ORDINANCE NO 41 1959,
ACCEPTING AND APPROVING THE PLAT OF WHAT IS KNOWN AS
MILLER BROTHERS SIXTH FOOTHILLS ANNEXATION TO THE CITY
OF FORT COLLINS, COLORADO, AND AUTHORIZING THE ANNEXATION
OF ALL THE TERRITORY EMBRACED IN SAID PLAT TO THE CITY
OF FORT COLLINS AND TO BE INCLUDED WITHIN THE LIMITS AND
JURISDICTION THEREOF, PURSUANT TO THE AUTHORITY CONTAINED
IN ARTICLE 112 CHAPTER 139, COLORADO REVISED STATUTES, 1953
IIHEREAS, heretofore a written petition was presented to the Council
of the City of Fort Collins in substantial compliance with the provisions of
Article 11, Chapter 139, Colorado Revised Statutes, 1953, by the sole owners
of the area of land embraced in what is known as the Miller Brothers Sixth
Foothills Annexation to the City of Fort Collins, wherein and whereby said
petitioners petitioned the City of Fort Collins for the annexation of all the
territory embraced in what is known as Miller Brothers Sixth Foothills
Annexation to the City of Fort Collins, Colorado, comprising the lands shown in
the plat thereof attached to said petition and more particularly described as
hereinafter set forth, and
WHEREAS, said petition was accepted by the Council of the City of
Fort Collins by resolution passed and adopted on the 22nd day of October, 1959,
and
WHEREAS, notice for hearing on the loth day of December, 1959, on an
ordinance approving the annexation of said territory and including the Easterly
portion of the same within the limits and jurisdiction of the City of Fort
Collins as a part of the "B" Residence District was duly published as provided
by law, and
WHEREAS, the Council of the City of Fort Collins has found that the
petition and the documents thereto attached meet the requirements of Article 11,
Chapter 139, Colorado Revised Statutes, 1953, and
WHEREAS, no proceedings for an election to determine the question of
annexation have been initiated by written counter-petition as provided by law
and no objection to annexation having been made,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
Section 1, That after due consideration of the petition for annexation,
the petition for the annexation of all the territory in what is known and
described as Miller Brothers Sixth Foothills Annexation to the City of Fort Collins,
Colorado, as shown by the plat thereof annexed to said petition and which is
more particularly described as follows, to-wit
A tract of land situate in the SW'k of Section 15, Township 7
North, Range 69 West of the 6th P M., Larimer County, Colorado, ✓
which, considering the West line of said SWk as bearing N: 00'
32' W and with all bearings contained herein relative thereto
is contained within the boundary lines which begin at a point
which bears S. 00* 32' E 1401 00 feet from the Northwest corner of
said SWt and runs thence S. 00' 32' E 480 00 feet, thence N. 89°
28' E 380.00 feet, thence N. 00' 32' W. 270 78 feet, thence N.
690 54' E. 369.47 feet, thence N. 83' 42' E. 205.14 feet, thence
S. 820 30' E 176.51 feet, thence S 00' 32' E 5 70 feet, thence
N. 890 28' E. 180 00 feet, thence N�00' 32' W. 253 06 feet, t/
thence N. 82' 30' W. 320 19 feet, thence along the arc of a 700
foot radius curve to the left a distance of 337 20 feet, the
long chord of which bears S 830 42' W. 333.94 feet, thence S 690
54' W. 432.00 feet, thence along the arc of a 420 foot radius curve
to the right a distance of 143 43 feet, the long chord of which
bears S 790 41' W. 142.73 feet, thence S. 390 28' W. 90.00
feet to the point of beginning,
be accepted and approved and that the said territory be annexed and made a part
of the City of Fort Collins and be included within the limits and ,jurisdiction
thereof, and that the following described lands situate in the Easterly portion
of the above described lands, to-wit
Beginning at the Northeasterly most corner of the above
described tract and running thence N 820 30' W. 247 67
feet, thence South 07' 30' W. 100 07 feet, thence South
820 30 E.^+W,47 feet, thence South 070 30' W. 170.00 feet,
thence South 82° 30' E. 90,53 feet, thence South 00° 32' E
5.70 feet, thence North 890 28' E. 180.00 feet, thence North
000 32' W. 253.06 feet to the point of beginning,
be included as a part of the "B" Residence District, and that the City Clerk be,
and he is hereby authorized and directed to prepare certified copies of this
ordinance to each of which shall be attached a plat of said Miller Brothers
Sixth Foothills Annexation to the City of Fort Collins, Colorado, and shall file
a copy thereof in the office of the Clerk and Recorder of the County of Larimer and
another copy thereof in the office of the Clerk of the City of Fort Collins,
together with a certified copy of said petition and another copy of said
petition and approving ordinance with the Secretary of State of the State of
Colorado.
Section 2. That in accepting and approving the plat of the Miller
Brothers Sixth Foothills Annexation to the City of Fort Collins, the City of
Fort Collins does not assume obligations respecting the construction of water
mains, sewer lines, gas mains, electric light lines or other services or utilities
with respect to service of said addition, except as may be required and provided by
the owners of property within the limits of said addition in compliance with the
terms and provisions of Ordinance No. 7, 1921, relating to local and public
improvements as amended.
Introduced, considered favorably on first reading and ordered published
this loth day of December, 1959, and to be presented for final passage on the
31st day of December, 1959,
