ACCEPTING AND APPROVING THE PLAT OF WHAT IS KNOWN AS THE
SECOND WESTERN ANNEXATION TO THE CITY OF FORT COLLINS,
COLORADO, AND AUTHORIZING THE ANNEXATION OF ALL THE TER-
RITORY EMBRACED IN SAID PLAT TO THE CITY OF FORT COLLINS
AND TO BE INCLUDED WITHIN THE LIMITS AND JURISDICTION
THEREOF PURSUANT TO THE AUTHORITY CONTAINED IN ARTICLE
11, CHAPTER 139, COLORADO REVISED STATUTES 1953
WHEREAS, heretofore a written petition has been presented to the
Council of the City of Fort Collins in substantial compliance with the pro-
visions of Article 11, Chapter 139, Colorado Revised Statutes 1953 by twenty-
three (23) individuals purporting to be 69 67 of the land owners of the area
involved and further purporting to be the owners of 76 7/ of the area of land
embraced in what is known as the Second Western Annexation to the City of Fort
Collins wherein and whereby said petitioners and applicants petitioned the
City of Fort Collins for the annexing of all the territory embraced in what
is known as the Second Western Annexation to the City of Fort Collins, Colo-
rado, comprising the lands shown in the plat thereof attached to said petition
and more particularly described as hereafter set forth, and
WHEREAS said petition was accepted by the Council of the City of
Fort Collins by resolution passed and adopted on the 12th day of December,
A D 1957 and
WHEREAS, notice for hearing on the 23rd day of January, A D 19589
on an ordinance approving the annexation of said territory and including the
same within the limits and jurisdiction of the City of Fort Collins was duly
published as provided by law and
WHEREAS the Council of the City of Fort Collins has found that the
petition and the documents attached thereto meet the requirements of Article
11 Chapter 139 Colorado Revised Statutes 1953, and
WHEREAS no proceedings for an election to determine the question
of annexation have been initiated by written counter-petition as provided by
law and no objection to annexation having been made,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
Section 1 That after due consideration of the petition for annex-
ation, that the petition for the annexation of all the territory in what is
known and described as the Second Western Annexation to the City of Fort Col-
lins Colorado, as shown by the plat thereof annexed to said petition and
which is more particularly described as follows, to-wit
Part of the SA of Section and of the NW4 of Section 15 both
in Township 7 North, Range 69 West of the 6th P M , Larimer
County, Colorado, contained within boundary lines which, con-
sidering the South line of the SW4 of said Section 10 as bear-
ing due East and with all bearings herein relative thereto
begin at the SW corner of the SE4 of the SA of said Section
10, and run
thence East, along the South line of the SW4 of said Section 10
22 00 feet,
thence Northerly, according to the description of a parcel of
land in the warranty deed recorded in Book 110 Page 102 of the
Larimer County records, 251 1 feet,
thence Easterly along the North line of the parcel of land in said
warranty deed, 935 07 feet, more or less, to a point which is
2228 07 feet Easterly and 252 92 feet Northerly from the SW corner
of said Section 10,
thence S 24 15' E 277 40 feet to the South line of the SW4 of Sec-
tion 10
thence West, along the North line of the NW4 of said Section 15
�15 08 feet, more or less, to the intersection of said North line
with the Northeasterly line of West Mulberry Street as described
in a quit claim deed dated April 29, 1948, and recorded in Book
852, at Page 184, of the Larimer County records,
—"thence S 58 04' E along said Northeasterly line of West Mulberry
Street, 324 61 feet to the East line of the NA of said Section
15,
thence S 00 26' E , along the East line of the NV& of said Section
15, 256 90 feet, to an intersection with the centerline of the
Larimer County Canal No 2,
thence along the meandering centerline of the Larimer County Canal
No 2 in a Northeasterly direction to a point on the North line
extended Of the Cook Subdivision of a part of the N4k of said Sec-
tion 15 which point is 2510 14 feet East and 230 00 feet South of
the NW corner of said Section 15,
thence West along the North line of said Cook Subdivision, 338 14
feet more or less, to the NW corner of Lot 1 of said Cook Subdiv-
ision,
thence N 00 27' W 230 00 feet to the North line of the Ntk of said
Section 15
thence West along the North line of the NW'k of said Section 15, 304 00
feet,
thence S 00 29' E 218 00 feet,
thence A 500 00 feet,

thence N 00 29' W 55 0 feet
thence W 115 00 feet
thence N 00 29 W 163 00 feet to the North line of the Nib
of said Section 15
thence East along the North line of the NW'k of said Section
15, 78 00 feet more or less to the point of beginning containing an
area of 10 921 acres more or less
be accepted and approved and that the said territory be annexed and made
a part of the City of Fort Collins and be included within the limits and
,jurisdiction thereof and that the City Clerk be and he is hereby author
ized and directed to prepare certified copies of this ordinance to each
of which shall be attached a plat of said Second Western Annexation to
the City of Fort Collins Colorado and shall file one copy thereof in
the Office of the Clerk and Recorder of the County of Larimer and another
copy thereof in the office of the Clerk of the City of Fort Collins to-
gether with a certified copy of said petition and another copy of said
petition and approving ordinance with the Secretary of State of the
State of Colorado
Section 2 That in accepting and approving the plat of the
Second Western Annexation to the City of Fort Collins the City of Fort
Collins does not assume obligations respecting the construction of water
mains sewer lines gas mains electric light lines or other services or
utilities with respect to the service of said addition except as may be
required and provided by the owners of property within the limits of
said addition at their own expense and except as may be initiated by the
owners of said property within the limits of said addition in compliance
with the terms and provisions of Ordinance No 7 1921 relating to local
and public improvements as amended
