ACCEPTING AND APPROVING THE PLAT OF WHAT IS KNOWN AS
THE NORTH COLLEGE AVENUE ANNEXATION TO THE CITY OF
FORT COLLINS, COLORADO, AND AUTHORIZING THE ANNEXATION
OF ALL THE TERRITORY EMBRACED IN SAID PLAT TO THE CITY
OF FORT COLLINS AND TO BE INCLUDED WITHIN THE LIMITS AND
JURISDICTION THEREOF, PURSUANT TO THE AUTHORITY CONTAINED
IN ARTICLE ll, CHAPTER 139, COLORADO REVISED STATUTES 1953
WHEREAS, heretofore written petitions were presented to the Council
of the City of Fort Collins in substantial compliance with the provisions of
Article 11, Chapter 139, Colorado Revised Statutes, 1953, by ninety-seven (97)
persons purporting to be 56 48 per cent of the qualified electors in the area
of the territory involved and further purporting to be the owners of 55 96
per cent of the area of the land embraced in what is known as the North College
Avenue Annexation to the City of Fort Collins, wherein and whereby said
petitioners petitioned the City of Fort Collins for the annexation of all the
territory embraced in what is known as North College Avenue Annexation to the
City of Fort Collins, Colorado, comprising the lands shown in the amended plat
thereof attached to said petition and more particularly described as hereinafter
set forth, and
WHEREAS, said petition was accepted by the Council of the City of
Fort Collins by resolution passed and adopted on the 22nd day of October, 1959,
and
WHEREAS, since the filing of the above mentioned petitions requests
were made that the following described lands be excluded from tie original
description, as follows
1. Finley land Part of the SP& of the SWk of Section 36,
Township 8 North, Range 69 West of the 6th P M , Larimer County,
Colorado, contained within boundary lines beginning at a point
on the South line of the SWk of the SWk of said Section 36 and
215 00 feet East of the SW corner thereof and running thence
East 995 98 feet, more or less, to the SE corner of the SWk
of the SW-1, of said Section 36, thence North 331.83 feet,
along the East line of the SWk of the SWk of said Section 36,
thence West 995.98 feet, more or less, parallel to the South
line of the SWk of the STD of said Section 36, to a point
215,00 feet East of the West line of said Section, and thence
South 331.83 feet, to the point of beginning
2 Dreher land Part of the NW& of the SW� of Section 1,
Township 7 North, Range 69 West of the 6th P M , Larimer
County, Colaado, contained within boundary lines beginning
at a point which is 625 feet North and again 175 feet East
of the SW corner of the NWk of the SWk of said Section 1,
and running thence North 537 feet, parallel to the Wet line
of said Section 1, thence East 40 feet, thence South 537
feet, and thence West 40 feet, to the point of beginning.
3 Harry Young land A portion of the SW4 of the SW4 of
Section 1, Township 7 North, Range 69 West of the 6th P M
Larimer County, Colorado, contained within boundary lines
beginning at a point which is 1137.6 feet North and again
190 feet East of the SW corner of said Section 1, and
running thence East 40 feet, thence South 94 7 feet, thence
West 40 feet and thence North 94.7 feet, to the point of
beginning.
and
WHEREAS, prior to the consideration of the within ordinance a public
hearing was had on the question of the exclusion of said lands and no
objection to such exclusion having been made, and
WHEREAS, the Council of the City of Fort Collins has determined that
said request for exclusion should be granted, and
WHEREAS, the Dreher Pickle Co has consented to its lands being
bisected by the East boundary of the proposed North College Avenue Annexation,
provided, the City of Fort Collins shall construct, shortly after annexation,
at its expense, a trunk water line of ample size from the Maple Street
connection in Fort Collins and across the Cache la Poudre River to and connection
with the North College Avenue Water Association line with the City to receive
such financial assistance from the North College Avenue Water Association as the
same is willing to give, and
WHEREAS, notice for hearing on the loth day of December, 1959, on an
ordinance approving the annexation of said territory as shown by the amended
plat and including the same within the limits and jurisdiction of the City of
Fort Collins with that portion of said annexed lands lying in the Northwest
quarter of the Northwest quarter of Section 12, Township 7 North, Range 69 West
of the 6th P.M , and the Southeast quarter of the Southwest quarter of Section 2,
Township 7 North, Range 69 West of the 6th P. M to be included in the "Fn
Industrial District, and with that portion of the annexed lands lying in the West
half of Section 1, Township 7 North, Range 69 West of the 6th P M. , the Northeast
quarter of Section 2, Township 7 North, Range 69 West of the 6th P M , and the
Southwest quarter of the Southwest quarter of Section 36, Township 8 North,
Range 69 West of the 6th P M , excepting the resubdivision of Goehring Subdivision,
to be included in the "D" Commercial District, and that portion of said annexed
lands in the resubdivision of the Goehring Subdivision to be included in the
' B" Residential District was duly published as provided by law, and

