HomeMy WebLinkAbout009 - 08/12/1938 - CREATING A DEPARTMENT OF UTILITIES AND PROVIDING FOR THE ADMINISTRATION THEREOF (EMERGENCY ORDINANCE ORDINANCE NO. 9 1938, BEING AN EMERGENCY ORDINANCE CRFATIW A DEPARTMENT OF UTILITIES AND PROVIDING FOR THE AEUINISTRATION THEREOF. WHEREAS, the City Council is of the opinion that it would be to the best interests of the City that all utilities owned and operated by the City be under one management and under Ordinance No. 9, 1935 there is created a Light and Power Department with the office of manager thereof, and in the opinion of the City Council said manager should also be the manager of and responsible for the operation of all other utilities owned and operated by the City. THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS Section 1. That there is hereby created a Department of Utilities of the City of Fort Collins, designated as the Utility Department of the City and said Department shall include in its administration all property rights and obligations of the City that are employed in or related to the utilities owned and operated by the City, and shall as far as practicable be administered as an entity, except that at all times separate and complete accounting systems for each utility shall be maintained. Section 2 The Manager of the Light and Power Department as provided by Ordinance No. 9 , 1935, shall be the Manager of the Utility Department, he shall be responsible for the administration of said Department and shall have the right and duty of hiring and discharging all assistants and other employees of said Department and of purchasing supplies -1- and equipment for the same , subject to the necessary supervision of the Commissioner of Works and City Council as provided in the charter of the City of Fort Collins, he shall have the right and duty of using employees and equipment of one utility on the cork of another utility and of assigning employees to part time duty in two or more utilities Nhen in his judgment the same shall be desirable , provided, however, that proper allocation of necessary costs shall be charged against the utility receiving the service The salary of the Manager of Utilities shall be such amount as shall be fixed by the City Council and payable out of the funds of the several utilities owned by the City Section 3 This ordinance shall not in any respect alter, change or repeal any part of Ordinance No 9, 1935, or Ordinance No 15, 1936 Section 4 In the opinion of the City Council an emergency exists for the preservation of the public health, peace and safety, and this Ordinance shall take effect upon its passage, under and by virtue of the authority contained in Sections 6 and 7 of Article IV of the City Charter Introduced, read at length and adopted by the unanimous vote of all members of the City Council , et a regular meeting held this 12th day of August, A D 1938 Commis i er ety and Ex- ficio Mayor Attest City Clerk STATE OF COLORADO, ) ss County of Larimer ) I, MILES F HOUSE, City Clerk of the City of Fort Collins, do hereby certify and declare that the foregoing Ordinance, consisting of four (4) sections, was duly pro- posed and read at length at a regular meeting of the City Council, held on the 12th day of August, A D 1938, and was duly adopted and ordered published in the Fort Collins Express-Courier, a daily newspaper and an official newspaper of the City of Fort Collins, by the unanimous vote of all members of the City Council as an emergency ordinance, in accord- ance with the provisions of Sections 6 and 7 of Article IV of the City Charter, and thereafter and on to-wit the 16th day of August, A D 1938, said Ordinance No 9 was duly published in the Fort Collins Express-Courier, a daily news- paper published in the City of Fort Collins, Colorado IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of said City, this 16th day of August, A D 1938 City Clerk
