ORDINANCE NO , 1959
ACCEPTING AND APPROVING THE PLAT OF WHAT IS KNOWN AS
MILLER BROTHERS THIRD FOOTHILLS ANNEXATION TO THE CITY
OF FORT COLLINS, COLORADO, AND AUTHORIZING THE ANNEXATION
OF ALL THE TERRITORY EMBRACED IN SAID PLAT TO THE CITY
OF FORT COLLINS AND TO BE INCLUDED WITHIN THE LIMITS AND
JURISDICTION THEREOF PURSUANT TO TIRE AUTHORITY CONTAINED
IN ARTICLE 11, CHAPTER 139, COLORADO REVISED STATUTES, 1953
WHEREAS heretofore written petition was presented to the Council
of the City of Fort Collins in substantial compliance with the provisions
of Article 119 Chapter 139, Colorado Revised Statutes, 1953, by the sole
owners of the area of land embraced in what is known as the Miller Brothers
Third Foothills Annexation to the City of Fort Collins wherein and whereby
said petitioner petitioned the City of Fort Collins for the annexation of all
the territory embraced in what is known as Miller Brothers Third Foothills
Annexation to the City of Fort Collins, Colorado, comprising the lands shown
in the plat thereof attached to said petition and more particularly described
as hereinafter set forth, and
WHEREAS said petition was accepted by the Council of the City of
Fort Collins by resolution passed and adopted on the 24th day of December,
A D 1958, and
WHEREAS, notice for hearing on the 12th day of February, A D. 1959,
on an ordinance approvingthe annexation of said territory and including the
same within the limits and jurisdiction of the City of Fort Collins was duly
published as provided by law, and
WHEREAS the Council of the City of Fort Collins has found that the
petition and the documents thereto attached meet the requirements of Article 11 r
Chapter 139 Colorado Revised Statutes 1953 and
WHEREAS, no proceedings for an election to determine the question
of annexation have been initiated by written counter-petition as provided by
law and no objection to annexation having been made,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
Section 1 That after due consideration of the petitiono for annexation
the petition• for the annexation of all the territory in what is known and
described as Miller Brothers Third Foothills Annexation to the City of Fort
Collins Colorado, as shown by the plat thereof annexed to said petition and
which is more particularly described as follows, to-wit
Part of the SWk of Section 15, Township 7 North
Range 69 West of the 6th P.M., which considering the
West line of the SW'y of said Section 15 as bearing
S 0 32' E and with all bearings contained herein
relative thereto begin at a point which bears S. 0 32'
E 760 feet from the NW corner of the SWk of said
Section 15, said point being the SW corner of Miller
Brothers Second Foothills Annexation to the csty of
Fort Collins, Colorado and run thence S. 0 32' E 641
feet along the West line of the SWk of said Section 15,
thence N. 89 28' E 90 feet, thence along the arc of a
420 foot radius curve to the left a distance of 143 43
feet, the long chord of which bears N 79 41' E 142 73
feet, thence N 69 54' E 432 feet, thence along the
arc of a 700 foot radius curve to the right a distance
of 337 20 feet, the long chord of which bears N 83 42'
E 333 94 feet, thence S. 82 30' E 320 17feet, thence
N 0 32' W 629 13 feet to the SE corner of the Miller
Brothers Second Foothills Annexation, and thence S 83 0'
W 1295 17 feet, to the point of beginning, containing
an area of 17 42 acres, more or less, and subject to
the right-of-way of the County road over the Westerly 30
feet thereof
be accepted and approved and that the said territory be annexed and made a
part of the City of Fort Collins and be included within the limits and juris-
diction thereof andthat the City Clerk be, and he is hereby authorized and
directed to prepare certified copies of this ordinance, to each of which shall
be attached a plat of said Miller Brothers Third Foothills Annexation to the
City of Fort Collins, Colorado, and shall file a copy thereof in the office
of the Clerk and Recorder of the County of Larimer and another copy thereof
in the office of the Clerk of the City of Fort Collins, together with a
certified copy of said petition and another copy of said petition and approving
ordinance with the Secretary of State of the State of Colorado,
Section 2 That in accepting and approving the plat of the Miller
Brothers Third Foothills Annexation to the City of Fort Collins the City
of Fort Collins does not assume obligations respecting the construction of
water mains sewer lines gas mains, electric light lines or other services or
utilities with respect to service of said addition, except as may be required
and provided by the owners of property within the limits of said addition in
compliance with the terms and provisions of Ordinance No. 7, 1921 relating
to local and public improvements, as amended
Introduced, considered favorably on first reading and ordered
published this 12th day of February, 1959, and to be presented for final
passage on the 12th day of March 1959 ,
