HomeMy WebLinkAbout053 - 01/09/1964 - AMENDING CHAPTER 19 OF THE CITY CODE BY ADDING PROVISIONS REQUIRING OFF STREET PARKING IN THE ZONING ORDINANCE N0. 53 1963, BEING AN ORDINANCE AMENDING CHAPTER 19 OF THE CODE OF ORDINANCES OF THE CITY OF FORT COLLINS, COLORADO, 1958s AS AMENDED, BEING THE ZONING ORDINANCE, BY ADDING TO SAID ZONING ORDINANCE PROVISIONS REQUIRING OFF-STREET PARKING IN THE ZONING DISTRICTS THEREIN CREATED BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 That Section 19-1 of the Code of Ordinances of the City of Fort Collins, Colorado, 1958, as amended, be and the same hereby is amended as follows a) By adding to the definition of "family" the following "provided, however, that family shall not include a group of more than 3 individuals who are not related by blood or marriage " b) By adding thereto the following definitions 1. "Off-Street Parking Space shall be an area of at least 300 square feet of appropriate dimensions for the parking of an automobile including access drives and aisles thereto." 2. 'Dwelling Unit shall mean one or more rooms which are designed for or occupied by one family living and cooking in a one-family dwelling, two-family dwelling, or multiple dwelling " 3. "Employees shall mean the gross number of persons to be employed in the building in question during any season of the year at any time of the day or night " 4. "Floor Area is the gross floor area used or intended to be used for service to the public as customers, clients, or patients It shall not mean floors or parts of floors used principally for non-public purposes such as for the storage, repair, or packaging of merchandise for offices incidental to the management or maintenance of stores or buildings or rooms used for rest rooms or for utilities." 5. "Major Addition shall pertain to the extension of an existing building where the cost of addition, not including repairs and re-construction of the existing building, is in excess of the assessed valuation of the existing building as assessed by the Larimer County Assessor during the year preceding the year in which such major addition takes place." Section 2. That Chapter 19 of the Code of Ordinances of the City of Fort Collins, Colorado, 1958, as amended, be and the same hereby is amended by making Section 19-12 Section 19-20, and by making Section 19-13 Section 19-21, and by making Section 19-14 Section 19-22, and by making Section 19-15 Section 19-23, and by making Section 19-16 Section 19-24, and by making Section 19-17 Section 19-25. J Section 3 That Chapter 19 of the Code of Ordinances of the City of Fort Collins, Colorado, 1958, as amended, be and the same hereby is amended by adding thereto the following sections "Section 19-12. Off-Street Parking Required. In the use of land for residential, commercial, industrial, or any other purpose, no building or structure shall be erected and no major addition shall be made to an existing building unless there is in existance upon the lot or unless there is provided on the lot concurrently with such erection or major addition off-street parking spaces on the basis of at least the following minimum requirements (a) Dwellings including one-family, two-family, and multiple family dwellings at least one off-street parking space for each dwelling unit (b) Fraternity houses, sorority houses, rooming houses, hotels, motels, dormitories, and similar places offering u sleeping accommodations at least one off-street parking space for each sleeping room or for every four beds, which- ever is greater. (c) Churches, elementary and high schools, private clubs, lodges, and similar places having auditoriums or facilities for public assembly at least one off-street parking space for each 10 seats in an auditorium or place for public assembly or one for each 100 square feet of the auditorium or public assembly place floor area, whichever is greater. (d) Commercial uses (including professional uses) located in a block not more than 25% occupied with commercial buildings at the time of passage of this ordinance at least one off-street parking space for each 300 square feet of floor area (e) Industrial uses located in a block not more than 25% occupied with industrial or commercial buildings at the time of passage of this ordinance at least one off-street parking space for each 5 employees " "Section 19-13 Alternate Location of Parking Spaces. In lieu of providing parking spaces called for in Section 19-12 on the lot which generates the parking requirements, such parking spaces may be provided on any lot or premises owned by the owner of the parking generator, a substantial portion of which is at least within 200 feet of the property generating such parking requirements for any residential use and within 400 feet of the property generating such parking requirements for any commercial or industrial use " "Section 19-14. Restrictions on Other Uses All area counted as off-street parking space shall be unobstructed and free of other uses." "Section 19-15. Access. Unobstructed access to and from a street shall be provided for all off-street parking space. " "Section 19-16. Protection of Adiacent Property All open off-street parking spaces shall be surfaced with asphalt, concrete, compacted gravel, or other dustless material All open off-street parking areas with 10 or more spaces shall be adequately screened from any adjoining residentially zoned lot -2- by a fence or wall at least four feet, but not more than six feet, in height or by a strip at least four feet wide densely planted with trees or shrubs which shall be main- tained in good condition at all times In addition, if lighting is provided, it shall not be directed toward any adjacent residential areas " "Section 19-17. Joint Facilities Off-street parking spaces may be provided in areas designed to serve jointly two or more buildings or users provided that the total number of off-street parking spaces shall not be less than that required by this ordinance for the total combined number of buildings or uses " "Section 19-18 Reduction No part of an off-street parking space required for any building or use for the purpose of complying with the provisions of this ordinance shall be included as a part of an off-street parking space similarly required for another building or use and no part of an off-street parking space required for any building or use for the purpose of complying with the provisions of this ordinance shall be converted to any use other than parking unless additional parking space is provided to replace such converted parking space and to meet the require- ments of any use to which such parking space is converted " "Section 19-19 Hardships In case of unusual hardship arising out of the parking requirements herein contained, recourse may be had to the Zoning Board of Appeals as in other cases " Section 4 That Section 19-21 (formerly Section 19-13) of the Code of Ordinances of the City of Fort Collins, Colorado, 1958, as amended, be and the same hereby is amended by deleting therefrom the words and figures "19-1 to 19-16" in both places where such words and figures appear and by substituting therefor the words and figures "19-1 to 19-25 " Section 5 That Section 19-10 of the Code of Ordinances of the City of Fort Collins, Colorado, 1958, as amended, be and the same hereby is amended by deleting therefrom the words and figures "19-1 to 19-16" in both places where such words and figures appear and by substituting therefor the words and figures "19-1 to 19-25 " Section 6 If any section, sub-section, sentence, clause, phrase, or portion of this ordinance is for any reason held invalid or unconstitutional by any Court of competent ,jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions hereof.
