HomeMy WebLinkAbout002 - 02/14/1963 - ANNEXING PROPERTY KNOWN AS THE WEST ELIZABETH STREET ANNEXATION ORDINANCE NO, 2 1963s ACCEPTING AND APPROVING fHE PLTT70E-WHAT IS KNOWN AS THE WEST ELIZABETH STREET ANNEXATION TO THE CITY OF FORT COLLINS, COLORADO, AND AUTHORIZING THE ANNEXATION OF ALL THE TERRITORY EMBRACED IN SAID PLAT TO THE CITY OF FORT COLLINS AND TO BE INCLUDED WITHIN THE LIMITS AND JURISDIC- TION THEREOF, PURSUANT TO THE AUTHORITY CONTAINED IN ARTICLE 112 CHAPTER 139, COLORADO REVISED STATUTES, 1953. WHEREAS, heretofore a written petition was presented to the Council of the City of Fort Collins in substantial compliance with the provisions of i Article ll, Chapter 139, Colorado Revised Statutes, by the sole owners of the area of land embraced in what is known as the West Elizabeth Street Annexation to the City of Fort Collins, wherein and whereby said petitioners petitioned the City of Fort Collins for annexation of all the territory embrac- ed in what is known as the West Elizabeth Street Annexation to the City of Fort Collins, Colorado, comprising the lands shown in the plat thereof attached to said petition and more particularly described as hereinafter set forth, and AREAS, said petition was accepted by the Council of the City of Fort Collins by resolution passed and adopted on December 13, 19622 and WHEREAS, notice for hearing on the 24th day of January, A D., 19633, on an ordinance approving the annexation of said territory and including the same within the limits and jurisdiction of the City of Fort Collins was duly published as provided by law, and WHEREAS, the Council of the City of Fort Collins has found that the petition and the documents thereto attached meet the requirements of Article 11, Chapter 139, Colorado Revised Statutes, 1953, and WHEREAS, no proceedings for an election to determine the question of annexation have been initiated by written counter-petition as provided by law and no objection to annexation having been made, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 That after due consideration of the petition for annexa- tion, the petition for the annexation of all the territory in what is known and described as the West Elizabeth Street Annexation to the City of Fort Collins, Colorado, as shown by the plat thereof annexed to said petition and which is more particularly described as follows, to-wit Begin at a point N 89 43'30 W. 660.0 feet from the East quarter corner of Section 16-7-692 thence North 89 43'30 West 330 0 feet, thence North 00 25' West 660 0 feet, thence S 89 35130 East 330.0 feet, thence South 00 25' East 660.0 feet to point of beginning, containing 5.0 acres, more or less be accepted and approved and that said territory be annexed and made a part of the City of Fort Collins and be included within the limits and jurisdiction of the City of Fort Collins as a part of A Residence District, and that the City Clerk be and he is hereby authorized and directed to prepare certi- fied copies of this ordinance, to each of which shall be attached a plat of said West Elizabeth Street Annexation to the City of Fort Collins, Colorado, and shall file a copy thereof in the office of the Clerk and Recorder of the County of Larimer, and another copy thereof in the office of the Clerk of the City of Fort Collins, together with a certified copy of said petition and another copy of said petition and approving ordinance with the Secretary of State of the State of Colorado Section 2 Thatin accepting and approving the plat of the West Elizabeth Street Annexation to the City of Fort Collins, the City of Fort Collins does not assume obligations respecting the construction of water mains, sewer lines, gas mains, electric light lines or other services or utilities with respect to service of said addition, except as may be required and provided by the owners of the property within the limits of said addition in compliance with the terms and provisions of Chapter 152 Code of Ordinances of the City of Fort Collins, Colorado, 19582 as amended, relating to local and public improvements Introduced considered favorably on first reading and ordered published this 24th day of January, A D , 1963, and to beFresented for final passage on the 14th day of February, A D , 1963 Mayor ATTEST City Cl rk -2- Passed and adopted on final reading this 14th day of February, A D , 1963 � l Mayor ATTEST city Clerk -3-
