HomeMy WebLinkAbout002 - 02/19/1938 - PROHIBITING THE PRACTICE OF GOING IN AND UPON PRIVATE RESIDENCES, PUBLIC BUILDINGS AND OFFICES IN TH ORDINANCE NO 20 1938 BEING AN EMERGENCY ORDINANCE PROHIBITING THE PRACTICE OF GOING IN AND UPON PRIVATE RESIDENCES, PUBLIC BUILDINGS AND OFFICES IN THE CITY OF FORT COLLINS, COLORADO , BY SOLICITORS, PEDDLERS, HAWKERS, ITINERANT MERCHANTS AND TRANSIENT VENDORS OF GOODS, WARES AND MERCHANDISE, BOOKS, PICTURES AND PERIOD- ICALS, NOT HAVING BEEN REQUESTED OR INVITED SO TO DO, DECLARING SUCK. PRACTICE TO BE A NUISANCE AND FIXING A PENALTY FOR THE VIOLATION THEREOF BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS Section 1 The practice of going in and upon private residences , public buildings and offices in the City of Fort Collins Colorado by solicitors peddlers , hawkers itinerant merchants and transient vendors of goods, wares and merchandise, books , pictures and periodicals , npt having been requested or invited so to do by the owner or owners , occupant or occupants of said private residences , public buildings or offices for the purpose of soliciting orders for the sale of goods wares and merchandise, or books pictures or periodicals or for the purpose of disposing of or peddling or hawking the same is hereby declared to be a nuisance and to be unlawful Section 2 Any attempt to obtain an invitation to visit such private residences public buildings and offices by personal solicitations, or promise of any demonstrations , pecuniary benefit , advantage or any gift , shall be deemed a violation of the terms and provisions of this ordinance Section 3 The Chief of Police and police force of the City of Fort Collins are hereby required and directed to L suppress the same and to abate any such nuisance as is described in the first section of this ordinance Section 4 Any person, fi}•m, co-partnership or corporation convicted of perpetrating a nuisance as defined in this ordinance shall be fined in a sum of not less than -1- $5 00 nor more than $300 00 Section 5 All ordinances and parts of ordinances in conflict with this ordinance are hereby repealed Section 6 Should any portion, phrase or paragraph of this ordinance be declared unconstitutional or void, it shall not affect the remaining phrases and paragraphs of this ordinance Section 7 In the opinion of the City Council an emergency exists for the preservation of the public health, peace and safety, and this ordinance shall take effect upon its passage under and by virtue of the authority contained in Sections 6 and 7 of Article IV of the City Charter Introduced, read at length and adopted by the unanimous vote of all members of the City Council at a regular adjourned meeting held this 19th day of February, A D 1938 Comm ss er a and Ex-Ufficio Attest kayor Clty Clerk STATE OF COLORADO, } ss County of Larimer ) I , MILES F HOUSE, City Clerk of the City of Fort Collins , do hereby certify and declare that the foregoing Ordinance , consisting of seven (7) sections, was duly proposed and read at length at a regular adjourned meeting of the City Council held on the 19th day of February A D 1938 and was duly adopted and ordered published in the Mountain and Plains Weekly a weekly newspaper and an official newspaper of the City of Fort Collins , by the unanimous vote of all members of the City Council, as an emergency ordinance , in accordance with the provisions of Sections 6 and 7 of Article IV of the City Charter, and thereafter and on to-wit the 25th day of February, A D 1938, said Ordinance No 2 , 1938, was duly published in the Mountain and Plains Weekly, a weekly newspaper published in the City of Fort Collins , Colorado IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of said City, this 25th day of February, A D 1938 City C er
