, per KWH-------------$0.05 Next 40 KWH used per month, per KWH------------- .04 Next 75 KWH used per month, per KWH------------- .02 All additional KWH used per month, per KWH------- .01 MINIMUM Minimum charge per meter per month--------------- 1,00 2 CONTRACT PERIOD AND CONDITIONS All contracts under this schedule shall be for a minimum period of thirty days and thereafter until terminated, where service is no longer required, on two days written notice. All customers not permanent residents , not owning their own residence, are required to make a deposit of $5.00 before meter is installed. This will be held by the Department until the contract is cancelled or proof of ownership is established. All bills due and payable ten days after date of bill or a penalty of 5% may be added. RULES AND REGULATIONS Customer desiring service under this schedule shall apply at the office and agree to the provisions as required by the city, and make the residence subject to inspection by the Department if so required. Service under this schedule is for the exclusive use of one customer only, one family residence, and shall not be resold or shared with others . Under this schedule 115 volt motors rated one-quarter and under one-half HP of the split-phase type, or one-half horsepower repulsion-induction type are allowed. ?here service is available for electrical cooking and hot water heating using three wire 230 volt service, motors up to three HP will be allowed on this rate. All motor uses and electrical hot water heating and cooking are subject to inspection before the customer uses heavy equipment under this rate. Service under this schedule will be in accordance wit)i the general provisions of the Service Rules and Regulations of the Department, as approved by the City Council. SCHEDULE 2 BUSINESS SERVICE APPLICABILITY Available in corporate limits of the City of Fort Collins and suburban fringe, provided lines are constructed near property to be served. Single meter rate for the use of one customer and not for resale to others . RATE First 50 KWH used per month, per KWH --------$0.05 e , Next 100 KWH used per month, per KWH -------- .04 Next 850 KWH used per month, per KWH -------- .03 Next 9000 KWH used per month, per KWH -------- .022 Next 10000 KWH used per month, per KWH -------- .02 Balance -------- 0175 MINIMUM Minimum monthly charge per meter per month -----$1.00 PAYMENT The above rates are net Bills for electric service are due and payable within ten days from date of bill A penalty of 5% may be added to bills for the first $100.00 per meter per month, plus 2% of the amount in excess of $100.00. CONTRACT PERIOD All contracts under this schedule shall be for a minimum period of thirty days and thereafter until terminated, where service is no longer required, by written notice several days in advance of termination period. 3 RULES AND REGULATIONS The above rules and regulations are subject to the provisions as approved by the City Council. Buildings and service to be subject to inspection by the Department and City Building Inspector. Deposit charge on business meters will be made in accordance with the nature of the business and the amount of current that may be used This amount may be up to approxi- mately two month's bill. Service under this rate is available for lighting and miscellaneous small appliances . Miscellaneous small motors may be served up to one horsepower. An extra charge will be made if either lights or motors are used, not having a power factor of 85% or better. Service to X-ray machines, electrical welders and other apparatus of similar characteristics will not be served under this schedule where in the opinion of the Department undue voltage disturbance will result or radio disturbance is created Proper shielding may be required. Such loads are to be served from separate circuits metered and billed under surveyed schedules by the Department. Service under this schedule is for commercial customers including clubs , fraternities , sororities, lodges , hotels, apartments, rooming houses, tourist camps , and multiple dwellings, where more than one dwelling or more than one living quarter is served thru one meter. This rate applies also to all churches . Commercial cooking and hot water heating served by separate meter and separate lines will take a lower rate as per schedule "Commercial Cooking". Service under this schedule will be in accordance with the general provisions of the Service Rules and Regulations of the Department as approved by the City Council. SCHEDULE 3 COMMERCIAL COOKING SERVICE ✓ AVAILABILITY Available for business cooking and heating RATE(Net) First 2500 KWH used per month, per KWH --------$0.0150 All additional KWH used per month, per KWH----- .01 MINIMUM Net minimum charge per meter, per month -------$2.00 DELAYED PAYMENT CHARGE The above rates are net To all bills not paid within ten(10)days from date of bill, there will be added 5%. CONTRACT PERIOD All contracts under this schedule shall be made for a period of twelve (12) months, automatically renewed for like periods but terminable where no service is longer required on three days ' written notice. Service under this schedule will be in accordance with the general provisions of the Service Rules and Regulations of the Department as approved by the City Council. 