HomeMy WebLinkAbout018 - 12/13/1956 - ANNEXING PROPERTY KNOWN AS THE WESTERN ANNEXATION ORDINANCE NO 18 , 1956 ACCEPTING AND APPROVING THE PLAT OF WHAT IS liNO11N AS THL W1STERN ANNEXATION TO THE CITY OF FORT COLLINS, COLORADO, AND AUTHORIZING THE ANNEXATION OF ALL THE TERRITORY al- BRACED IN SAID PLAT TO THE CITY OF FORT COLLINS, THE SAME TO BE MADE A PART OF THE CITY OF FORT COLLINS AND TO BE INCLUDED WITHIN THE LIMITS AND JURISDICTION THEREOF, PUR- SUANT TO THE AUTHORITY CONTAINED IN ARTICLE ll, CHAPTER 139, COLORADO RBVIS_ED_STATUTES 1953^ ZvHEREAS, heretofore a written petition has been presented to the Council of the City of Fort Collins in substantial compliance with the provisions of Article 11, Chapter 139, Colorado Revised Statutes 1953 by 192 persons purporting to be 73 8% of the qualified electors in the area of the territory involved and further purporting to be the owners of 67.6% of the area of the land embraced in what is known as the western Annexation to the City of Fort Collins, wherein ar d whereby said petitioners and applicants petitioned the City of Fort Collins for the annexing of all the territory embraced in what is known as the Western Annexation to the City of Fort Collins, Colorado, comprising the lands shown in the plat thereof attached to said petition and more particularly described as hereafter set forth, and WHEREAS., said petition was accepted by the Council of the City of Fort Collins by resolution passed and adopted on the 27th day of September, A D 1956, and WHEREAS, notice for hearing on the 8th day of November, A D 1956, on an ordinance approving the annexation of said territory and including the same within the limits and jurisdiction of the City of Fort Collins was duly published as provided by law, and WHEREAS, the Council of the City of Fort Collins has found that the petition and the documents attached thereto meet the requirements of Article 11, Chapter 139, Colorado Revised Statutes 1953, and 'WHEREAS', no proceedings for an election to determine the question w of annexation have been initiated by written counter-petition as provided by law and no objection to annexation having been made BE IT ORDAINED BY THE COUNCIL OF THa CITY OF FORT COLLINS Section 1. That after due consideration of the petition for annexa- tion that the petition for the annexation of all the territory in what is known and described as the Western Annexation to the City of Fort Collins, Colorado, as shown by the plat thereof annexed to said petition and which is more particularly described as follows, to wit A portion of the North z of Section 15, Tounship 7 North, Range 69 West of the 6tn P M , Larz.mer County, Colorado, and considering the North line of said Section 15 as bearing due East and with all bearings herein relative thereto, contained within the following described boundary lines, to wit Beginning at a point on the South line of Birch Street in the Alvin L Miller Subdivision, according_to the plat filed for record on April 21, 1952, in Plat Book 6 on Page 47, which point is 990 00 feet South of the North line of said Section 15 and 1,088 00 feet West of the East line of said Section 15, and running thence West 232 00 feet, to the SW corner of said Alvin L Miller Subdivision, on the centerline of City Park Avenue, which point is also the SE corner of the Miller Brothers Second Subdivision, according to the plat filed for record on August 31, 1954, in Plat Book 6 on Page 88, thence West 340.00 feet, thence S 000201 E. 5 00 feet, tnence West 400 69 feet, thence S 00°201 E. 160 feet, thence West 579 31 feet, to the SW corner of said Miller Brothers Second Subdivision, thence West 19 98 feet, more or less, to the L7est line of the NFr of said Section 15, thence S. 00026, E 462 60 feet, more or less, along the hest line of the NE4 of said Section 15, to a point which is S. 00026t E 13617 60 feet, from the Mi corner of the�NE4 of said Section 15, thence West 1,329 58 feet, more or less, to-the East line of the West z of the N1^Fi of said Section 15, thence N. 00°291 W 22 70 feet, along the East line of the West oof the NW4 of said Section 15, thence West 666 52 feet, thence North 198 00 feet, thence West 664 93 feet, more or less, to a point on the West line of the N-vA. of said Section 15, which point is S 00032t E 1,396 90 feet from the NW corner of said Section 15, thence N 00032t ZJ 295 feet, along the West lane of the Mill of said Section, thence East 867 04 feet, to the SW corner of Lot 57 in the Miller Brothers Third Subdivision according to the plat filed for record on March 14, 1955,_un Plat Book 6 on Page 96, thence N 000291 W. 1,101 90 feet, more or less, along the West line of said Miller Brothers Thud