HomeMy WebLinkAbout002 - 01/18/1935 - RELATING TO THE ORGANIZATION OF THE POLICE DEPARTMENT (EMERGENCY ORDINANCE) ORDINANCE NO 2 1935 BEING AN EMERGENCY ORDINANCE RELATING TO THE ORGANIZATION OF THE POLICE DEPART- MENT OF THE CITY OF FORT COLLINS AND REPEALING ORDINANCE NO 23 SERIES OF 1924 AND ALL OVdER ORDINANCES OR PARTS OF ORDINANCEV IN CONFLICT HEREVIITH BE IT ORDAINED BY THE CITY COUNCIL CF THE CITY OF FORT COLLINS Section 1 That the Police Department of the City of Fort Collins shall be under the immediate supervision and control of the Commissioner of Public Safety and shall be charged with the duty to enforce the penal lays of the State of Colorado and all ordinances and regulations of the City of Fort Collins and shall cooperate with State and Federal law enforcement officials Section 2 For the purpose of carrying on the work of said Police Department the City Council Is hereby authorized and empo� ered to appoint, upon the recommendation of the Commissioner of Public Safety, one Chief of Police and such other police officers as may be necessary for the preservation of the oeace and good order and the health and safety of }he citizens and the protection of property, and in case of emergency or necessity the Commissioner of Public Safety is authorized to appoint such special police officers for temporary general or special duty as he may deem advisable and necessary for the public good All police officers shall be under the immediate direction and control of the Chief of Police, but both said Chief of Police and all other police officers shall be at all times subject to the general control and direction of the Commissioner of Safety Police officers may be assigned to such positions or special duties as the Chief and the Commissioner of Safety may deem for the best interests of the Department The Chief and other police officers shall receive such compensation as provided in the ordinance relating to salaries or in resolutions adopted pursuant thereto, and shall hold their respective offices or employment at the pleasure of the City Council upon the recommendation of the Commissioner of Public Safety pursuant to the provisions of Article VI of the City Charter Section 3 Ordinance No 23 Series of 1924, and all other ordinances or parts of ordinances in conflict with this ordinance, are hereby repealed Section 4 In the opinion of the City Council an emergency exists for the preservation of the public health safety and peace and this ordinance shall take effect upon its passage under and by virtue of the authority contained in Sections 6 and 7 of Article IV of the City Charter Introduced read at length and adopted by the unanimous vote of all members of the City Council this 18th day of January A D 1935 ATTEST Commissioner of Safety and Es- Officio myor City C er -2- STATE OF COLORADO, f ss County of Larimer ) I, A J ROSENMv City Clerk of the City of Fort Collins do hereby certify and declare that the aforesaid Ordinance, consisting of four (4 ) sections was duly proposed and read at length at a regular meeting of the City Couneii held on the 18th day of January, A D 1935, and was duly adopted and ordered published in the Fort Collins Express- Courier a daily newspaper and the official newspaper of the City of Fort Collins by the unanimous vote of all members of the City Council , as an Emergency Ordinance in accordance with the pro- visions of Sections 6 and 7 of Article IV of the City Charter, and thereafter and on to-wit the 19th day of February, A D 1935 said ordinance No. 2 was duly published in the Fort Collins Express-Courier, a daily newspaper published in the City of Fort Collins Colorado IN WITNESS WhEREOF I nave hereunto set my hand and affixed the seal of said City this 19th day of February, A D 1935.
