HomeMy WebLinkAbout069 - 12/07/1967 - RELATING TO PARKING LOTS OWNED OR OPERATED BY THE CITY, RESTRICTING THE NUMBER OF HOURS A CAR MAY BE ♦ 4 ORDINANCE NO 69, 1967 BEING AN ORDINANCE 'RELATING TO PARKING LOTS OWNED OR OPERATED BY THE CITY OF FORT COLLINS , RESTRICTING THE NUMBER OF HOURS A CAR MAY BE PARKED ON SUCH LOTS AND PROVIDING FOR IMPOUNDING AND DIS- POSING OF VEHICLES PARKED ON SUCH LOTS IN EXCESS OF THE LIMITS HERE=N EKPRESSED, AND DECLARING 41N EMERGENCY BE IT ORDAIN ED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 That from and after the effective date of this Ordinance, no person shall park any vehicle on any parking lot owned or maintained and operated by the City off' Fort Collins for a period of time greater than 72 consecutive lours Section 2 Whenever any motor venicle without a driver is found parked or stopped in violation of the restrictions imposed by this Ordinance , the police officer finding such vehicle shall take the registration number of such vehicle and any other informa- tion which may identify its user, and shall conspicaousl� affix to sacn vehicle a penalty assessment notice on the form authorized in Section 23-22-2 of the Code of Ordinance of the City of Fort Collins , Corrado, 1958, as amended, directing the owner thereof to respond to and answer the charge against him at a place and a time specified in said notice In the event the owner of such vehicle fails to comply with such notice, the procedure set forth in Section 22-.22-13 of the Code of Ordinances of the City of Fort Collins , Colorado, 1958, as amended, shall be followed Section 3 Whenever any police officer finds a venicle parked on a parking lot owned or maintained and operated by the City of Fort Collins in violation of the provisions of this Ordinance , such officer shall require the owner of the same to remove the same , if he is able to locate such owner, or if he cannot locate such owner, then he may cause the same to be removed and placed in storage in the nearest garage or other place of safety designated or main tained by this municipality Section 4 Any automobile or other vehicle left on any parking lot owned or maintained and operated by the City of Fort f Collins for a period of more than 72 consecative 'aours shall be conclusively presumed to have been abandoned by the odner thereof Section 5 Any motor vehicle placed in storage, pur- suant to the provisions of this Ordinance , shall be disposed of in accordance with the provisions of Section 13-5-72, Colorado Revised Statutes , 1963, as amended In the opinion of the City Council, an emergency exists for the actual preservation of the public peace , health, safety and property, and this Ordinance shall take effect on its passage under and by virtue of the authority contained in Section 6 and 7 of Article II of the Charter of the City of Fort Collins Introduced, read at length and adopted by the unanimous vote of all members of the City Council at a regular meeting head this 7th day of December, A D , A D 1967 MAYOR ATTEST CITY CLERK J STATE OF COLORADO) ) ss COUNTY OF LARIMER) I, MILES F HOUSE, City Clerk of the City of Fort Collins, do hereby certify and declare that the foregoing Ordinance , consisting of five sections, was duly proposed and read at length at a regular meeting of the City Council held on the 7thj, day of December, A D 1967, and was duly adopted and ordered published in the Fort Collins Coloradoan, a daily newspaper and the official newspaper of the City of Fort Collins, by the unanimous vote of all members present of the City Council as an emergency ordinance, in accordance with the provisions of Sections 6 and 7 of Article IV of the City Charter, and thereafter and on, to-wit the 12th day of December, A D 1967, said Ordinance No 69, 1967, was duly published in the Fort CoIlins Coloradoan, a daily news- paper published in the City of Fort Collins , Colorado IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of this City, this 12th day of December, A D 1967 City CIjbrk
