SIIBbMSION, THE PERSONS suniVISION AND THE JUSTICE PLaCE =DIVISION, AND AUTHORIZING THE ANNEBATION OF-ALL THE TEt1TORY EMBRACED IN SAID PLAT TO THE CITY OF F10R.T COLLINS AND TO BE INCLUDED WITHIN THE LIMITS AND JURISDICTION THEREOF PMUANT TO THE AUTHORITY CONTAINED IN ARTICLE 11, CHAPTER. 139s COLO— RADO BE9I§ED STATUTES 1953s AND THE PROVISIONS OF 6RDINANCE_NO. 14s 19?4 ^ 1 WHEREAS, heretofore a written petition has been presented to the Council of the City of Fort Collins in substantial compliance with the provisions of Article 11, Chapter 1,39, Colorado Revised Statutes 1953, by 46 persons purporting to be the owners of 67 08 percent of the land embraced in what is known as the Gray+Strecker Subdivision, the Persons Subdivision, and the Justice Place Subdivision, wherein and whereby said petitioners and applicants petitioned the City of Fort Collins for the annexation of all the territory embraced in what is known as the Gray-Strecker Subdivision, the Persons Subdivision, and the Justice Place Subdivision to the City of Fort Collins, Colorado, comprising the lands shown in the^plat thereof annexed to said petition and more particularly described as follows A tract of land in the Northwest quarter (NW-4) of Section 241 Township 7 North, Range 69 West of the 6th P.,,M.s Larimer County, Colorado, consisting of the Gray-Strecker Subdivision, the Person Subdivision and the Justice Place Subdivision and more particularly described as being contained within boundary lines which begin at a point on the North line of said Section 24 which is 660 feet East of the Northwest corner thereof and run thence South 662 feet parallel to the West line of the Northwest quarter (NWQ) of said Section 24,$ thence East 1317 feet, more or less, to a point which is 30 feet South of the Southeast corner of Lot 8 in Block 3 of the GrayStrecker Subdivision, according to the plat of Flinnts Hesubdivision of Block 3 GrayStrecker Subdivision, dated December 31s 1945, thence North 662 feet, to a point on the North line of said Section 24.. which is 1317 feet, East of the point of beginning, and thence West 1317 feet to the point of beginning, AND, WHEREAS, in the said application and petition the applicants for themselves and their grantees covenanted and agreed to and with the City of Fort Collins that upon the acceptance of said application, it is expressly agreed acid understood that the applicants and their grantees expressly covenant and agree that they will be bound by and will observe and obey the ordinances in effect at the time of the acceptance of said annexation of the addition respecting the ins stallation and payment for local public improvements, and WHEREAS, said petition was accepted by the City Council of the City of Fort Collins by resolution passed and adopted on the 28th day of July, A. D. 19553, and WHEREAS, notice for hearing on the 8th day of September, A. D. 1955, on an ordinance approving the annexation of the above described territory and in- cluding the same within the limits and jurisdiction of the City of Fort Collins was duly published as provided by law, and WBERFAS, the Council of the City of Fort Collins has found that the petition and the documents attached thereto meet the requirements of Article 11, Chapter 139, Colorado Revised Statutes 1953, and WHEREAS, no proceedings for an election to determine the question of annexation have been initiated by written counter-petition as provided by law and no objection to said annexation having been made, BE IT ORDAIM BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1. That after-due-consideration of the petition for annexation that the petition for the annexation of all the territory embraced in what is known and described as the Gray-Strecker Subdivision, the Persons Subdivision, and the Justice Place Subdivision to the City of Fort Collins, Colorado, as shown by the plat thereof annexed to said petition, be accepted and approved and that the said territory be annexed and made a part of the City of Fort Collins and be included within the limits and jurisdiction thereof, and that the City Clerk be and he is hereby authorized and directed to prepare certified copies of this Ordinance to each of which shall be attached a plat of said Gray-Strecker Subdivision, the Persons Subdivision, and the Justice Place Subdivision and shall file one copy thereof in -2- J the office of the Clerk and Recorder of the County of Larimer, and another copy thereof in the office of the Clerk of the City of Fort Collins, together with a certified copy of the said petition, and anotherlcopy of said plat and approving Ordinance with the Secretary of the State of Colorado. Section 2. That in accepting and approving the plat of the Gray-Strecker Subdivision, the Persons Subdivision, and the Justice Place Subdivision, the City of Fort Collins does not assume any obligations respecting the construction of water mazns, sewer lines, gas mains, electric light lines or other services or utilities with respect to the service of said addition except as may be req=red and provided by the owners of property within the limits of said addition at their own expense and except as may be initiated by the owners of property within the limits of said addition in compliance with the terms and provisions of Ordinance No 7, 1921, relating to local public improvements as amended. Introduced, considered favorably on first reading and ordered published this 8th day of September, A. D. 1955, and to be presented for final passage on October 13, A.
