HomeMy WebLinkAbout011 - 04/28/1923 - RELATING TO THE FIXING OF A SCHEDULE OF RATES, INCLUDING RULES AND REGULATIONS, SAID RATES TO BE CHA A ORDINANCE PTO �� , 1923 BEING AN ORDINANCE RELATTI7G TO TIE FIXING OF A SCHEDULE OF RATES INCIUDING RULES AND REGULATIONS SAID RATES TO BE CHARGED AND COLLECTED BY THE I'ESTFRN LIGHT AND POWER COMPANY FOR ELECTRIC LIGHT AND POWEP SERVICE AND UUNICIPAL LIGHTING WITHIN THE CORPORATE LIMITS OF THE CITY OF FORT COLLINS PURSUANT TO THE PROVISIONS OF SECTION 4 OF ARTICLE XVIII OF THE CITY CHARTER WHEREAS, Under and by virtue of Section 4, of Article XVIII of the City Charter, the power to regulate rates and to make rules and regulations for service by public utility corporations is reserved to the people to be exercised by ordinance of the Council and WHEREAS, The Commissioner of Works and Public Utilities, pursuant to the authority of the City Council, has investigated and caused to be investigated the matter of rates, rules and regulations for the service of electricity for light heat and power purposes, within the corporate limits of the City of Fort Collins, and has reported to the City Council on the said subject, wherein said Commissioner recommends to the City Council the passage of an ordinance covering said recommendations therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS Section 1 That The Western Light and Power Company nay to the City of Fort Collins an occupation tax, for the use and occupancy of the streets, alleys, and public grounds of the said city, in operating and n}aintaining its lines therein, one per cent on the gross revenues of the said company in monthly installments on sworn statements, prepared by said company and duly filed with the City Clerk at the time of such payment And for the purpose of advising the City of the correctness of the said returns, it shall be lawful for the Commissioner of Works and Public Utilities to inspect, or daase to be inspected the books of the said company, upon the malting of said returns and duly report to the City Council thereon and in addition the said company shall pas for the cost of publication of this ordinance t Section 2 The City Council finds and determines that the rates now being charged and collected by The Western Light & Power Company are fair and reasonable rates, and which schedule of rates is hereinafter set forth and adopted as the ,lust and lawful rates for the said Company to charge and collect within the corporate limits of the City of Fort Collins, for light, heat and power furnished to the inhabitants of said city and for municipal lighting, with certain additions and amendments in accordance with the terms and provisions of the schedule of rates hereinafter set forth in Section 3, together with the general rules and regulations filed with the City Clerk by the said Company, which said rules and regulations shall govern and control the said Company in rendering service and charging and collecting rates provided in this schedule, which schedule of rates is hereby accepted and adopted as controlling in the matter of the service to be rendered Lentil further modified by regulations of the City Council Section 3 The following schedule of rates is hereby adopted ✓ rates and approved which shall be t]M/lawful for the Western Light & Power Company to charge and collect for light and power service and municipal lighting within the corporate limits of the City of Fort Collins being the schedule of rates referred to in Section 2 of this ordinance SCxLDULE 1 GENERAL LIGHTING PATES - METERED AVAILABILITY General lighting and incidental power for service 24 hours per day RATE For the first 100 K W H used per month oer K W H 10¢ For the next 200 K W H used per month per K W H 90 For the next 300 K W H used per month Der K W H 8¢ For the next 400 K W H used per month per K W H 7¢ All over 1,000 K W H used per month per K W H 6¢ DISCOUDTP A discount of 5% will be allowed if bill is paid within 10 days after same is due MINIMUM GUARgTEE Minimum bill for residence lighting shall be $1 25 per month Minianim bill for commercial lighting shall be 20 cents net per 100 watts connected per month, and in any event not less then $1 25 net per month In determining the connected load for the purpose of calculating minimum monthly bills, heating devices fans and small utility motors not exceeding 4 horsepower in size, shall not be considered as forming part of ,ine customer's connected load Empty scokets shall be considered as 50 watts each SCHEDULE 2 COMMERCIAL LIGPTING RATES - ^IETERED - BUSIAESS HOUSES AVAILABILITY This schedule is available for service 24 hours per day to all commercial lighting customers who sign contracts under this schedule for definite connected load RATE For the first 60 hours average use per net month of maximum demand per K W H 100 gross For the next 120 hours average use per month of maximum demand per K W H 6¢ net For all current consumed in excess of 180 hours average use per month of maximum demand ner K W H 3¢ net DETERMINATION OF MAXITM! DEMAND Either by suitable demand meter or estimated as percentage of total connected load at comnanyl s option when estimated the maximum demand shall be 90% of first 5,000 watts and 70% of the balance of the total connected load, provided that no maximum demand shall be considered as less than 500 watts Heating devices, fans, and small utility motors, not exceeding 4 horsepower shall not be ircluded in calculating maximum demand Empty sockets shall be considered as 50 watts each PROMPT PAYNMT DISCOUNT Bills rendered at the gross rate for first 60 hours use of maximum demand and discounted to the net rate if paid within the 10 day discount period