HomeMy WebLinkAbout006 - 02/17/1923 - AMENDING SECTION 2 OF ORDINANCE NO. 012, 1917, RELATING TO THE REGULATION OF THE USE AND OCCUPANCY O r r ORDIAANCE NO 6, 1923 BEING AN EMERGENCY ORDIJANCE AMEYDING SECTION 2 OF ORDINANCE NO 12, 1917, RELATING TO THE RFGT1LtiTION OF THE USF AND OCCUPANCY OF STREETS, ALLEYS AND PUBLIC GROUNDS FOR THE PURPOSE OF INSTALLING WATER, SEWER, G4S AND OTHER SERVICE, AND ALSO TFE OCCUPANCY OF STREETS, ALLEYS AND PUBLIC GROUNDS FOR BUILDING 4ND OTHER PURPOSES BE IT ORDAINED BY THE CITY COUNCIL OF TFE CITY OF FORT COLLINS Section 1 That Section 2 of Ordinance No 12, 1917, relating to the regulation of the use and occupanc3 of streets, alleys and public grounds for the purpose of installing dater, sewer, gas and other service, be amended so as to read as follows "Sec}ion 2 Before any person or corporation shall have the right to have any excavation made in any street, alley or public ground of the City of Fort Collins except as provided in Sec'ion 1 of said Ordinance Ao 12, he, they or it shall file a written application with the Departlent of Public Works for permit to make such excavation, whicn application shall state specifically and illustrate by sketch or plan the exact location, depth, extent and nature of the proposed excavation it shall also state the purpose for which the permit is requested and when required to be completed, which application shall be so filed as to give not less than twenty-four hours notice, holidays and Sundays excluded, when the work shall be commenced Upon filing the said application, the Commissioner of Works or his assistant shall irlimediately make a statement to the applicant of the cost of said proposed work, including all tap and license fees, which said cost shall be based upon the standardized tabulated statement of cost heretofore prepared by the Gorks Department and duly adopted by the City Council, as a basis for all construction Bork under this section on February 10, 1923, in which standardized schedule of costs all street water mains are treated and adopted as being in 'he center of the street The applicant shall thereupon take said statement of cost to the City Clerk and pay the amount thereof to the City Clerk who shall thereupon issue a receipt, and then paid the Works Department shall be authorized to have the work covered by the application and the payment of the cost thereof done " Sec' ion 2 In the opinion of the City Council an emergency exists for the preservation of the public healtr , peace and safety, and this ordinance shall take effect upon its passage and publicat_on under and bj virtue of the authority contained in Sections 6 and 7 of Article IV of the City Charter Introduced, read at length and adopted by the unanimous vote of all the members of the City Council this 17th aay of February A D 1923 mmissioner of Sa an ExOfficio ATTFST Mayor City ClerTE— STATE OF COLORADO ) )SS COUNTY OF LARIMER ) I, A J ROSEITOW, City Clerk of the City of Fort Collins do hereby certify and declare that the foregoing ordinance, consisting of two (2) sections, vas duly proposed and read at lengt'i at a regular rreeting of the City Council held on the 17th day of February , A D 1923, and was duly adopted and ordered published _n the Fort Collins Courier, a daily newspaper and the official newspaper of the Citj of Fort Collins, by the unanimous vote of all members of the Council, as an emergency ordinance, in accordance with the provisions of Sections 6 and 7 of Article IV of the City Charter and thereafter , on torvit the 20th da3 of February , A D 1923, said ordinance No 6 was duly published in the Fort Collins Courier, a daily newspaper nublished in the City of Fort Collins, Colorado IN WITNESS IvHEREOF, I have hereunto set mj hand and affixed the seal of sald City, this 20ttii day of February, A D 1923 City Clerk