4 SCHEDULE 4 GENERAL SECONDARY POWER SERVICE APPLICABILITY Available for an initial specified demand for alter- nating current power service metered at the voltage of City's established secondary distribution system. DETERMINATION OF CONTRACT HORSEPOWER When the connected load is five HP or less , the total connected load shall be eonsidered as the contract horsepower. When the connected load is in excess of five horsepower, the contract horsepower, which in no event shall be taken as less than five HP nor less than one hundred percent of the manufacturer's rating of largest motor connected, shall be determined at option of the City by the following method For installations consisting of more than two (2 ) items of motors or other apparatus, the minimum charge shall be based on 75% of the total horsepower connected. DELAYED PAYMENT CHARGE To all bills not paid within ten days from date of bill, there will be added five percent of the first $100.00 or less of net monthly bill, plus two percent of the amount in excess of $100.00. Service under this schedule will be in accordance with the general provisions of the Service Rules and Regulations of the Department as approved by the City Council. SCHEDULE 5 SPECIAL -- PRIMARY Large Power APPLICABILITY Applicable within the city limits of Fort Collins AVAILABILITY Available for alternating current, 60 cycle, power only. Service to be taken at one point of delivery only and metered at voltage of city's primary distribution system. Not avail- able for standby or resale service. Not available during peak load hours if notified by the Light and Power Department in advance of peak hours 5 SCHEDUIE 5 (continued) RATE First 20,000 KWH used per month, per KWH ------------------------------------ $0 0175 Next 302000 KWH used per month, perKWH ------------------------------------ .015 All additional KIH used per month, per KWH ------------------------------------ , .0125 MINIMUM Net minimum charge for any calendar month per meter, per month ----------------------$100000 DELAYED PAYMENT CHARGE To all bills not paid within ten(10 )days from date of bill, there will be added 5% of the first $100 and 2% of the amount in excess of $100.00, CONTRACT PERIOD All contracts under this schedule shall be for a minimum period of six months and thereafter until terminated, where service is no longer required, on three days written notice by either party RULES AND REGULATIONS It is specifically understood that the customer is to hold the power factor of his motors to as near 80% as possible with the above rate schedule. POINT OF MEASUREMENT All current under Schedule 5 shall be considered as measured at the voltage of the city 's established primary distribution system at the point where service is delivered. TRANSFORMERS Customers who do not guarantee to use service for twelve months each year, under Schedule 5, shall be required to furnish and maintain transformers for stepping down voltage from that furnished by city's primary distribution voltage to that required by customer 's installation City shall not be required to furnish transformers in any case unless they are of standard size and voltage. POWER FACTOR - Should the average monthly power factor or unbalance between phases of the customer 's installation fall below 80%, under Schedule 5, the demand or contract horsepower shall for purpose of billing be increased in the ratio of 80% to the actual average power factor or unbalance Service under this schedule will be in accordance with the general provisions of the .Service Rules and Regulations of the Department as approved by the City Council. SCHEDULE 6 SPECIAL HOT WATER HEATER RATE AVAILABILITY Available for Clubs, Sororities , Lodges, Hotels or other business houses. RATE(Net ) For all KWH used per month, per KWH-------------- $0.01 MINIMUM Net minimum charge per meter, per month---------- 2 00 DELAYED PAYMENT CHARGE For all bills not paid within ten days from date of bill, there will be added 5% of the net bill. 6 SCHEDUIE 6 (continued) CONTRACT PERIOD All contracts under this schedule , except when a line extension other than a service loop is required, shall be made for a period of thirty(30) days , automatically renewed for a like period but terminable thereafter when service is no longer required on three days written notice SPECIAL RULES AND REGULATIONS Under this schedule the Department reserves the right to automatically control the service during peak hours . Peak hours considered from sun down to 9 00 P. M. or as otherwise specified later. No other device shall be used on this schedule other than the hot water heaters The customer agrees to install such hot water heating device, standard 20 gallon tanks or larger, on a separate meter service, 115-230 volt service. It is understood by the customer that this special hot water heating rate shall not affect other commercial schedules now in effect by the Department in any way. Service under this schedule will be in accordance with the general provisions of the Service Rules and Regulations of the Department as approved by the City Council. SCHEDULE 7 PUBLIC BUILDING SERVICE General - Fort Collins and School District No. Five