as indicated on the bill 3 MINIMUM GUARANTEE The customer must guarantee a minimum monthly bill of 200 net per 100 watts connected and in any event a minimum monthly bilk of not less than $1 25 net In determining the connected load for the purpose of calculating minimum monthly bills, heating devices, fans, and small utility motors not exceeding d horsepower in size shall not be considered m forming -Dart of the customerls connected load Empty sockets shall be considered as 50 watts each SCHEDJLE 3 COMEPCIAL FLAT RATE AND PORCH LIGHTING AVAILABILITY For sign and display lighting service controlled by company in business section only and for porch lighting of residences when other electric lighting service furnished by Flat rate for porch lighting, per month per watt 1 5¢ net MINIMUM GUARANTEE No flat rate for sign and display lighting shall be less than $1 50 per month No flat rate for porch lighting shall be less than 75 cents per month SCHEDULE 4 COTMINATION RESIDENCE LIGHTING COOTaN1TG AND TiEpTING AVAILABILITY Combination lighting, heating and cooking, for service 24 hours per day for residential use only This rate does not apply to clubs, fraternities, lodges, hotels or rooming houses 4 RATE Readiness to serve charge ner active room per month 250 net Plus an energy charge for the first 5 K W H per active room per month per K W H 5¢ net For the next 100 K W H used per month per K W T1 ' net For all excess used per month per K W H 3� net Active rooms include all rooms except halls, closets`"bath, rooms, pantries, and porches (unless the porch is used as sleeping porch, in whi ch case it will be considered an active room).* Basements will not be clas-ed as active rooms, unless they are used for other purposes than storage, furnace rooms, or laundries AINIMUM GUARANTEE The minimum monthly bill shall be the readiness to serve charge but in no case shall the residence be considered less than 6 active rooms for a minimum charge of not less than $1 50 per month DELAYED PAYMENT PENALTY Penalty of i cent per K W H will be added to bill if not paid wit'iin 10 days after same is due SCHEDULE 5 COOKING AND HEATING AVAILABILITY For use for cooking and heating only where there is a connected load in ranges or other appliances of 3 K W or over RATE For the first 100 K W used per month per K W H h net For all excess used per month per A W Hp 3¢ net DELAYED PAYMENT PENALTY Penalty of g cent per K W H will be added to bill if not paid within ten days after same is due MINIMUM MONTELY GUARANTEE The customer shall guarantee a minimun charge of at least $2 00 for connected load not exceeding 3 K W , and $1 35 for each additional K W connected over 3 K W for each month service is used and for at least three successive months each year SCHEDULE 6 MISCELLANEOUS SMALL COTa ERCIAL POWER AVAILABILITY For alternating current power service for installation of 5 horsepower or less at the voltage and phase of company's established system 5 RATE For the first 100 $ W H used per month per K W H 7¢ net For the next 250 K W H used per month per K W H 4¢ net For all over 350 K W H used per month per K W H 2¢ net DELAYED T'AYMENT PENALTY Penalty of j cent per K W H will be added to bill if not paid within 10 days after same is due MINIMUM MONTHLY GUARANTEE The customer shall guarantee a minimum monthly charge of $1 00 net per month for each horsepower or fraction thereof connected for each month in which service is demanded, and for not less than five consecutive months each year SCHEDULE 7 COWERCIAL AND INDUSTP.IAL POYER AVAILABILITY For alternating current power service for installations aggregating more than 5 horsepower at the voltage and phase of the comoany's established distribution system Power will be supplied under this schedule only to the extent that company shall have available power in excess of its regairements for other customers of %hich fact its horsepower shall be taken as the manufa� turersl name plate rating On installation of 2 motors the contract horsepower shall be taken as 80% of combined manufacturers' name plate rating On installation of 3 motors the contract horsepower shall be taken as 70% of combined manufacturers' name plate rating On installation of 4 motors the contract horsepower shall be taken as 60% of combined manufacttrerst name plate rating On installation of 5 motors the contract horsepower shall be taken as 50% of combined manufacturers' name plate rating On installation iof 6 or more motors the contract horsepower 6 shall be taken as 45% of combined manufacturers' name plate rating Each installation served from one meter or servicelshall be considered as a separate installation Provided on any installation the contract horsepower shall not be less than the manufacturers' name plate rating of the largest motor or appliance connected also at the option of the company the contract horsepower may be determined as the actual 15-minute maximum demand as measured by a suitable demand meter DELAYED PAYMENT PENALTY A penalty of i cent per K W H will be added to monthly bill if such bill is not paid within ten days after the same is due provided that such penalty shall not exceed $5 00 on any month's bill MINIMUM 'MONTHLY GUARANTEE The customer shall guarantee a minimum rronthly charge of $1 00 net per horsepower or fraction of contract horsepower for each month in which service is connected and for a period of at least 5 consecutive months of each year HOURS OF SERVICE Customers wnose load is 15 horsepower or more who do not guarantee to use service for 12 months each year shall not operate motor or motors bet%een the hours of 4 30 P M and 9 30 P M during the months of November, December, January and February