AMENDING ORDINANCE NO 17, 1936, REGUTATI OG THE USE OF AND TRAFFIC UPON THE PUBLIC STREETS, ALLEYS AND SIDEWJXS IN THE CITY OF FORT COLLINS, PROVIDING A PENALTY F(R THE VIOLATION THEREOF AND PROVIDING FOR THE REGULATION OF TRAFFICS AT STREET INTERSECTIONS AND THE REGULATION OF PARSING OF ALL KINDS OF VEHICLES WITHIN THE CITY LIMITS h BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS Section 1 That Section 6 of Ordinance No 17 Series of 1936, be and the same is hereby amended to read as follows "Section 6 At street intersections the driver of the vehicle on the left shall yield the right of way to the vehicle on the right The driver of the vehicle within an intersection intending to turn to the left , shall yield the right of way to any vehicle approaching from the opposite direction which is within the intersection or so close thereto as to constitute an immediate hazard No vehicle shall pass or attempt to pass any other vehicle going in the same direction within an intersection The driver of a vehicle about to enter or cross a street from a private road or driveway, or about to enter a through street, shall yield the right of way to all vehicles approaching on said street " Section 2 That Section 10 of Ordinance No 17 1936, be and the same is hereby amended to read as follows "Section 10 All vehicles shall stop near the curb, except^in cases of emergency, for the purpose of allowing another vehicle or pedestrians to cross, and no vehicle shall be permitted to park on any street, except as follows , to-wit -1- (a) All vehicles shall be parked on the right hand side and parallel with the curb , not more than twelve inches from the curb, except that vehicles shall be parked at an angle of 45 degrees and against the curb in the following blocks in the City of Fort Collins South College Avenue, 100 and 200 blocks All of North College Avenue All of East Mountain Avenue West Mountain Avenue, 100 and 200 blocks East Olive Street , 100 block West Olive Street , 100 block All of Walnut Street All of Pine Street All of Linden Street LaPorte Avenue, 100 block All of Jefferson Street West Oak Street, 100 and 200 blocks East Oak Street , 100 block Remington Street, 100 block South Mason Street , 100 block (b) Vehicles going North may be parked in the center of the street on the East side of the Street Railway track on South and North College Avenue and vehicles going South may be parked on the Street Railway track on North College Avenue, and vehicles going East may be parked on the South side of the Street Railway track on Mountain Avenue, parallel with the railway track in the lanes marked therefor, upon the following streets South College Avenue, 100 and 200 blocks North College Avenue, 100 block West Mountain Avenue, 100 and 200 blocks P. 1 East Mountain Avenue, from East side of Linden Street East to Peterson Street Vehicles may be parked in the center of the street in the 200 block on North College Avenue in the lanes marked therefor All vehicles parked in the center of the street shall drive into said parking lanes from that portion of the street nearest said parking lanes and in departing therefrom shall go in the same direction in which the same entered In driving into or out of a parking lane in the center of the street , the driver of the vehicle shall yield the right of way to all traffics on the street (c) No vehicle parked at an angle shall back out more than six feet without stopping and giving an audible signal, and all vehicles backing from the curb , whether parked at an angle or parallel with the curb, shall yield the right of way to all other vehicles or pedestrians approaching or passing thereby (d) Parking in the paving districts, except in places where center parking is permitted, is hereby prohibited between the hours of 1 00 A M and 6 00 A M (e) Double parking is hereby prohibited (f) All vehicles shall be parked between the established parking lanes when such are marked and not otherwise (g) Bicycles shall not be left on the sidewalk, against any building or lying upon the curb , and shall only be packed in such spaces as are provided therefor (h) No person shall stop, stand or park a vehicle, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic control device , in any of the following places On the sidewalk , in front of a public or private driveway, except where lanes are -3- i marked, within an intersection, within five (5) feet of a fire hydrant , on a cross walk, between a safety zone and the adjacent curb , within twenty (20) feet of the driveway entrance to any fire station and on the side of the street opposite the entrance to any fire station within seventy-five (75) feet of said entrance when properly marked , alongside or opposite any street excavation or obstruction when such standing stopping or parking would obstruct traffic , on the roadway side of any vehicle stopped or parked at the edge or curb of a street , on any place where