APPLICABILITY Available in the corporate limits of Fort Collins and ✓ suburgan fringe territory, provided lines are constructed near service to be rendered. RATE Schedule "A" All kilowatts used per kilowatt hour for lighting and small motors---------------------$0,03 Schedule "B" For all cooking and hot water heating, school cafeterias and home economics laboratories served by separate meter and separate line First 500 KWH used per month, per KWH--------- .Ola All additional used for cooking and heating -------------------------------------- .01 MINIMUM Minimum charge per meter per month ------------- $2,00 CONTRACT PERIOD AND CONDITIONS All contracts under this schedule shall be applied for in writing by the boards in control of the buildings and the contract shall automatically remain in force until terminated by either the Department served or by future city regulations . RULES AND REGULATIONS Under this schedule the Department will permit 115 volt motors rated up to one-quarter (4) horsepower split- phase type, or one-half (2) horsepower repulsion induction type . Larger motors with 230 volts , three line service are subject to inspection by the Department It is agreed under this schedule that all lighting and motor loads shall have an average power factor of 85% or better. Service under this schedule will be in accordance with the general provisions of the Service Rules and Regulations of the Department as approved by thf° City Council. 7 SCHEDULE 8 MUNICIPAL RAILWAY POWER AND LIGHT AND CITY HALL SERVICE AVAILABILITY Available only for combined power and lighting service to the Municipal Street Railway, City Shops and City Hall of the City of Fort Collins . RATE Energy Charge All KWH used, per KWH -------------------------- $0,01 Service to the Municipal Railway shall be metered at the voltage of the city's established primary distri- bution system. Service to the City Hall shall be metered at the voltage of the city's established secondary distribution system. The city shall have the right to obtain service under any of the city's rates available for such service in lieu of the above rate. Service under this schedule will be in accordance with the general provisions of the Service Rules and Regulations of the Department as approved by the City Council, SCHEDULE 9 SPECIAL DEMAND POZR SERVICE APPLICABILITY Applicable within the city limits of Fort Collins where lines and services are adequate for this kind of load. AVAILABILITY Available by contract to all power consumers using the Departmentts standard secondary service for operation of X-ray machines , electric welders of proper power factor, and other apparatus with excessive momentary demands. RATE Primary Charge First five KW per KW of demand, per month --------------------------------- - 1.00 Balance of demand per KW per month -------- .75 Plus energy charge per KW ----------------- .035 MINIMUM Minimum charge for the above service---------- 00 PAYMENT The above rates are net. Service bills become due and payable within ten (10) days from date of bill DETERMINATION OF DEMAND- The KW demand shall, at the option of the Department, be the manufacturers name plate rating or as indicated by a suitable indicating instrument. The demand shall be either the KW rating or 80% of the KVA, whichever is the greater. Computations will be to the nearest KW. CONTRACT PERIOD Service is for a twelve month period If discontinued for reasonable cause sooner, a charge of j1*00 will be made for disconnecting and reconnecting RULES AND REGULATIONS All equipment must be inspected by the Department engineers before placing in service. The General Rules and Regulations as to proper and safe shielding and wiring of all such appliances must be followed in the above installations. 8 SCHEDULE 10 BUSINESS DISPLAY LIGHTING SERVICE APPLICABILITY Available for window and display lighting service in the business section when the size and character of the installation meets the approval of the city, and the burning hours are controlled as specified in the rate. RATE(Net ) Burning all night, per 100 watts connected, per month ----------------------------------- $0.80 MINIMUM Net Monthly minimum charge per customer as provided by the burning hours of the rate. No connected load shall be considered as less than 200 watts. DELAYED PAYMENT CHARGE The above rates are net . To all bills not paid within ten (10) days fro-i date of bill, there will be added 5% of the net bill CONTRACT PERIOD All contracts under this schedule shall be made for a period of twelve (12 ) months , automatically renewed for like periods but terminable, where no service is longer required on three (3 ) days written notice. Standard Rules and Regulations apply the same aR in Commercial Rate No. 2. SCHEDULE ISM" MUNICIPAL STREET LIGHTING APPLICABILITY Available within the city limits of Fort Collins AVAILABILITY For street lighting purposes where service is rendered thru overhead or suspended type equipment or for underground connections in the business district of the city RATE For all street lighting ordered by the City Council per month ---------------------------------- $1 180.33 TERMS AND CONDITIONS The 'Department is to furnish and install all lamps, wire, poles, fixtures and other equipment necessary in rendering street lighting service, and will maintain and operate same CONTRACT PERIOD The above rates are to remain in force until changed on recommendation of the City Manager and by authority of the City Council. 