HomeMy WebLinkAbout046 - 09/27/1962 - AMENDING CHAPTER 9 OF THE CITY CODE DEALING WITH FIRE PREVENTION BY ADDING THERETO SECTIONS REGULATI ORDINANCE N0. 46 , 19622 BEING AN ORDINANCE AMENDING CHAPTER 9 OF THE CODE OF ORDINANCES OF THE CITY OF FORT COLLINS, _COLORADO, 19582 AS AMENDED, DEALING WITH-FIRE PREVENTION BY ADDING THERETO SECTIONS REGULATING THE LOCATION OF GASOLINE DISPENSING SERVICE STATIONS WITHIN THE LIMITS OF THE CITY OF FORT COLLINS AND DECLARING AN EMERGENCY WHEREAS, the storage and dispensing of gasoline in large quantities constitutes a danger to the citizens of the City of Fort Collins and to property within the City. of Fort Collins, and WHEREAS, gasoline is a highly inflammable and explosive substance, and WHEREAS, the regulation and control of the location of gasoline dispensing service stations is a matter of utmost importance to the citizens of the City of Fort Collins, and WHEREAS, in the opinion of the Council of the City of Fort Collins an emergency for the actual preservation of the public peace, health, safety and property exists because of the location and establishment of gasoline dis- pensing service stations in places where such service stations constitute a danger to persons and property within the City of Fort Collins. NOW, THEREFORE, BE IT_ ORDASNED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1. That Chapter 9 of the Code of Ordinances of the City of Fort Collins, Colorado, 1958, as amended, be and it is hereby amended by adding thereto the following sections : "Section 9-21. That hereafter the location of all gasoline dispensing service stations within the limits of the City of Fort Collins must be-approved by the City Council and when in the opinion of the Council of the City "of Fort Collins the location for which application for permit is made would not be for the best interests of the public the permit shall be refused. Section 9-22. In any event, no permit shall be issued for any gasoline dispensing service station unless: A. The lot or parcel of land to be used as a gasoline dispensing service station has'a street frontage of at least 100 feet and an average depth of at least 100 feet. B. The walls of any building or,'.structure used in connection with a gasoline dispensing service 'station are set back at least 25 feet from any adjoining residence property line and at least 40 feet from a street line. C; The entrance and exit driveway. or driveways are at least 24 feet wide but not more than 30 feet wide and located at least 10 feet from adjoining property line and at least 20 feet from the corner of intersecting public streets. D. 'Every gasoline or oil tank, pump, lift, filling, greasing, or. other device, appliance or apparatus/is located at least 25 feet .from any street line. and at least 5 feet from the side and rear lines of the premises. E.. The nearest boundary line of the lot'or parcel of land to be used .for'a gasoline dispensing service stations is at least 300 feet from the boundary line of any property used as or upon which is erected: 1. a public or private school; . 2. a church or other place of worship; 3, a.hospital, rest'home or nursing home; 4. a public library, museum, or any other public building; 5. a theater or other building or structure used for motion picture, theatrical or operatic productions or for any other form of public entertainment; 6. .a public playground.or civic center; 7. a firehouse or firestation." Section 2. In the opinion of the City Council an emergency exists for - the actual preservation of the public peace, health, safety and property, and this Ordinance shall take effect upon its passage under:and by virtue of the authority contained in Sections 6 and 7 of Article 2 of the Charter of the City of Fort Collins.
