ACCEPTOWAND APPROVING THE PLAT OF WHAT IS KNOWN AS THE
EIGHTH,SOUTH,SHIELDS.STREET ANNEXATION TO.THE CITY OF FORT
COLLINS, COLORADO, AND.AUTHORIZING, THE ANNEXATION OF ALL THE
TERRITORY EMBRACED IN.SAID. PLAT.TO THE CITY OF,FORT..COLLINS
AND TO BE_INCLUDBD WITHIN ,THE LIMITS. AND.JURISDICTION THEREOF,
PURSUANT TO THE ,AUTHORITY CONTAINED IN ARTICLE .II, .CHAPTER
139 COLORADU REVISED STATUTES 1953.
WHEREAS, heretofore a written petition was presented to the Council
of the City of Fort Collins in substantial compliance with the provisions of
Article 11, Chapter 139, Colorado Revised Statutes, by the sole owners of
the area of land embraced in what is known as the Eighth South Shields Street
Annexation to the City of Fort -Collins, wherein and whereby said petitioners
petitioned .the City of Fort.Collins, for the annexation of all the territory
embraced in what is known as the Eighth South Shields Street Annexation to
the City of Fort Collins, Colorado, comprising the lands shown in the plat
thereof attached to said petition and more particularly described as hereinafter
set forth, and
WHEREAS, said petition was accepted by the Council of the City of
Fort Collins by resolution passed and adopted on July 12, 1962, and
WHEREAS, notice for hearing on,the 23rd day of August, A. D., 1962,
on an ordinance approving the annexation of said territory and including the same
within the limits and jurisdiction of the City of Fort Collins was duly published
as provided by law, and
WHEREAS, the Council of the City of Fort Collins has found that the
petition and the documents thereto attached meet the requirements of Article
11, Chapter 139, Colorado Revised Statutes, 1953, and
WHEREAS, no proceedings for an election to determine the question
of annexation have been initiated by written counter-petition as provided by
law and no objection to annexation having been made.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS:
Section 1. That after due consideration of the petition for annexation,
•the petition for the annexation of all the territory,sin what is known and des-
cribed as Eighth South Shields Street Annexation to the City of Fort Collins,
Colorado, as shown by the plat thereof annexed to said petition and which is
more particularlyldescribed 'as follows, to-wit:
A tract of land situate in the SEA of the SEk of Section 15,
Township 7 North, Range 69 West;" of the '6th P.M., County of "
Larimer,"State of Colorado; which considering the East line
of' said SE& as'bearing North and with all bearings_contained
herein relative thereto is contained within the boundary
lines which begin at a point which bears North 737.3 feet
from the SE corner of said SE'; and run thence North 90.58
feet to the SE corner of the 7th South Shields Street annexa-
tion to the City of Fort Collins, Colorado, thence N. 89030'
W. 1328:1 feet to s point_on the Easterly line of the 3rd -
Fairview Annexation to the,City of Fort Collins, Colorado;
thence S. 00°02'30"" E. 165:42 feet along' said Easterly line;
thence S. '89029'"30 E. 497.98 feet; thence South 230.33 feet;
thence East 5000 feet -to a point on the Westerly line* of
the Maxfield Annexation to the City of Fort Collins, Colorado;
thence North 223.00 feet along said Westerly line to the
Northwest coiner of said Maxfield Annexation; thence'East
110.00 feet along the Northerly line of said Maxfield Annexa-
tion; thence North. 76,95 feet; thence S.- 89°29'30" E. 220.0
feet io the point of beginning containing 7.2915 acres more
or less;
bedaccepted and approved and that said territory be annexed and made a part of
the City ofgFortSgoUins, and be included within the limits and jurisdiction
of the City of Fort Collins as a part of "A" Residence District, and that the
City Clerk be and he is hereby authorized and directed to prepare certified
copies of this ordinance, to each of which shall be attached a plat of said
Eighth South Shields Street Annexation to the City of Fort Collins,. Colorado,
and shall file a copy thereof in the office of the Clerk and Recorder of the
County of Larimer, and another copy thereof in the office of the Clerk of the
City of Fort Collins, .together with a certified copy of said petition and .
another copy of said petition and approving ordinance with the Secretary of
State of the State of Colorado.
Section 2. That in accepting and approving the plat of the 8tghthh
.South Shields Street.Annexation to the City of Fort Collins, the City of Fort
Collins does not assume obligations respecting the construction of water mains,
sewer lines, gas mains, electric light lines or other services or utilities
with respact to service of said addition, except as may be required and pro-
vided by the owners of the property within the limits of said addition/in
compliance with the terms and provisions of Chapter 15, Code of Ordinances of
the City of Fort Collins, Colorado, 1958, as amended, relating to local and
public improvements.
. Introduced, considered favorably on first reading and ordered pub-
lished this 23rd day of August, A.•D., 19629 and to be presented for final
passage on the 13th day of September, A. D., 1962.
