ORDINANCE NO 3115 1958
ACCEPTING AND APPROVING THE PLAT OF WHAT IS KNOWN AS
FIRST SOUTH SHIELDS STREET ANNEXATION TO THE CITY OF
FORT COLLINS COLORADO AND AUTHORIZING THE ANNEXATION
OF ALL THE TERRITORY EMBRACED IN SAID PLAT TO THE CITY
OF FORT COLLINS AND TO BE INCLUDED WITHIN THE LIMITS
AND JURISDICTION THEREOF PURSUANT TO THE AUTHORITY
CONTAINED IN ARTICLE 110 CHAPTER 1399 COLORADO REVISED
STATUTES, 1953
WHEREAS, heretofore written petitions were presented to the
Council of the City of Fort Collins in substantial compliance with the
provisions of Article 11, Chapter 139, Colorado Revised Statutes, 1953,
by the sole owners of the area of land embraced in what is known as
the First South Shields Street Annexation to the City of Fort Collins,
wherein and whereby said petitioners petitioned the City of Fort Collins
for the annexation of all the territory embraced in what is known as First
South Shields Street Annexation to the City of Fort Collins, Colorado,
comprising the lands shown in the plat thereof attached to said petition
and more particularly described as hereinafter set forth, and
WHEREAS, said petitions were accepted by the Council of the City
of Fort Collins by resolution passed and adopted on the 25th day of
September, 1958, and
WHEREAS, notice for hearing on the 13th day of November, A D.9.
1958, on an ordinance approving the annexation of said territory and
including the same within the limits and jurisdiction of the City of Fort
Collins was duly published as provided by law, and
WHEREAS the Council of the City of Fort Collins has found that
the petitions and the documents thereto attached meet the requirements of
Article 11, Chapter 139 Colorado Revised Statutes, 1953, and
WHEREAS, no proceedings for an election to determine the question
of annexation have been initiated by written counter-petition as provided
by law and no objection to annexation having been made,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
Section 1 That after due consideration of the petitions for
annexation, the petitions for the annexation of all the territory in what
is known and described as First South Shields Street Annexationtb the
City of Fort Collins, Colorado, as shown by the plat thereof annexed to
said petitiore and which is more particularly described as follows, to-wit
Part of the Northeast -t Section 150 Township 7 North,
Range 69 eldest of the 6th P M , Larimer County, Colorado
contained within boundary lines which begin at a point
on the East line of the Northeast ;4 of said Section 150
which point is 1093 feet North of the Southeast corner
of the Northeast t of said Section 15, which point is
also the Southeast eorner of the Clair F Wolfer
Annexation to the Cityoof Fort Collins, Colorado, accord-
ing to the Plat, dated December 120 1956s and running
thence Test, parallel to the North line of the Northeast
;4 of said Section 159 1290 feet to a point 30 feet East
of the centerline of City Park Avenue extended South,
thence South, parallel to the East line of the Northeast
t of said Section 15, 169 feet, thence East, parallel to
the North line of the Northeast TT4 of said Section 15,
1020 feet to a point 270 feet West of the East line of
the Northeast T4 of said Section 150 thence South, parallel
to the East line of the Northeast k of said Section 150
87 3 feet, thence East parallel to the North line of
the Northeast y of said Section 159 100 feet to a point
170 feet West of the East line of the Northeast J; of said
Section 15, thence South, parallel to the East line of
the Northeast �;cE said Section 15, 102 3 feet, thence
West, parallel to the North line of the Northeast t said
Section 15, 30 feet to a point 200 feet West of the East
line of the Northeast k of said Section 159 thence South
parallel with the East line of the Northeast t of said
Section 15, 141 feet, thence East, parallel to the North
line of the Northeast k said Section 15, 200 feet to a
point on the East line of the Northeast '; of said Section
15, thence North, along the East line of the Northeast k
said Section 15, 49$ 6 feet to the point of beginning, and
containing an area of 6 593 acres, more or less,
be accepted and approved and that the said territory be annexed and made a
part of the City of Fort Collins and be included within the limits and
jurisdiction thereof and that the/City Clerk be and he is hereby authorized
and directed to prepare certified copies of this ordinance, to each of which
shall be attached a plat of said First South Shields Street Annexation to
the City of Fort Collins, Colorado, and shall file a copy thereof in the
Office of the Clerk and Recorder of the County of Larimer and another
copy thereof in the Office of the Clerk of the City of Fort Collins, together
with a certified copy of said petitions and another copy lof said petitiocs and
approving ordinance with the Secretary of State of the State of Colorado
Section 2 That in accepting and approving the plat of the First
South Shields Street Annexation to the City of Fort Collins, the City of
Fort Collins does not assume obligations respecting the construction of
water mains, sewer lines, gas mains, electric light lines or other services
or utilities with respect to service of said addition, except as may be
required and provided by the owners of property within the limits of said
addition in compliance with the terms and provisions of Ordinance No 7,
1921, relating to local and public improvements, as amended
Introduced, considered favorably on first reading and ordered
published this 13th day of November, 19580 and to be presented for final
passage on the lkth day of December, 1958,
