Home My WebLink About019 - 12/13/1956 - ANNEXING PROPERTY KNOWN AS THE BLEVINS SUBDIVISION ORDINANCE NO 19 1956 ACCEPTING AND APPROVING THE PLAT OF WHAT IS KNOavN AS THE BLEVINS SUBDIVISION TO THE CITY OF FORT COLLI19S, COLORADO, AND AUTHORIZING THE ANNEXATION OF ALL THE TERRITORY EM- BRACED IN SAID PLAT TO THE CITY OF FORT COLLINS, THE SAM TO BE MADE A PART OF THE CITYOF FORT COLLIN5 AND TO BE 131CLUDED WITHIN THE LTPaTS AND JURISDICTION THEREOF, PUR- SUANT TO THE AUTHORITY CONTAINED U ARTICLE-11, CHAPTER 139, COLORADO REVISED STATUTES 1953 WHEREAS, heretofore a written petition has been presented to the Council of the City of Fort Collins in substantial compliance with the provisions of Article 11, Chapter 139, Colorado Revised Statutes 1953 by 17 persons purporting to be 66 6 per cent of the qualified electors in the area of the territory involved and further purporting to be the owners of 60 5 per cent of the area of the land embraced in what is known as the Blevins Subdivision, wherein and whereby said petitioners and applicants petitioned the City of Fort Collins for the annexing of all the territory embraced in what is known as the Blevins Subdivision, comprising the lands shown in the plat thereof attached to said petition and more particularly described as hereafter set forth, and WHEREAS, said petition was accepted by the Council of the City of Fort Collins by resolution passed and adopted on the 27th day of September, A D 1956, and WHEREAS, notice for hearing on the 8th day of November, A D 1956, on an ordinance approving the annexation of said territory and in- cluding the same within the limits and jurisdiction of the City of Fort Collins was duly published as provided by law, and WHEREAS, the Council of the City of Fort Collins has found that the petition and the documents attached thereto meet the requirements of Article 11, Chapter 139, Colorado Revised Statutes 1953, and WHEREAS, no proceedings for an election to determine the question of annexation have been initiated by written counter-petition as provided by law and no objection to annexation having been made BE IT ORDAINED BY TIM COUNCIL OF THE CITY OF FORT COLLINS Section 1 - That after due consideration of the petition for annexa- tion that the petition for the annexation of all the territory in what is known and described as the Blevins Subdivision, as shown by the plat thereof annexed to said petition and which is more particularly described as follows., to-wit A portion of the Southeast 1 of the Southwest Y of Section 14, Township 7 North, Range 69 tdest of the 6th Principal Meridian, Larimer County, Colorado, contained within boundary lines beginning at the Southeast corner of the Southwest j of said Section 14, thence North 552.6 feet along the East line of said Southwes 4, thence West 424.5 feet parallel with the South line of said quarter section, thence South 552 6 feet parallel with the first course, thence East 424,5 feet to the point of beginning, be accepted and approved and that the said territory be annexed and made a part of the City of Fort Collins and be included within the limits and jurisdiction thereof and that the City Clerk be and he is authorized and directed to prepare certified copies of this ordinance, to each of which shall be attached a plat of said Blevins Subdivision, and shall file one copy thereof in the office of the Clerk and Recorder of the County of Larsmer and another copy thereof 3n the office of the Clerk of the City of Fort Collins, together with a certified copy of the said petition and another copy of said petition and approving ordinance with the Secretary of the State of Colorado Section 2 That in accepting and approving the plat of the Blevins Subdivision, the City of Fort Collins does not assume obligations respecting the construction of water mains, sewer lines, gas maa ns, elec- tric light lines or other services or utilities with respect to the service of said addition, except as may be required and provided by the owners of property within the limits of said addition at their own ex- pense and except as may be initiated by the owners of Baia property within the limits of said addition an compliance with the terms and pro- visions of Ordinance No 7, 1921, relating to local and public improvements, - 2 - as amended Introduced, considered favorably on first reading and ordered published this 8th day of November, A D 1956, and to be presented for final passage on December 13, A D 1956. AND, WHEREAS, said lands are contiguous to the CTLty Limits of the City of Fort Collins, Colorado, and WHEREAS, a plat of said lands has been prepared in accordance with the applicable provisions of the Colorado State Statutues, and provisions of the Ordinances of the City of Fort Collins , which said plat is submitted herewith, NOW.. THEREFORE, it is respectfully petitioned that said plat, comprising the above described lands, be accepted and approved, and that the territory embraced therein, be known as the ANNEXATION OF THE BLEVINS SUBDIVISION TO THE CITY OF FORT COLLINS, COLORAD09 be annexed and made a part of the City of Fort Collins, Colorado, and included within the limits and jurisdiction theredf. The applicants, for themselves and th®tr associates covenant and agree for themselves and their grantees, to and with the City of Fort Collins, that upon acceptance of the application that it is expressly agreed and understood that the applicants and their grantees expressly covenant and agree that they will be bound by and will observe and obey all ordinances in force and effect at the time of the acceptance of said annexation petition, respecting the installation of local public improvements.
