HomeMy WebLinkAbout009 - 07/17/1953 - AMENDING ORDINANCE NO. 005, 1946, AS AMENDED, RELATING TO THE SALE OF MILK AND MILK PRODUCTS (EMERGE ORDINANCE NO 9 , 1953 BEING AN EMERGENCY ORDINANCE AMENDING ORDINANCE NO 5, 1946, AS AMENDED, RELATING TO THE SALE OF MILK AND MILK PRODUCTS DEFINING "MILK" AND "GRADE A PASTEMED MILK It BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS in part Section 1 That Section lA of Ordinance No 5, 1946, be amended/to read as follows "Section 1A - Milk Milk is hereby defined to be the lacteal se.. cretion obtained by the complete milking of one or more healthy cows, excluding that obtained within 15 days before and 5 days after calving, or such longer period as may be necessary to render the milk practically colostrum free; which contains not less than 8 5 percent of milk solids not fat, and not less than 3 5 percent of milk fat " Section 2 That Section %, Item 26r, relating to Grade A Pasteurized Milk be amended to read as follows "GRADE A PASTEURIZED MILK Grade A pasteurized milk is grade A raw milk, with such exceptions as are indicated if the milk is to be pasteurized, which has been pasteurized, cooled, and bottled in a milk plant conforming with all of the following items of sanitation and the average bacterial plate count per of which at no time after pasteurization and until delivery exceeds 30,000/cubic centimeter, as determined under sections 1 (S) and 69 and showing proof of efficient pasteurization as evidenced by satisfactory phosphatase tests, and which at no time following pasteurization and until delivery, has a coliform count exceeding ten (10) per cubic centimeter " Section 3 In the opinion of the City Council an emergency exists for the preservation of the publ�c health, peace and safety, and this ordinance shall take effect upon its passage, under and by virtue of the authority contained in Sections 6 and 7 of Article IV of the City Charter Introduced, read at length, and adopted by the unanimous vote of all members of the City Council, at a regular meeting held this 17th day of July, A D 1953 mayor Attest City Clerk STATE OF COLORADO) ) ss COUNTY OF LARIMER) I, MILES F HOUSE, City Clerk of the City of Fort Collins, do hereby certify and declare that the aforesaid Ordinance, consisting of three sections, was duly proposed and read at length at a regular meeting of the City Council, held on the 17th day of July, A D 1953, and was duly adopted and ordered published in the Fort Collins Coloradoan, a daily newspaper and official newspaper of the City of Fort Collins, by the unanimous vote of all members of the City Council, as an Emergency Ordinance, in accordance with the provisions of Sections 6 and 7 of Article IV of the City Charter, and thereafter and on, to-wit the 21st day of July, A D 1953, said Ordinance No 9 was duly published in a Fort Collins Coloradoan, a daily newspaper pub sl sedan the City of Fort Collins, Colorado IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of said City, this 21st day of July, A D 1953 City Clerk lerk ^2"
