BEING AN EMERGENCY ORDINANCE CONCERNING THE PROTECTION OF LAWNS
GARDENS AND OTHER PRIVATE PROPERTY WITHIN THE CITY OF FORT
COLLINS , AND ALSO TO PROTECT THE CENTER PARYINGS IN STREETS AND
AVENUES AND THE ORNAMENTAL PLANTING THEREIN AND PROVIDING A PENALTY
THEREFOR
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS
Section 1 It shall be unlawful for any person
not the owner or occupant thereof , or acting with the permission
or by authority of such owner or occupant or being a member of
his or her family, to walk, run, ride or drive on or across any
lawn or garden upon any private premises within the City of Fort
Collins , or to take , remove , damage or destroy any flower, vegetable ,
fruit , shrub, vine , plant , tree , lawn , fence , building or other
improvements upon any private property within the City of Fort
Collins
Section 2 It shall be unlawful for any person
not an employee of the City of Fort Collins , in the discharge of
his duties , to be or to walk, run, ride or drive on or across any
center parking in any street or avenue within the City of Fort
Collins , or to take , damage or destroy any flower, shrub , plant
or tree growing thereon, without the permission or by the authority
of the Commissioner of Works
Section 3 Any person or persons who shall violate
the above ordinance , or any part thereof shall be fined in a
sum of not less than 05 00 nor more than $50 00 for such violation
thereof , or may be imprisoned until such time as said fine is paid
Section 4 In the opinion of the City Council an
emergency exists for the preservation of the public health , peace
and safety and this Ordinance shall take effect upon its passage
under and b5 virtue of the authority contained in Sections 6 and
7 of Article IV of the City Charter

Introduced, read at length and adopted by the
unanimous vote of all members of the City Council , at a regular
meeting of the City Council , held this loth day of April, A D

of Fort Collins , do hereby certify and declare that the aforesaid
Ordinance , consisting of four (4) sections , was duly proposed and
read at length at a regular meeting of the City Council , held on
the loth day of April , A D 1936 , and was duly adopted and ordered
published in the Fort Collins Express-Courier, a daily newspaper
and the official newspaper of the City of Fort Collins , by the
unanimous vote of all members of the City Council , as an Emergency
Ordinance in accordance with the provisions of Sections 6 and 7
of Article IV of the City Charter and thereafter and on to-wit
the 13th day of April A D 1936 , said Ordinance No 6 was
duly published in the Fort Collins Express-Courier, a daily
newspaper published in the City of Fort Collins , Colorado
IN WITNESS WHEREOF, I have hereunto set my
hand and affixed the seal of said City, this 13th day of April, A D
1936
