BEING AN ORDINANCE VACATING AN EASEMENT IN THE NORTHEAST QUARTER OF SECTION 23, TOWNSHIP
7 NORTH, RANGE 69 WEST OF THE SIXTH P.. M
WHEREAS, the City Council acquired an easement for utilities by agreement recorded in
the Larimer County Records, in Book 1107, at page 316, and
WHEREAS, the. improvements serve by a portion of said easement have been relocated, and
alternate easement has been provided to the City, and all utilities located in said portion
of such easement have been relocated, and such portion of said easement is not needed for
municipal purposes, and
and WHEREAS, the City Council has been petitioned to vacate such portion of said easement,
WHEREAS, it appears that the rights of the residents of the City of Fort Collins will
in no way, be prejudice or injured by the vacation of said easement.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS:
That portion of the easement acquired by agreement recorded in Book 1107, at page 316
of the Larimer County Records, to-wit:
That part of the Northeast quarter of Section 23; Township 7 North, Range 69 West of
the Sixth P. M. , Larimer County Colorado, described as follows : Beginning at the Northeast
corner of said Section 23; thence West along the North line of Section 23, a distance of
55.07 feet to a point which iS the intersection of the center line of Prospect Street, and
the Westerly right-of-way line of U. S. Highway No. 287, then South 0'53' West along said
Westerly right-of-way, a distance of 220.02 feet; thence West a distance of 67.05 feet to
the true point of beginning; thence West a distance of 160 feet; thence North a distance
of 10 feet; thence East a distance of 150 feet; thence North a distance of 180 feet; thence
East a distance of 10 feet; thence South a distance of 190 feet to the true point of begin-
ning.
Be an the same hereby is abolished, vacated, and abated
Introduced, considered favorably on first reading, and ordered published this 3rd day
of July, 1969, and to be presented for final passage on the 24th day of July, 1969.
