HomeMy WebLinkAbout002 - 03/01/1946 - PROVIDING FOR THE SUBMISSION TO A VOTE OF THE DULY QUALIFIED TAXPAYING ELECTORS, AT THE GENERAL ELEC ORDINANCE NO 2 , 1946 BEING AN EMERGENCY ORDINANCE PROVIDING FOR THE SUBMISSION TO A VOTE OF THE DULY QUALIFIED TAXPAYING ELECTORS OF THE CITY OF FORT COLLINS, AT THE GENERAL ELECTION OF A CITY COMMISSIONER TO BE HELD IN SAID CITY ON TUESDAY, THE 2ND DAY OF APRIL, A D 19469 THE QUESTION OF AUTHORIZING THE CITY COUNCIL OF SAID CITY TO CONTRACT All INDEBTEDNESS ON BEHALF OF THE CITY, AND UPON THE CREDIT THEREOF, BY ISSUING THE NEGOTIABLE COUPON BONDS OF THE CITY IN AN AGGREGATE PRINCIPAL AMOUNT NOT EXCEEDING $250,000 00, FOR THE PURPOSE OF ACQUIRING A SEWAGE DISPOSAL PLANT TOGETHER WITH ALL NECESSARY APPURTENANCES FOR THE CITY WHEREAS, in the opinion of the City Council of the City of Fort Collins, provision should now be made to raise funds for the purpose of acquiring a sewage disposal plant, together with necessary lands, rights of way, sewer mains and appurtenances for the treatment of the sewage of the City of Fort Collins, which plant complete as herein described is hereinafter referred to as a sewage disposal plant, and WHEREAS, the City of Fort Collins is unable to provide funds for a sewage disposal plant out of its current revenues, and AREAS, in the opinion of the City Council of said City, an indebtedness should be contracted on behalf of the City and upon the credit thereof, by issuing the negotiable interest bearing bonds of the City, for the purpose of acquiring a sewage disposal plant. NOW THEREFORE, BE IT ORDAINED BY = CITY COUNCIL OF THE CITY OF FORT COLLINS Section 1. That at the general election of a City Commissioner to be held in the City of Fort Collins on Tuesday, the 2nd day of April, A D 1946, the question of authorizing the City Council of said City to contract an indebtedness on behalf of the City and upon the eredit thereof, by issuing the negotiable interest bearing bonds of the City in an aggregate amount not exceeding $250,000 00, for the -1- purpose of acquiring a sewage disposal plant for the City, be and the same is hereby submitted to a vote of such qualified electors of the City as shall in the year next preceding said election have paid a property tax therein, for their determina- tion Section 2. The question so submitted shall be voted on at said election by the voters qualified as aforesaid, at the several precincts of said City as hereinafter set forth in the notice of the election Section 3 The voting shall be by ballot of the form hereinafter provided, and said election shall be in all respects, as nearly as may be , held and conducted in the manner prescribed by law and the charter of the City of Fort Collins in cases of elections for City Commissioners. Section 4 The ballots to be used in voting upon the question submitted shall be prepared and furnished by the City Clerk to the Judges of election, to be by them furnished to the voters, and shall be in the following printed form, and shall be deposited in a separate ballot box provided by the City Clerk for such purpose SEWAGE DISPOSAL PLANT OFFICIAL BALLOT FOR THE ELECTION TO BE HELD IN THE CITY OF FORT COLLINS ON TUESDAY TI- OF APRIL, A D. 94 . Question submitted Shall the City Council of the City of Fort Collins be authorized to contract an indebtedness on behalf of the City, and upon the credit thereof, by issuing the negotiable interest bearing bonds of the City in an aggregate principal amount of not exceeding $250,000 00, for the purpose of acquiring a sewage disposal plant for the City of Fort Collins? INSTRUCTIONS TO VOTERS--A voter wishing to vote in favor of the adoption of the question submitted, shall place a cross (X) mark in the space opposite the words "For -2- a Sewage Disposal Plant " A voter wishing to vote against the adoption of the question submitted, shall place a cross (X) mark in the space opposite the words "Against a Sewage Disposal Plant " If you wrongly mark, tear or deface this ballot, return it to the Judge of election and obtain another. When your ballot has been properly marked, deposit it in the separate ballot box provided for such purpose For a Sewage Disposal Plant Against a Sewage Disposal Plant A vote in favor of the question submitted will authorize the City Council to issue negotiable interest bearing bonds of the City, not to exceed $250,000 00 principal, at such rate of interest as is determined by the City Council and the proceeds to be