ACCEPTING AND APPROVING THE PLAT OF WHAT IS KNOWN AS

OF-FORT COL-LINS,, COLORADOND AUTHORIZING
ANNEXATION..OF ALL THE TERRITORY EMBRACED IN•SAID PLAT
TO THE CITY OF FORT COLLINS
TO. BE INCLUDED.WITHIN
THE:,LIMITS AND JURISDICTION THEREOF, PURSUANT .TO.THE
AUTHORITY CONTAINED IN ARTICLE .11, _CHAPTER. 139, COLORADO
REVISED-STATUTES 1953.
WHEREAS, ,heretofore a written petition was presented to the Council
of the City of Fort Collins in substantial compliance with the provisions of
Article 11, Chapter 139, Colorado Revised Statutes, 1953, by the sole owners
of the area of land embraced in what is known as,Miller Brothers Tenth
Foothills Annexation to the City of Fort Collins, wherein and whereby. said
petitioners petitioned the City of Fort Collins for the annexation of all
the territory embraced. in what is known as Miller Brothers..Tenth +Foothills
Annexation to the City of Fort Collins, Colorado, comprising the lands shown
in the plat thereof attached to said petition and more particularly described
as hereinafter set forth, and .
WHEREAS, said petition was accepted by the Council of the City of
Fort Collins by resolution passed and adopted on September 15, 1960, and
- WHEREAS, notice for hearing on the 27th day of October, A. D.
1960, on an ordinance approving the annexation of said territory and
including the same within the limits and jurisdiction of the City of
Fort .Collins•,was"duly published as provided by law, and
`'WHEREAS,''the 'Council of the City of Fort Collins has found that the
petition and:the documents thereto attached meet the requirements of Article 11,
Chapter- 139, Colorado Revised Statutes, 1953,, and
WHEREAS, no proceedings for an election to determine the question of
annexation 'have been initiated by written counter-petition. as provided.by law
and no objection to annexation having been made,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS:
Section 1: That after due consideration of the petition for
annexation, the petition for the annexation of all the territory in what is '
known and described as Miller Brothers Tenth Foothill Annexation to the City'
of Fort Collins, Colorado, as shown by; the plat thereof annexed to said petition and
which is more particularly described as follows, to-wit:

A tract of land situate in the SE4 of Section 16,
Township 7 North, -.Range 69 'West of the 6th P.M.
County of Larimer, State of Colorado, which considering
the East line of said SE4 as bearing N. 00'32' W. and
with all bearings contained herein relative thereto
is contained within the boundary lines which begin at
a point which bears N. 00032' W. 550.05 feet from the
Southeast corner of the NE4 of said SE4 and run thence
N. .89041' W. 289:22 feet, thence S. 82*25' W. 672.18 feet,
thence N'. 45°41' W._ 79.65 feet, thence N. 23037145" W.
79.04 feet, thence N. 86026130" W. 110.00 feet, thence
along the arc of a 175 foot radius curve to the right a
distance of 16.75 feet, the long chord of which bears N.
06018' E. 16.74 feet, thence N. 80°57'30" W. 164.57 feet,
thence N: 00°22'30" W. 686.58 feet to a point on the
North line of said.SE4, thence S. 89043'30" E. 1311.96 feet
along said North line. to the Northeast corner of said
SE4," thence S. 00*32' E. 770.60 feet to the point of
beginning, containing 23.6507 acres more or less;
be accepted and approved and that said territory be annexed and made a part of
the City of Fort Collins and be included within the limits and jurisdiction
thereof and that the City Clerk be and he is hereby authorized and directed
. to prepare certified copies of this ordinance, to each of which shall be
attached a plat of said Miller Brothers Tenth Foothills Annexation to the
City of Fort Collins, Colorado, and shall file a copy thereof in the office
of the Clerk and Recorder of the County of Larimer and another copy thereof
in the office of the .Clerk of the City of Fort Collins, together with a
certified copy of said petition and another copy of said petition and approving
ordinance with the Secretary of State of the State of Colorado.
Section 2. That in accepting and approving the plat of the
Miller Brothers Tenth Foothills Annexation to the City of Fort Collins, the
City of Fort Collins does not assume obligations respecting the construction
of water mains, sewer lines, gas mains, electricllight lines or other
services or utilities with respect to service of said addition, except as .
may be required and provided by the owners of property within the limits
of said addition in compliance with the terms and provisions of Ordinance
No. 7, 1921, relating,to local and public improvements as amended.
Introduced, considered favorably on first reading and ordered
published this 27th day of October, A. D. 1960, and to be presented for
final passage on the 17th day of November, A. D. 1960.
