HomeMy WebLinkAbout013 - 12/02/1948 - VACATING THE ALLEY IN BLOCK 4 (EMERGENCY ORDINANCE) Lw ORDINANCE NO 13 1948 BEING AN EMERGENCY ORDINANCE VACATING THE ALLY IN BLOCK 4 IN THE CITY OF FORT COLLINS, COLORADO, ACCORDING TO PLAT FILED JANUARY 18, 1873 WHEREAS, The plat of Block 4 in the City of Fort Collins filed on January 18, 1873, shows an alley running north and south, which is more particularly described by metes and bounds as follows, to-wit Beginning at the northeast corner of Lot 3 in Block 4 in the City of Fort Collins, thence South 269 85 feet, thence South 830 37' East 12 80 feet, thence North 410 10' East 10 94 feet, thence North 263 27 feet, thence West 20 00 feet to the point of beginning, AND WHEREAS, Said alley has never been opened to the public and has never been used as an alley and for many years last past has been abandoned and has been closed to public travel, and WHEREAS, The owners of the lots abutting on said alley have petitioned the City Council to cause the same to be vacated, and WHEREAS, The City Council is of the opinion that it will be to the best interests of the City to vacate said alley, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS Section 1 That the alley in Block 4 in the City of Fort Collins, according to plat filed January 18, 1873, and more particularly described as follows, to-wit Beginning at the northeast corner of Lot 3 in Block 4 in the City of Fort Collins, thence South 269 85 feet, thence South 83037' East 12 80 feet, thence North 41*10' East 10 94 feet, thence North 263 27 feet, thence West 20 00 feet to the point of beginning, be and the same is hereby vacated, abolished and abandoned a , Section 2 In the opinion of the City Council an emergency exists for the preservation of the public health, peace and safety, and this ordinance shall take effect upon its passage under and by virtue of the authority contained in Sections 6 and 7 of Article IV of the City Charter Introduced, read at length, and adopted by the unanimous vote of all members of the City Council, at a regular meeting held this 2nd day of December, A D 1948 —T Ma#yor Attest City Clerk -2- 1 STATE OF C OLORAD 0 ) SS COUNTY OF LARIMER ) I, MILES F HOUSE, City Clerk of the City of Fort Collins, do hereby certify and declare that the aforesaid Ordinance, consisting of two sections, was duly proposed and read at length at a regular meeting of the City Council, held on the 2nd day of December, A D 1948, and was duly adopted and ordered published in the Fort Collins Coloradoan, a daily newspaper and official newspaper of the City of Fort Collins, by the unanimous vote of all members of the City Council, as an Emergency Ordinance, in accordance with the provisions of sections 6 and 7 of Article IV of the City Charter, and there- after and on, to-wit the 7th day of December, A D 1948, said Ordinance No 13 was duly published in the Fort Collins Coloradoan, a daily newspaper published in the City of Fort Collins, Colorado IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of said City, this 7th day of December, A D 1948 City Clerk
