ORDINANCE NO. 19, 1960,
ACCEPTING AND APPROVING THE PLAT OF WHAT IS KNOWN AS
MILLER.BROTHERS NINTH FOOTHILES,ANNEXATION TO THE CITY
OF..FORT. COLLINS, COIARADO,.AND_AUTHORIZING THE.ANNEXATION
OF:ALL.THE_TERRITORY.EMBRACED .IN SAID.PIAT TO THE CITY,
OF FORT.COLLINS:AND.TO BE-INCLUDED WITHIN. THE LIMITS.AND
JURISDICTION.TH_EREOF, PURSUANT TO .THE.AUTHORITY.CONTAINED
IN ARTICLE 11, CHAPTER 139, COLORADO REVISED.STATUTES, 1953.
WHEREAS, heretofore' a written petition was presented to the Council
of the City of Fort Collins in substantial compliance with the provision of
Article 112 Chapter 1393, Colorado Revised Statutes, 1953, by the sole owners
of the area of land embraced in what is known as Miller Brothers Ninth
Foothills Annexation to the City of Fort Collins, wherein and whereby
said petitioners petitioned the City of Fort Collins for the annexation of
all the territory embraced in what is known as Miller Brothers Ninth Foothills
Annexation to the City of Fort Collins, Colorado, comprising the lands shown
in the plat thereof attached to said petition and more particularly described
as hereinafter set forth, and
WHEREAS, said petition was accepted by the Council of the City of .
Fort Collins by resolution passed and adopted on May 26, 1960, and
WHEREAS, notice for hearing on the 14th day of July, A.D. 19603,
on an ordinance approving the annexation of said territory and including the
same within the limits and jurisdiction of the City of Fort Collins was duly
published as provided by law, and
WHEREAS, the Council of the City of Fort Collins has found that the
petition and the documentsthereto attached meet the requirements of Article
11, Chapter 139, Colorado Revised Statutes, 19531, and
WHEREAS, no proceedings for an election to determine the question
of annexation have been initiated by written counter-petition as provided by
law and no objection to annexation having been made,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS:
Section 1. That after due consideration of the petition for
annexation, the petition for the annexation of all the territory in what is
known and described as Miller Brothers Ninth Foothills Annexation to the City
of Fort Collins, Colorado, as shown by the4plat thereof annexed to said petition
and which is more particularly described as follows, to-wit:
A tract of land situate in the SW4 of Section 15,
Township 7-North., Range 69 'blest of the 6th P.M„
County of' Larimer,' State of' Colorado, which,
considering the West line of said SW, . as bearing
N. 00032' W. and.with. all. bearings contained herein
relative. thereto,• is contained within the boundary
lines which begin at a point which bears S, 000.32' E.
1,731.00 feet and again N. 89'28' E. 380,00 feet from
the NW corner of said SW4, and run thence_ N. 00'32' W.
120.78 feet; thence N.. 69'54' E, 369.47 feet;: thence
N: 83°42' E. 205,14 feet; .thence So 82'30'- E. 79.98
feet; thence S. 07030' W. 420,00 'feet; thence S. 82030'E
186.10 feet; thence S. 00'32' E. 38,30 feet;. thence N.
89`28' E. 150.00 feet; thence S. 00'32' E. 38.70 feet;
thence S.. 89049130" E. 131089 feet; 'thence S. 00'32' E.
660.00 feet to a point on the South Line of said .%&;
thence N. 89'49'30" W. 819.00 feet along said South.
line of said S4J3,L.; thence N. 00032' W. 489.00 feet; thence
N. 340.56" W. 336.22 feet; thence N. 00'32' W. 150.00
feet; thence S. 89,.028' W. 30.00 feet to the point of
beginning, containing 19.3231 acres, more or less;
be accepted and approved and that the said territory be ,annexed and made a
part of" the City of Fort Collins and be included within the limits and
jurisdiction thereof, and that the following described land, to-wit:
Lots 77, 1122 128 through 138, 145 through 148
of. Miller- Brothers Ninth Foothills Annexation to
the City of Fort Collins, -Colorado, .as described,
on the proposed annexation,"plat of said subdivision;
be included in the "B" Residence District, and .that .the following land,
to-wit:
Lots 76, and 113 through 127 of Miller Brothers Ninth
Foothills Annexation to the City of Fort Collins,
Colorado, as described on the proposed annexation
plat of said subdivision;
be included as "C" Residence District, and that the City Clerk be,
and he is hereby authorized and directed to prepare certified copies of this
ordinance to each of which shall'be attached a-plat of said Miller Brothers
Ninth Foothills Annexation to the City of Fort Collins, Colorado, and shall
file a copy thereof in the office of the Clerk and Recorder of the County
of Larimer and another copy thereof in the office of the Clerk of the City of
Fort Collins, together with a certified copy of said petition and another copy
of said petition and approving ordinance with the Secretary of State of the
State of Colorado.
Section 2. That in accepting and approving the plat of the Miller
Brothers Ninth Foothills Annexation to the City of Fort Collins, the City of
Fort Collins does not assume obligations respecting the construction of water
mains, sewer lines, gas mains, electric light lines or other services or utilities

with respect to service of said addition, except as-may be required and
provided by .the owners of property within the 1imits' of said addition in
compliance with the terms and provisions of Ordinance Nop 7, 1921, relating
to local and public improvements as amended.
Introduced, considered favorably on first reading and ordered
published this ,14th. day of July, 19603, and to be' presented 'for ,final
passage on the Ith day of August, 19600