used for acquiring a sewage disposal plant, together with necessary lands, rights of way, sewer mains and appurtenances for the treatment of the sewage of the City of Fort Collins A vote against the question submitted means that the voter does not wish the City to issue the above bonds. Section 5. No ballots for or against said question shall be received by the Judges unless the person offering the same shall be a qualified elector of the City of Fort Collins, and shall in the year next preceding said election, have paid a property tax therein Section 6. The Judges who shall act at the general municipal election in said City are hereby appointed as Judges of said election upon the question so submitted -3- 51 Section 7 The vote at said election on the question aforesaid shall be canvassed and returned, and the return made and the result declared in the same manner, as nearly as may be, as provided by the charter of the City of Fort Collins for the canvass, return and declaring of the result of the votes cast at an election of a City Commissioner Section 8 A notice of the time and place of said election shall be published in the Fort Collins Coloradoan, a daily newspaper and the official newspaper of the City of Fort Collins, at least fifteen days before such election, and also a copy of such notice shall be posted at the place of voting in eadh precinct, at least fifteen days before such election, announcing the time, place and object of the election, which notice may be included in and made a part of the general election notice of said election, and the Clerk of the City of Fort Collins is hereby charged with the duty of effectuating this provision Said notice shall be in substantially the following form ELECTION NOTICE NOTICE IS HEREBY GIVEN that pursuant to the provisions of Section 1 of Article XIV of the Charter of the City of Fort Collins, a general election will be held in the several precincts within the corporate limits of said City, on the 2nd day of April, A D 1946, for the purpose of electing one Commissioner of Finance and Supplies and Ex-Officip City Treasurer to serve for a period of six ( 6) years from the first Tuesday after the second Monday of April, 1946, and that said election will be held at the following places in said City, to-wit- -4— Precinct A-1 - City Hall Precinct B-1 - Colorado Farm Supply Company Precinct B-2 - LaPorte School Precinct B-3 - Community House , City Park Precinct 0-1 - Court House Precinct C-2 - Lincoln Junior High School Precinct C-3 - Unitarian Church Precinct C-4 - Washington School Precinct D-1 - Remington School Precinct D-2 - Bethlehem Lutheran Church Precinct D-3 - Laurel School Precinct E-1 - State Armory Precinct E-2 - Mame R Harris School And also, pursuant to Ordinance No. 2 of the City of Fort Collins, Colorado, adopted and approved on the _,lit_ day of March , A D 1946, public notice is hereby given that at the aforesaid election of a City Commissioner of the City of Fort Collins, to be held in said City on Tuesday, the 2nd day of April, 1946, there will be submitted to a vote of such qualified electors of the City of Fort Collins as shall, in the year next preceding said election, have paid a property tax therein, the following question Shall the City Council of the City of Fort Collins be authorized to contract an indebtedness on behalf of the City, and upon the credit thereof, by issuing the negotiable interest bearing bonds of the City in an aggregate principal amount of not exceeding $250s000 00 for the purpose of acquiring a sewage disposal plant for the City of Fort Collins? The ballots to be used in voting upon the question above submitted, will be furnished to the voters by the Judges of Election, to be deposited in a separate ballot box which will be provided for that purpose (Inserted in the above notice will be notice of the election of a Commissioner of Finance for the six (6) year term and certain provisions thereof Also notice of all other matters to be voted upon by the electors at said election } The polls for said general election shall be opened at the hour of seven o'clock A M and shall remain open continually and be closed at seven o' clock P M of said day, and said election shall be conducted in the manner prescribed by the City Charter and the law of the State of Colorado appli- cable thereto IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of said City, this 12th day of March , A D 1946 Miles F Hou$e City Clerk Section 9.