official signs prohibit stopping, on any street railway track, except 100 Block on North College Avenue, in front of any entrance or building where officially designated and marked by appropriate signs " Section 3 That Ordinance No 17, 1936, be and the same is hereby amended by adding thereto Section 10-a, which is as follows "Section 10-a No vehicle shall be permitted to remain parked at the curb in the same space for more than 1 two hours, between the hours of 8 00 A M and 6 00 P M on Monday to Saturday inclusive of each week, in any of the following blocks, to-wit South College Avenue, 100 and 200 blocks North College Avenue, 100 block West Mountain Avenue 100 block East Mountain Avenue, 100 block Linden Street , 100 block West Oak Street 100 block East Oak Street, 100 block No vehicle shall be permitted to remain parked at the curb in the same space for more than fifteen minutes in front of the Post Office Building on South College Avenue, in the space -4- � J 1 J between Oak Street and the driveway South of said building " Section 4 That Section 12 of Ordinance No 17, Series of 1936 , be and the same is hereby amended to read as follows "Section 12 No truck and no car with trailer attached thereto shall be parked in the center of the street or against the curb in the 100 block on East and West Mountain Avenue and the 100 block on North and South College Avenue , and no truck having a load capacity of three tons or more and no truck or car with a trailer or semi-trailer thereto attached, shall be permitted to park in any space where angle parking or center parking is allowed, excepting in the center of the 200 block on North College Avenue or excepting during the expeditious and necessary loading and unloading of merchandise " Section 5 That Ordinance No 17 of the Series of 1936, be and the same is hereby amended by adding thereto Section 12-a, which is as follows "Section 12-a No trailer, trailer house, house car or any other vehicle mounted on wheels, or with wheels detached therefrom, and equipped or used as living or sleeping quarters, shall be parked upon any street for the purpose of occupancy thereof, or parked upon any lot or premise within the City limits for the purpose of occupancy thereof, unless the same shall meet with all sanitary and building code requirements regulating the construction and occupancy of habitable dwellings " Section 6 That Section 18 of Ordinance No 17 , Series of 1936, be and the same is hereby amended to read as follows "Section 18 It shall be unlawful for any person to park upon a street any vehicle displayed for sale, or any vehicle 5. J which does not have affixed thereon the owner's license plates as required by law No owner or occupant of any place of business shall suffer or permit any vehicle , whether left for safe-keeping, repairing or otherwise, to remain on the sidewalk adjoining or in front of any such place No person shall operate or park any vehicle on any street for the primary purpose of displaying advertising, or operate or park upon the streets any vehicle with loud speaker equipment in operation " Section 7 All ordinances and parts of ordinances in conflict with this ordinance are hereby repealed, save and except that all causes of action accrued in favor of the City of Fort Collins by reason of the violation of said ordinances, or any section of Ordinance No 17, 1936 as herein amended, prior to the taking effect of this repeal, shall be prosecuted as though no repeal had been made Section 8 In the opinion of the City Council an emergency exists for the preservation of the public health, peace and safety and this Ordinance shall take effect upon its passage under and by virtue of the authority contained in Sections 6 and 7 of Article IV of the City Charter Introduced, read at length and adopted by the unanimous vote of all members of the City Council, at a regular meeting held this 16th day of July, A D 1937 Mayo Attest -7` Acting ty Ulerk STATE OF COL0RADO, ) ss County of Larimer ) I, NELLIE WARFIELD, Acting City Clerk of the City of Fort Collins, do hereby certify and declare that the aforesaid Ordinance , consisting of eight (8) sections, was duly proposed and read at length at a regular meeting of of the City Council, held on the 16th day of July, A D 19379 and was duly adopted and ordered published in the Fort Collins Express-Courier, a daily newspaper and the official newspaper of the City of Fort Collins, by the unanimous vote of all members of the City Council, as an Hnergency Ordinance, in accordance with the provisions of Sections 6 and 7 of Article IV of the City Charter, and thereafter and on to-wit the 20th day of July, A D 19379 said Ordinance No 12 was duly published in the Fort Collins Express-Courier, a daily newspaper published in the City of Fort Collins, Colorado IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of said City, this 20th day of July, A D 1937 --� acting City Clbrk
