HomeMy WebLinkAbout009 - 05/16/1935 - CREATING THE LIGHT AND POWER DEPARTMENT AND PROVIDING FOR THE ADMINISTRATION THEREOF (EMERGENCY ORDI wn I ORDINANCE NO 9 1935 ) BEING AN ORDINANCE CREATING THE LIGHT AND POWER DEPARTMENT OF THE CITY OF FORT COLLINS , COLORADO , AND PROVIDING FOR THE ADMINIS- TRATION THEREOF WHEREAS , the City of Fort Collins is now engaged in the business of serving the inhabitants of the City of Fort Collins with electric energy for light and power, together with fringe lines adjacent to the corporate limits of said City, and it is now necessary to arrange for the proper and orderly adminis- tration of the said business THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS Section 1 That there is hereby created a Department of the City go-kernment of the City of Fort Collins , designated as the Light and Power Department of said City, that said department shall include in its administration all property rights and obligations of the City that shall be employed in or related to electric service of the City and shall, as far as practicable , be administered as an entity All contracts, records and evidences of title relating to any of the electrical property heretofore or hereafter acquired by the City shall be assembled and carefully preserved and full and correct account shall be kept of all assets and liabilities , receipts and dis- bursements, cost of acquisition of the electrical system and disbursements and expenditures in connection therewith, all to be kept separate and distinct from the accounts of any other department of the city government Said department shall keep all moneys arising from the operation of the electrical department -1- [A and its properties in a separate fund, known as Fort Collins Light and Power Fund, deposited as provided by the City Charter and if possible in Banks which are members of the Federal Deposit Insurance Corporation and will have such deposits secured as now provided by the City Charter The Department shall operate the electrical properties of said City in an efficient and economical manner in accordance with the practice prevailing in privately owned utilities of a similar nature , and shall install and maintain a standard system of accounting which shall at all times correctly reflect all financial operations of the system and keep such other records and data as are generally used by electric utilities privately owned All purchases of any kind for the department shall be made by requisition, signed by the manager of the department and approved by the Commissioner of Finance , and all pay rolls , payments for purchase of materials and other items of expenses and disbursements shall, prior to payment , be approved by the manager of the department and the Commissioner of Finance and shall be vouchered and paid by the department by warrant signed by the Commissioner of Finance and the manager of the department The department shall duly remit to the City Treasurer moneys required to pay principal and interest due on bonds at any time outstanding against the light and power department or its property, and shall at all times so conduct its affairs as to comply with all parts of Ordinance No 7 , 1935 , so far as the same appertains to the operation and management of the light and power department of the City The manager of the department shall render monthly, on or before the 8th day of the month, a report in writing in triplicate to the City Council, with a summary of the receipts and disbursements of the electrical system for the preceding -2- month, and also six or more copies of an itemized statement of all transactions within the department during the preceding month, in such detail as may be from time to time required by the City Council, and at least once a year shall furnish to the City Council, in triplicate , an annual statement of all the transactions of the department , all in accordance with the standard system of accounting for electric utilities Section 2 For the administration of said department and the operation of the municipal light and power service of the City, tnere is hereby created the office of manager of the light and power department , who shall have had at least six (6) years experience in the operation and manage- ment of electric utilities and be otherwise competent and fitted for the responsibility of such position, and such manager will have the right and duty of hiring and discharging all assistants and other employees of the system and of purchasing supplies and equipment for the system, subject to the necessary super- vision of the City Council as provided in the Charter of the City of Fort Collins Such manager shall receive at all times a salary commensurate with that paid by private utility companies to managers in similar positions of experience and responsibility, and to be fixed by resolution of the City Council The department shall have such employees , whose terms of employment and compensation shall be as provided by resolution of the City Council, subject to the provisions of the City Charter The duties of said several employees shall be as prescribed by the manager of the light and power department of the City filed with the City Council, or as may hereafter be fixed by resolution of the City Council -3- Section 3 The City Council shall require a surety bond of any or all officers and employees of the light and power department who handle funds and from any other employee of said department when deemed necessary by the City Council, said bonds are to be corporate surety bonds, the form of which shall be prepared by the City Attorney and approved by resolution of the City Council, said bond or bonds may be individual bonds or may be one or more blanket bonds covering employees or groups of employees as may be hereafter determined by resolution of the City Council Section 4 It shall be the duty of the manager of the Light and Power Department to see that sufficient fire insurance, workmen' s compensation insurance and public liability insurance is carried upon the property belonging to the system and to cover its operations , in such amount as may be hereafter fixed by resolution of the City Council The companies and agencies through which said insurance is written shall meet the approval of the City Council Section 5 This ordinance shall not in any respect alter, change or repeal any part of Ordinance No 7 , 1935 , and all operations of said department by any officer or employee thereof shall be carried on in strict conformance with the terms and provisions of said Ordinance No 7 , 1935 Section 6 In the opinion of the City Council an emergency exists for the preservation of the public health, peace and safety, and this ordinance shall take effect upon its passage under and by virtue of the authority contained in Sections 6 and 7 of Article IV of the City Charter Introduced, read at length and adopted by the unanimous vote of all members of the City Council, at a regular adjourned meeting of the City Council, held the 15th day of May, A D 1935 the fore- going Ordinance, consisting of six (6) sections , was duly proposed adjourned and read at length at a regular/meeting of the City Council , held on the 15th day of May, A D 1935, and was duly adopted and ordered published 1n the Fort Collins Express-Courier, a daily newspaper and the official newspaper of the City of Fort Collins, by the unanimous vote of all members of the City Council as an emergency ordinance , in accordance with the provisions of Sections 6 and 7 of Article IV of the City Charter, and there- after and on to-wit the 16th day of May, A D 1935, said Ordinance No 9 was duly published in The Fort Collins Express-Courier, a daily newspaper published in the City of Fort Collins , Colorado IN WITNESS THEREOF, I have hereunto set my hand and affixed
