ADDITION TO THE CITY OF FORT COLLINS AND AUTHORIZING THE ANNEXATION OF ALL THE TERRITORY EMBRACED IN SAID PLAT TO THE CITY OF FORT COLLINS, THE SAME TO BE MADE A PAPT OF THE CITY OF FORT COLLINS AND TO BE INCLUDED WITHIN TFE LIMITS AND JURISDICTION THEREOF, PURSUANT TO THE AUTHORITY CONTAINED IN ARTICLE 113 CHAPTER 1395, COLORADO REVISED STATLITE$, 1953 WIMEAS, heretofore a written petition has been presented to the Council of the Cityof Fort Collins in substantial compliance with the provisions of Article 11, Chapter 139, Colorado Revised Statutes, 1953, by the State Board of Agriculture purporting to be the sole owner if the land embraced in what is known as the Second College Addition to the City of Fort Collins Colorado, wherein and whereby said petitioner and applicant petitioned the City of Fort Collins for the annexation of all the territory embraced in what is known as the Second College Addition to the City of Fort Collins, Colorado, comprising the lands shown on the plat thereof annexed to said petition and more particularly described as follows The South one-half (S2) of the Southeast quarter (SE4) of Section Thirteen (13), Township Seven (7) North, Range Sixty-nine (69) West of the Sixth Principal Meridian The North one-half (N2) of the Southeast quarter (SE4) of Section Thirteen (13), Township Seven (7) North, Range Sixty-nine (69) West of the Sixth Principal Meridian, except the following described tracts Beginning at a point on the North line of Garfield Street in the City of Fort Collins continued East one thousand (1,000) feet East of Smith Street, thence North three hundred six and one-half DOD feet to county road, thence East eight hundred fifty-two and one-half (8522) feet along the county road, thence South three hundred six and one.-half (3062) feet to con- tinuation on North line of Garfield Street, thence West eight hundred fifty-two and one-half (8522) feetto place of beginning also beginning at a point on the South line,,, of the cmgity road a continuation of the East lino of Stover Street in Section Thirteen (13) Township Seven (7) North Range Sixty-nine (69) West, thence East four hundred (400) feet along the South line of the county roaa, thence South two hundred seventy-five (275) feet, thence West one hundred sixty (160) feet, thence South thirty-one (31) feet, thence West two hundred forty (240) feet, thence North three hundred six (306) feet to place of beginning WHEREAS, said petition was accepted by the Council of the City of Fort Collins by resolution passed and adopted on the 13th day of December, A D 1o56 and s 1 I=EAS, notice for hearing on the 24th day of January, A D 1957, on an ordinance approving the annexation of the above described territory and including the same within the limits and Pjurisdiction of the City of Fort Collins was duly publishedas provided by law, and WHEREAS, the Council of the City of Fort Collins has found that the petition and the documents attached thereto meet the requirements of Article 113 Chapter 139, Colorado Revised Statutes1953, BE IT ORDIINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 That after due consideration of the petition for annexation, that the petition for annexation of all the territory em- braced in what is known and described as the Second College Addition to the City of Fort Collins, Colorado, as shown by the plat thereof annexed to said petition, be accepted and approved, and that the saia territory be annexed and made a part of the City of Fort Collins and be included within the limits and jurisdiction thereof, and that the City Clerk be and he is hereby authorized ana directed to prepare certified copies of this ordinance to each of which shall be attached a plat of said Second College Addition to the City of Fort Collins, Colorado, and shall file one copy thereof in the office of the Clerk and Recorder of the County of Larimer and another copy thereof in the office of the Clerk of the City of Fort Collins, together with a certified copy of the said petition and another copy of said plat and approving ordinance with the Secretary of State of the State of Colorado Section 2 That the same shall in no sense be interpreted as (1) conveying to the City of Fort Collins any right, title or interest in said property, (2) granting any jurisdiction whatever for regulation of traffic or parking or for other purposes relating to the traffic control, (3) conveying an/fight to establish new streets or extend existing streets on or across said property, (4) granting any jurisdiction whatever over 2 normal procedures of conducting research in crops and soils by the petitioner, nor (5) granting any right to apply the provisions of any muricipal ordinance, and specifically any building code, zoning code, or licensing ordinance upon the above described property/so long as title thereof shall remain in the State Board of Agriculture Section 3 That in accepting and approving the plat of the Second College Addition to the City of Fort Collins the City of Fort Collins does not assume any obligations respecting the construction of water mains, sewer lines, gas mains, electric light lines or other services or utilities with respect to the service of said annexation except as may be required and provided by the owners of property within the limits of said annexation at their own expense and except as may be initiated by the owners of property within the limits of said annexation in compliance with the terms and provisions of Ordinance No 7, 1921, relating to local public improvements
