HomeMy WebLinkAbout012 - 05/28/1954 - VACATING A PORTION OF CHESTNUT STREET ADJOINING BLOCKS 1 AND 15 AND THE ALLEYS IN BLOCKS 1 AND 15 (E t ORDINANCE NO 12 , 1954 BEING AN EMERGENCY ORDINANCE VACATING A PORTION OF CHESTNUT STREET ADJOINING BLOCKS 1 AND 15 AND THE ALLEYS IN BLOCKS l AND 15 WHEREAS, the several owners of all of the lots in Blocks 1 and 15 in the City of Fort Collins, according to the map of the Town of Fort Collins, Larimer County, Colorado, filed January 18, 1873 with the Clerk and Recorder of Larimer County, have petitioned the City Council to cause the vacation)of the following described portion of Chestnut Street and of the alleys in Blocks 1 and 15, to-dit 1 CHESTNUT STREET That portion of Chestnut Street situate and lying between Block 1 and Block 15 in the City of Fort Collins, according to the Map of the Town of Fort Collins, Larimer County, Colorado, filed January 18, 1873, with the County Clerk and Recorder of Larimer County, Colorado 2 ALLEYS IN BLOCK 1 AND BLOCK 15 The alleys in Block 1 and in Block 15 according to the Map of the Town of Fort Collins, Larimer County, Colorado, filed January 18, 1873, with the County Clerk and Recorder of Larimer County, AND WHEREAS, said street and said alleys sought to be vacated have never been opened to public travel and no public funds have been expended for construction or maintenance on said street or on said alleys, AND WHr:EMS, the City Council is of the opinion that it will be to the best interest of the City to vacate the said portion of Chestnut Street and the alleys in Blocks 1 and 15, above described THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS Section 1 That the portion of Chestnut Street lying between and adjoining Blocks 1 and 15, according to the Map of the Town of Fort Collins, Laruner County, Colorado, filed January 18, 1873, with the Clerk and Recorder of Larimer County, and the alleys in Blocks 1 and 15, according to the Map of the Town of Fort Collins, Larimer County, Colorado, filed January 18, 1873, with the Clerk and Recorder of Larimer County, be and the same are hereby vacated, abolished and abandoned, pursuant to the ordinances of the City of Fort Collins and the statutes of the State of Colorado in such cases made and provided, and particularly under the provisions of Chapter 217 of the 1949 Session Laws of the State of Colorado Section 2 In the opinion of the City Council an emergency exists for the preservation of public health, peace and safety, and this ordinance shall take effect upon its passage under and by virtue of the authority contained in Sections 6 and 7 of Article IV of the City Charter Introduced, read at length, and adopted by the unanimous vote of all members of the City Council, at a regular meeting held this 28th day of May, A D 1954 Commissioner of ety r.0 fic o Mayor ATTEST 244 City Clerk -2- �1 STATE OF COLORADO) ) ss COUNTY OF LARIMER) I, MILES F HOUSE, City Clerk of the City of Fort Collins, do hereby certify and declare that the foregoing Ordinance, consisting of two sections, was duly proposed and read at length at a regular meeting of the City Council, held on the 28th day of May, A D 1954, and was duly adopted and ordered published in the Fort Collins Coloradoan, a daily newspaper and the official newspaper of the City of Fort Collins, by the unanimous vote of all members of the City Council as an emergency ordinance, in accordance with the provisions of Sections 6 and 7 of Article IV of the City Charter, and thereafter and on, to-wit the ict day of June , A D 1954, said Ordinance No 1? was duly published in the Fort Collins Coloradoan, a daily newspaper published in the City of Fort Collins, Colorado IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of this City, this__Ls s t day of J in e , A D 1954 k;ity Ulerk -3-