Subdivision to a point on the North line of said Section 15, which is 868.00_feet East of the NW corner of said Section 15, - 2 - thence East 385 00 feet, along the North line of said Section 15, thence S 000291 E. 163 00 feet, along the Easterly line of Lot 28 in. the Miller Brothers Third Subdivision, thence East 115 00 feet, thence S. 000291 E 55 00 Net, thence East 500 00 feet, thence N 000291 W 218 00 feet, to a point on the North line of said Section 15, which is 11868 00 feet East of the NW corner of said Section, thence East 304 00 feet, along the North line of said Section 15, thence S. 000271 E. 230 00 feet, to the NW corner of Lot 1 in the Cook Subdivision, thence East 289 00 feet, along the Nortn line of Lots 1, 2, 3, and 4 in the Cook Subdivision, thence S 250431 E 84 36 feet, along the Northeasterly line of Lots 4 and 5 in the Cook Subdivision, thence S. 000271 E 185.00 feet, along the Easterly line of Lots 5 and 6 in the Cook Subdivision, to the SE corner of said Subdivision, thence West 35 00 feet, along the South line of Lots 6 and 7 in the Cook Subdivision, to the NE corner of the Roscoe Anderson Subdivision, _thence S. 000261 E 381.00 feet, thence East 20 00 feet, thence S 000261 E 117 00 feet, to the SE corner of the Roscoe Anderson Subdivision, thence East 180 00 feet, more or less, to the East line of the N'144 of said Section 15, thence N 00026t 67 816 49 feet, more or less, along the East line of the N-Wa of said Section 15 to the Northeasterly line of the County Road as described in a quit claim deed dated April 29, 1948, and recorded in Book 852 on Page 184, of the Larimer County Records, thence S 58004? E 91 22 feet, along the Northeasterly line of the County Road, thence S 890431 E 247 06 feet, along the Northerly line of the County Road, thence N 6LO141 E 117 80 feet, more or less, along the North- westerly line of the County Road to a point which is due Nortn of the NE corner of Lot 9 in the Slade Acres Subdivision according to the Plat filed for record on ]lay^3, 1948, an_Plat Book 6 on Page 17, thence South 324 24 feet, more or less, to the SE corner of Lot 9 in said Slade Acres Subdivision, thence Nest 288 96 feet, more or less, to the Nil corner of Lot 14 in the Miller Brothers Subdivision, according to the Plat filed for re- cord on May 10, 1954, in Plat Book 6 on Page 78, which Subdivision is now a part of the City of Fort Collins, thence S. 570531 E. 87 05 feet, thence S. 510531 E 127.70 feet, thence S 490051 E 190 70 feet, to the SW corner of Lot 13 in said Miller Brothers Subdivision, _ thence East 683.76 feet, along the South line of said Miller Brothers Subdivision, to the SE corner thereof, thence N. 000231 W. 250 00 feet, along the Ea$t lane of said Mi11er Brothers Subdivision, to the NE corner thereof, thence East 10 57 feet, more or less, to a point which is 1,511.00 feet West of the East lane of the NE4 of said Section 15, thence S 00020t E 330 00 feet, thence East 423.00 feet, and thence S 00020t E 165 00 feet,to the point of beginning, - 3 - J be accepted and approved and that the said territory be annaxed and made a part of the Citj of Fort Coll ins and be included within the limits and jurisdiction thereof and that the City Clerk be and he is authorized and airected to prepare certified copies of this ordinance, to each of which shall be attached a plat of said destern Annexation to the City of Fort Collins, Colorado, and shall file one copy thereof in the office of the Clerk and Recorder of the County of Larimer and another copy thereof in the office of the Clerk of the City of Fort Collins, together with a certified copy of the saia petition and another copy of said petition and approving ordinance with the Secretary of the State of Colorado Section 2. That in accepting and approving the plat of the Western Annexation to the City of Fort Collins, the City of Fort Collins does not assume obligations respecting the construction of water mains, sewer lines, gas mains, electric light lines or other services or utilities with respect to the service of said addition, except as may be required and provided by the owners of propertojithin the limits of said aadition at their own expense and except as may be initiated by the owners of said property within, the limits of said addition in compliance with the terms and provisions of Ordinance No 7, 1921, relating to local and public im- provements, as amended Introduced, considered favorably on first reading and ordered published this 8th day of November, A D 1956, and to be presented for final passage on December 13, A D 1956 Mayor ATTEST City Clerk m - - Passed apd adopted o•i final reading this 13th a y of December, A D 1956 f Mayor ATTEST City Clerk 5