9 ELECTRIC RATES GENERAL SERVICE RULES AND REGULATIONS 1. Service Standards r Standard secondary service as referred to in rate schedules is alternating current, 60 cycles , single or three phase. (a) Single phase, 2 or 3 wire, 115-230 volts. (b) Three phase, three wire, 230 volts. Standard primary service as referred to in the rate schedules is alternating current, 60 cycle, single or three phase, 2400 volts . 2. M ter and Service Drops The Department will furnish, install at its expense, own and maintain the equipment to properly meter the service required. Standard overhead service drops from the supply lines of the Department to the premises of the consumer will be provided by the Department. In the event an underground service is desired by the consumer, he shall provide, own and maintain it. An allowance will be made by the Department for a reasonable deduction, estimating the cost of overhead services for such reductions. 3. Space for Meters The consumer will provide at his expense and in connection with his wiring, a suitable mounting space or enclosure for the installation of the metering equipment in accordance with the prevailing requirements of the 'Hiring Ordinance of the City of Fort Collins All new installations or changes require, where possible, sequence outdoor metering No meter shall be fastened to walls by consumers, either plastered or otherwise fixed in a socket preventing removal for test. 4. Consumers ' Wiring The consumer shall provide at his expense all inside wiring necessary for the proper utilization of the service. The Department will require that the service entrance wiring, the meter "loop" and the service entrance switch be installed in accordance with the prevailing requirements of the Wiring Ordinance of the City of Fort Collins The service entrance wiring shall be brought to a point outside the building which may be satisfactorily reached from the Department 's supply lines without service drop trespass upon other property. The meter loop wiring shall be such that one meter will measure the entire requirement of each class of service. The Department will not assume any responsibility with respect to the consumers ' wiring, or for damages to the con- sumer resulting from defective wiring installed by consumer. Service may be discontinued after due notice to the consumer if wiring or equipment is considered unsafe, and will not be reconnected until the unsafe condition has been corrected. 5. Instantaneous Demand As a protection to service and equipment, motors of five (5) horsepower or larger shall have such characteristics or be equipped with a starter of such design that the instan- taneous current requirement will be limited to approximately 300 per cent of normal full load current. In all installations of motors, starting devices and equipment must be inspected by the Department before the motor is placed in service by the consumer. 10 -2- 6. Right of Access The Department shall have the right to enter upon the premises of the consumer at all reasonable times for the pur- pose of inspecting, repairing, replacing or removing Department-owned equipment 7. Application and Contract for Service Applications for service shall be made at the office of the Department on standard forms, which when signed by the applicant and approved by the Department, shall constitute a contract between the consumer and the Light Department of the City of Fort Collins . The Department will, if desired, assist the consumer in selecting rate best suited for his requirements The consumer shall be responsible for the rate schedule selected and his use of service shall be in accordance with provisions thereof. 8. Credit-Deposits-Payment Guarantees Applicants for service will be required to establish credit satisfactory to the Department before applications will be approved or service connected. The Department may require of the consumer a cash deposit sufficient to cover sixty (60) days ? estimated service bill or a satisfactory guarantee of the payment of such bills for a like period. Deposits will not be considered as advance payment for service bills and will be applied as credits to service accounts only after service has been discontinued. Interest will be paid by the Department upon such deposits at the rate of six (6 ) per cent per annum, payable upon the return of the deposit or annually upon the request of the con- sumer, for the time such deposit is held by the Department and the consumer is served by the Department unless such period be less than six (6) months, provided that in computing interest no consideration will be given to fractional parts of months or dollars. 9. Revenue Guarantees The Department will require of each consumer for each meter installed at each address, before service is discontinued, a total revenue equivalent to the monthly minimum charge specified in the rate schedule under which service is taken The above requiPement will not be applicable to owners of, or agents for rental properties, desiring temporary continu- ation of service for a period not exceeding ten (10) days for cleaning or other emergency purposes, after properties have been vacated by tenants, and service remains connected. 