except in cases of absolute necessity to protect life or property SCHEDULE 8 COIZ ERCIAL AND INDUSTRIAL POWXR AVAILABILITY By contract for alternating cur-ent power service for 12 months of each year for installation aggregating more tnen 5 horsepower at the voltage and phase of the company's established distribution system power will be supplied under this schedule only to the extent that company shall have available power in excess of its requirements for other customers, of which fact its determination shall be final RATE DKVLM CHARGE For being 0 8 times the contract horse- power which shall be determined as follows On installation of 1 motor the contract horsepower shall be taken as the manufacturers' name plate rating On installation of 2 motors the contract horsepower shall be taken as 80% of combined manufacturers' name plate rating On installation of 3 motors the contract horsepower shall be taken as 90% of combined manufacturers' name plate rating On installation of 4 motors the contract horsepower shall be taken as 60% of combined manufacturers' name plate rating On installs*ion of 5 motors the contract horsepower shall be taken as 50% of combined manufacturers' name plate rating On installation of 6 or more rm tors the contract horsepower shall be taken as 45% of combired manufacturers' name plate suitable demand meter MUM PAYIVMNT PENALTY A penalty of L cart per K W H will be added to mont)ly bill if such bill is not paid within ten days after the same is due, proviaed that such penalty shall not exceed $5 00 on any month's bill MINIMUM MONTHLY GUARANTEE The cus*orer shall guarantee a minimum monthly charge equal to the demand charge each month for 12 months of each year r UEL The energy charges Frovided herein are based on coal costing not less than $1 80 norm more than $2 80 per ton delivered at mean steam plant of company When such coal cost is in excess of $2 80 per ton, as sho%,n by the records of the company for the previous calendar month, the above base rate shall be increased 0 3 mills ($0 0003) per K W H for each increase of 10 tents per ton and when such coal cost is less than $1 80 per ton, the above base rate shall be decreased 0 3 mills ($0 0003) per K W H for each 1C cents tier ton decrease in the cost of coal H SPECIAL MULES CONTRACT PEPIOD All contracts under Schedules 2, 3, 4, 6 7 and 8 are for a minin-um period of 12 months, automatically renewable for a like period and terminable on 30 days' written notice before the end of any such period When the customer desires to change the connected load, a new contract may be entered into for a period of 12 months before the expiration of the original contract Customer is not permitted to change the connected load provided for in contract without signing new contract based on changes contemplated under penalty of refusal of further service under this schedule POINT OF MEASURMENT All current, under Schedules 6, 7 and 8 shall be considered as measured at the voltage of the company's established distribution sys*em at tia point where service is delivered Where the current is not metered at the company's established voltage, anVamount shall be added to monthly bill for electric service equivalent to 25 cents per month for each K W capacity df the aggregate rating of customer's transformers connected TRANSFOM ERS Cus omers who do not guarantee to use service for 12 months each year, under Schedules 6, 7 and 8, shall be required to furnish and maintain transformers for stepping-dowm voltage from tna.t furnished by company's distribution voltage to that required by customer's installation Company shall not be required to furnish transformers in any case unless they are of standard size and voltage POWER FACTOR. Should the average monthly pomr factor of unbhlance between phases of the customer's installation fall below 80%, under Schedules 7 and 84 the demand or contract horsepower shall for purpose of billing be increased in the ratio of W to the actual average power factor or unbalance GENERAL RULES AND REGULATIONS The General Rules and Regulations governing the supply and use of electrical service in the City of Fort Coliins shall be the same as those in effect in the balance of the territory in Colorado served by The Western Light and Power Company by the approval of The Public Utility the present City gall and Fire Station for ordinary and reasonable usage at a flat rate of $100 00 per annum TERMS AND CONDITIONS The company will install, maintain and operate arc lamps as required by the city at the above scheduled rates for street lighting The company will install, maintain and operate at the above scheduled rates for street lighting all incandescent overhead bracket or suspended street lights complete providing such lights are located within two Ynmdred feet of the nearest available p6int on its existing distribution system, and provided the 10 investment per fixture does not exceed the annual reve from each sucr unit The cor-pany will operate and maintain ornamental street lighting standards and install and maintain the overhead or underground wiring, as required for such standards at the above scheduled rates for street lighting Whenever the company installs ornamental street 1_ghting standards, at the request of the City, the Company shall charge for each such unit, in addition to the above schddule of street lighting rates, an amount equivalent to 12 per cent on such additional investment until it is reimbursed for such investment such 12 per cent Iierng 8 per cent interest and 4 per cent depreciation Bills shall be rendered by the company and paid by the city for all municipal lighting in equal monthly installments at the end of each
