HomeMy WebLinkAbout028 - 09/08/1923 - RELATING TO SALES OF FRUITS AND VEGETABLES, FROM ALL KINDS OF VEHICLES STANDING IN FRONT OF BUSINESS ORDINANCE NO `� �, 1923 BEING AN EMERGENCY ORDINANCE RELATING TO SALES OF FRUITS AND VEGFTABLES, FROM ALL HINDS OF VEHICLES STANDING IN FRONT OF BUSINESS HOUSES WITHIN THE BUSINESS DISTRICT OF THE CITY OF FORT COLLINS, AND PROVIDING A PUBLIC 'VMFET PLACE FOR SALES OF FRUITS AND VEGETABLES W&reas, The practice of vending fruits and vegetables of all kinds from all kinds of vehicles standing in front of business houses within the limits of the business dis1ttct of the City of Fort Collins is declared to be a nuisance interfering with and blockading traffic on the streets and sidewalks and is fast becoming a menace to the public health and safety of the inhabitants of the City of Fort Colli -is, therefore BE IT ORDAINED BY THE CITY COUNCIL OF THC CITY OF FORT COLLINS, COLORADO Section 1 That the vending or sale of fruits and vegetables from standing vehicles of all kinds in front of business houses on the streets of the City of Fort Collins, within the limits of the business district, within the corporate limits of the City of Fort Collins is hereby prohibited, provided such sales of fruits and vegetables may be made from standing vehicles of all kinds in the public market place hereinafter provided by Section Two of this ordinance and provided, further, that tics ordinance shall not be construed to apply to peddlers of fruits and vegetables within the corporate lirrits of the City of Fort Collins from moving vehicles and provided further this ordinance shall not be held to apply to licensed peanut and popcorn venders holding permits to operate stands within the business district from the owners of property Section 2 Immediately upon the taking effect of this ordinance it shall be the duty of the Comr^issioner of Safety and ExOf`icio Mayor to secure a place for establishing a temporary public market to be opened and operated by the City of Fort Collins under such rules and regulations as may be prepared and approved by the City Council such temporary public market place to be continued until a permanent public market place is acquited and placedin operation pursuant to ordinance to be adopted by the City Council Section 3 Any person or persons who shall violate any of the provisions -o-f this ordinance,shall upon conviction be fined not less than l / ✓e— Dollars nor more than One Hundred Dollars for each offense Section 4 In the o�rtiaion of the; City Council an emergency exists for the preservation of the public health, peace and safety, and l this ordinance shall take affect upon its passage and publication under and by virtue of the authority contained in Sections 6 and 7 of Article IY of the City Charter Ifitroduced, read at length and adopted by the unanimous vote of all the members of the City Council this 8th day of September A D 1923 issioner of Safety xOfficio Mayor ATTEST City Clerk STATE OF COXRADO) ) SS COUNTY OF LARIMER) I, A J ROSENOW City Clerk of the City of Fort Collins do hereby certify and declare that the foregoing ordinance, consisting of four (4) sections was duly proposed and read at length at a regular meeting of the City Council held on the 8th day of Seltember, 9 D 1923, and was duly adopted and ordered published in the Fort Collins r-rer, a daily newspaper and the official newspaper of the City of Fort Collins, by the unanimous vote of all members of the Council, as an emergency ordinance in accordance with the provisions of Sections 1-and 7 of Article IY of the City Charter and thereafter towit the c9 day of September A 923, said Ordinance No a was duly published in the Fort Collins ter a daily newspaper published in the City of Fort Collins, Colorado IN WITNESS WIMREOF� I have hereunto set my hand and affixed the seal of said City, this _/0 � day of September, A D 1923 City Clerk J