WHEREAS, the Council of the City of Fort Collins has found that the
petition and the documents thereto attached meet the requirements of Article 11,
Chapter 139, Colorado Revised Statutes, 1953, and
WHEREAS, no proceedings for an election to determine the question of
annexation have been initiated by written counter-petition as provided by law
and no objection to annexation having been made,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
Section 1 That after due consideration of the petition for annexation,
the petition for the annexation of all the territory in what is known and'
described as the North College Avenue Annexation to the City of Fort Collins,
Colorado, as shown by the plat thereof annexed to said petition and which is
more particularly described as follows, to-wit
Parts of Section 12-7-69, Section 1-7-69, Section 2-7-69,
Section 35-8-69, and Section 36-8-69, Larimer County,
Colorado, contained within boundary lines described as
follows Beginning at the SW corner of Section 1-7-69,
thence North along the West line of said Section 422 37
feet, thence N 73019' % 94.83 feet, thence South 449.20
feet, to a point on South line of Section 2-7-69, thence
West 415 feet plus or minus along South line of said
Section 2, to a point on the North bank of the Cache la
Poudre River, thence in a Northwesterly direction along
said meandering North bank of the Cache la Poudre River
4300 feet more or less to a point on the North line of
the SR of Section 2-7-69, thence East 725 feet more or
less to the NE corner of the SSA of Section 2-7-69, thence
East 1320 feet more or less to the NW corner of the NE4
of SE4 of Section 2-7-69, thence North 2642 83 feet more
or less to the NW corner of NE4 of NE4 of Section 2-7-69,
thence North 306.85 feet along the West line of SETS of SE4
of Section35-8-69, to a point on the North boundary line
of the Re-Subdivision of the GoehringSubdivision Plat
dated July 7, 1947, and running thence N 56019' E 247.80

feet more or less to the SE corner of the Griffin Addition,
plat dated July 28, 1955, thence North along the West line
of NT& of the NWT of Section 12-7-69 226 5 feet to the point
of beginning, being an area of 266 acres, more or less,
be accepted and approved and that the said territory be annexed and made a part
of the City of Fort Collins and be included within the limits and ,jurisdiction
thereof with that portion of said annexed lands lying in the Northwest quarter
of the Northwest quarter of Section 12, Township 7 North, Range 69 West of the
6th P M , and the Southeast quarter of the Southwest quarter of Section 2,
Township 7 North, Range 69 West of the 6th P M to be included in the "F"
Industrial District, and with that portion of the annexed lands lying in the West
half of Section 1, Township 7 North, Range 69 West of the 6th P M., the Northeast
quarter of Section 2, Township Z North, Range 69 West of the 6th P.M , and the
Southwest quarter of the Southwest quarter of Section 36, Township 8 North,
Range 69 West of the 6th P M., excepting the resubdivision of Goehring Subdivision,
to be included in the "D" Commercial District, and that portion of said annexed
lands in the resubdivision of the Goehring Subdivision to be included in the
"B" Residential District and that the City Clerk be, and he is hereby

authorized and directed to prepare certified copies of tins ordinance to each
of which shall be attached a plat of said North College Avenue Annexation to
the City of Fort Collins, Colorado, and shall file a copy thereof in the office
of the Clerk and Recorder of the County of Larimer and another copy thereof in
the office of the Clerk of the City of Fort Collins, together with a certified
copy of said petition and another copy of said petition and approving ordinance
with the Secretary of State of the State of Colorado
Section 2. That in accepting and approving the plat of the North
College Avenue Annexation to the City of Fort Collins, the City of Fort Collins
does not assume obligations respecting the construction of water mains, sewer
lines, gas mains, electric light lines or other services or utilities with respect
to service of said addition, except as may be required and provided by the owners
of property within the limits of said addition in compliance with the terms and
provisions of Ordinance No 7, 1921, relating to local and public improvements
as amended, and except that the City of Fort Collins shall shortly after
annexation, at its expense, construct a trunk water line of ample size from
the Maple Street connection in Fort Collins and across the Cache Is Poudre
River to and connection with the North College Avenue Water Association line,
with the City of Fort Collins to receive as assistance for such provision
the cash assets of said association.
Introduced, considered favorably on first reading and ordered published
this loth day of December, 1959, to be presented for final passage on the 31st
day of December, 1959
