HomeMy WebLinkAbout011 - 07/24/1953 - VACATING A PORTION OF THE ALLEY IN BLOCK 3, KENWOOD HEIGHTS ADDITION (EMERGENCY ORDINANCE) oRDINANCE NO ", 1953 BEING AN MMQENCY ORDINANCE VACATING A PORTION OF THE ALLEY IN BLOCK 39 KENGfOOD HEIGHTS ADDITION TO THE CITY OF PORT COLLINS, COLORAM WHEREAS, the plat of Block 3, Kenwood Heights Addition to the City of Fort Collins, Colorado, shows an alley opening on Woodford Avenue, and WHDREAS, a portion of said alley has never been opened to the public and has never been used as an alley, and for many years last past has been abandoned and has been closed to public travel, which said portion of said alley is more particularly described as follows, to-wits The alley lying between Lots 1 and 2 and Lots 10 and 11 in Block 3 of the Kenwood Heights Addition to the City of Fort Collins, Colorado, and more particularly described as being contained with3.n the following described boundary lines, to. wits Beginning at the Northwest corner of Lot 1 and running thence South 101 8 feet to the Southwest corner of Lot 2, thence West 20 feet to the Southeast corner of Lot 10, thence North 101 8 feet to the Northeast corner of Lot 11, and thence East 20 feet to the point of beginning) AND, WHERBAS, the owners of the lots abutting on said portion of said alley have petitioned the City Council to cause the same to be vacated, and WHEREAS, the City Council is f$ the opinion that it will be to the best interests of the City to vacate said portion of said alley THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT COLLINSs Section 1 That that portion of the alley in Block 3, Kenwood Heights Addition to the City of Fort Collins, Colorado, more particularly described as follows, to-wits The alley lying between Lots 1 and 2 and Lots 10 and 11 in Block 3 of the Kertvood Heights Addition to the City of Foot Collins, Colorado, and more particularly described as being contained within the following described boundary lines, to. vita Begs pg at the Northwest corner of Lot 1 and running thence South` 101 8 feet to the Southwest cdi& of Lot 2, thence West 20 feet to the Southeast corner of Lot 10, thence North 101 8 feet to the Northeast cozener of Lot 11, and thence East 20 feet to the point of beginningp be and the same is hereby vacated, abolished and abandoned Section 2 That rights of way or easements are hereby reserved for the continued use of existing sewer, gas, rater or similar pipelines and appurtenances, and for electrio, telephone and similar lines and appurtenances Section 3 In the opinion of the City Council an emergency exists for the preservation of the public health, peace and safety, and this ordinance shall take effect upon its passage under and by virtue of the authority contained in Sections 6 and 7 of Article IV of the City Charter Introduced, read at length, and adopted by the unanimous vote of all members of the City Council, at a regular meeting held this 24th day of duly, A D 1953 or ATTE r &gap City Cleric .2.
