HomeMy WebLinkAbout001 - 02/13/1953 - VACATING A PORTION OF MAGNOLIA STREET LOCATED IN THE SCOTT-SHERWOOD ADDITION (EMERGENCY ORDINANCE) � � 1 rt ORDINANCE NC 1 1953 BEING AN EILiE ENCY ORDINANCE VACATING A PORTION OF MAGNOLIA STREET LOCATED IN T112, SCOTT-SHER4d00D ADDITION TO THE CITY OF FORT COLLI14S, COLORADO iffiEREAS, the plat of Scott-Sherwood Addition to the City of Fort Collins, recorded June 14, 1907, shows a portion of the North thirty (30) feet of Yagnolia Street being used as a street which said portion adjoins Lot sixteen (16), Block nine (9), of said Addition on the South and which is contiguous to the South line of said lot sixteen (16), and KE]REAS, said portion of Magnolia Street has never been used as a street, and for many years last past has been closed to the public travel, and 41 = 5 S, the actual North line of said Magnolia Street as used by the public lies thirty (30) feet South of the South boundary of Lot sixteen (16), Block nine (9), in Scott-Sherwood Addition to the City of Fort Collins, and 4HEREAS, the owner of said property has petitioned the City Council to cause the same to be vacated, and YMEREAS, rights of way or easements are hereby reserved for the con- tinued use of existing sewers, gas, water or other pipe lines and appurtenances, and for the continued use of existing electric, telephone and similar lines and appurtenances by the City of Fort Collins, and 0EREAS, the City Council is of the opinion that it will be to the best interests of the City to vacate said portion of said Magnolia Street THE,ZEFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT E01LINS Section 1 That the portion of the North thirty (30) feet of Mag- nolia Street, as laid out on the plat of Scott-Sherwood Addition to the City of Fort Collins, as recorded June 14, 1907, in the records of the Clerk and Recorder of Larimer County, Colorado, which adjoins lot sixteen (16), Block nine (9) of said Addition on the South and which is contiguous to the South line of said lot sixteen (16), be and the same is hereby vacated, abolished and abandoned Section 2 In the opinion of the City Council an emergency exists for the preservation of the public health, peace and safetj and this ord�rance shall tale effect upon its passage under and bj virtue of the authorit3 contained in sections 6 and 7 of Article IV o'' the City Charter Introduced, read at length and adopted by a unanimous vote of all members of the City Council at a regular meeting held this _13+,L day of February, A D 1953 p p 4 . 1.ayor AT'T'J T Cit Clerk STATE OF COLOr-ADO ) ss COUP TY OF LATZ LR ) I, I IL,,S F HOUSE, City Clerk of the City of Fort Collins, Colorado, do hereby certify and declare that the 4foresaid ordinance, consisting of two sections, was duly proposed and read at length at a regular meeting of the City Council, held on the 13th day of February, A D 1953, and was duly adopted and ordered published in the Fort Collins Coloradoan, a daily newspaper and official newspaper of the Citj of Fort Collins, Color.do, by a unanimous vote of all trerib-rs of the City Council, as an emergency ordinance, in accordance rith the provisions of sections 6 and 7 of Article IV of the City Charter, and there- after and on, to- Tit the 1 th da3 of February , A D 1953, said Ordinance No I was duly published an the Fort Collins Coloradoan, a daily newspaper published in the City of Fort Collins, Colorado IN I ITdESS VHERLOF I have hereunto set my hand and official seal of said City this 17th day of February ,A D 1953 ity Clerk -2-