10. Resale Service will be furnished for the sole use of the consumer at the premises designated in the service application and con- tract, and the consumer shall not directly or indirectly sell or otherwise dispose of such service to any other person or persons , except upon specific authorization of regulatory author- ities having jurisdiction. 11. Tampering with Meter The consumer shall not tamper or otherwise interfere with the proper operation of the Department 's meter or other equip- ment, or in any way interfere with the proper meter registration of service used. For violation of this regulation, service will be dis- continued without notice to the consumer and will not be recon- nected until the consumer shall have installed standard service entrance wiring in accordance with the prevailingrequirements of the Wiring Ordinance of the City of Fort Collins. The consumer will be liable for an estimated service bill for the period during which such irregularity existed. 11 12. Service Shut-off for Non-payment - Service may be discontinued for non-payment of past due service accounts after forty-eight (48) hours notice to con- sumers . A charge of $1.00 may be made for reconnection 13, Service Failures No liability shall attach to the Department for service failures caused by strikes , acts of God or unavoidable accidents or contingencies beyond its control 14, Attachments to Poles Attachments to poles or lighting standards will not be permitted except upon specific authority of the Department The attachment of radio aerials is prohibited. 15. Gratuities Inspectors, agents and employees of the Department are forbidden to accept any personal compensation or gratuity from consumers . 16. Luminous Tube Lighting- Power Factor correction of Luminous Electric Discharge Tubes or other lighting equipment of inherent low power factor characteristics shall, at all times, be provided with effective power factor corrective equipment such that the power factor of such lighting equipment shallbe not less than eighty-five (85%) per cent lagging. Such corrective equipment shall be directly connected in the load circuit without separate fuses . The Department reserves the right to refuse or disconnect service to such lighting equipment until these requirements have been complied with 17 Verbal Agreements No promise, agreement or representation of any employee of the Department shall be binding upon the Department, unless the same shall have been incorporated in the contract for service. 18. Extension of sines and Services Extension of distribution or transmission lines to place of delivery of service to consumer or consumers will be made, subject to the following conditions, and in accordance with Rules 42A and 42B of the Public Utilities Commission of the State of Colorado. (a) Permanent Extensions for Continuous Service A-1 Permanent extension for continuous service will be constructed within a reasonable time after acceptable appli- cation therefor, when in the judgment of the Department the assured annual revenue for each year of the three year period immediately following the construction of such extension and establishment of service thereto, will equal or exceed forty (40%) per cent of the total cost of such extension. A-2 When it is not certain in the judgment of the Department that the assured annual revenue for each of the three years following construction and establishment of service to such extension will equal forty(40%) per cent of the cost thereof, such permanent extension will nevertheless be made when the con- struction and existence of such extension is, in the opinion of the Department, economically sound and feasible. (b ) Revenue Guarantees or Deposits B-1 All extensions of lines outside the city limits are to be made on special contracts subject to the approval of the City Council. B-2 If extensions are made that may later on serve two or more customers, the Department reserves the right to repurchase line at any time subject to reasonable depreciation. 12 Section 3 Ordinance No 8, 1935 , as amended by Ordinance No 2, 1937, Ordinance No 5, 1938, and Ordinance No 2 , 1940, is hereby repealed except that the schedule of rates and rules and regulations therein contained shall apply to and be used on all billings of the Light and Power Depart- ment to and including the 31st day of December, A D 1945 Section 4 In the opinion of the City Council an emergency exists for the preservation of the public health, peace and safety, and this Ordinance shall take effect upon its passage under and by virtue of the authority contained in Sections 6 and 7 of Article IV of the City Charter, and the schedule of rates , rules and regulations shall apply to all billings made by the Light and Power Department from and after the 1st day of January, A D 1946 Introduced, read at length, and adopted by the unanimous vote of all members of the City Council , at a regular meeting held this 28th day of December, A D 1945 Commission' SafeWj and ex- officio Mayor Attest City C er 13 STATE OF COLORADO, ) ss.
