HomeMy WebLinkAbout012 - 10/24/1952 - VACATING THE ALLEY IN BLOCK 324, CAPITOL HILL ADDITION (EMERGENCY ORDINANCE) ORDINANCE NO 12 , 1952 BEING AN EMERGENCY ORDINANCE VACATING THE ALLEY IN BLOCK 324, CAPITOL HILL ADDITION TO THE CITY OF FORT COLLINS) COLORADO, ACCORDING TO PLAT FILED APRIL 9, 1907 WHEREAS, the plat of Block 324, Capitol Hill Addition to the City of Fort Collins, Colorado, filed on April 9, 1907, in the office of the County Clerk and Recorder of Larimer County, shows an alley running North and South in said addition, and WHEREAS, said alley has never been opened to the public and has never been used as an alley, and for many years last past has been abandoned ana has been closed to public travel, and WHEREAS, the owners of the lots abutting on said alley have petitioned the City Council to cause the same to be vacated, and WHEREAS, the City Council is of the opinion that it will be to the best interests of the City to vacate said alley THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS Section 1 That the alley in Block 324, Capitol Hill Addition to the City of Fort Collins, Colorado, according to plat filed April 9, 1907, be and the same is hereby vacated, abolished and abandoned Section 2 In the opinion of the City Council an emergency exists for the preservation of the public health, peace and safety and this Ordinance shall take effect upon its passage under and by virtue of the authority contained in Sections 6 and 7 of Article IV of the City Charter Introduced, read at length and adopted by the unanimous vote of all members of the City Council at a regular meeting held this 24th day of October, A D 1952 Mayor ' ATTEST City Clerk STATE OF COLORADO) ) ss COUNTY OF LARIMER) I, MILES F HOUSE, City Clerk of the City of Fort Collins, Colorado, do hereby certify and declare that the aforesaid Ordinance, consisting of two sections, was duly proposed and read at length at a regular meeting of the City Council, held on the 2 th day of October, A D 1952, and was duly adopted and ordered published in the Fort Collins, Coloradoan, a daily newspaper and official newspaper of the City of Fort Collins, Colorado, by the unanimous vote of all members of the City Council, as an Emergency Ordinance, in accordance with the provisions of Sections 6 and 7 of Article IV of the City Charter, and thereafter and on, to-wit the 28th day of October, A. D. 1952, said Ordinance No 1_ was duly published in the Fort Collins Coloradoan, a daily newspaper published in the City of Fort Collins, Colorado IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of said City, this 28th day of October, A.
