BEING AN ORDINANCE ANNEXING CERTAIN TERRITORY TO THE CITY
OF FORT COLLINS, COLORADO
W:iMEAS, heretofore a written petition, together with four prints of
an annexation map, was filed with the City Clerk of the City of Fort Collins
requesting; the annexation of certain territory more particularly described
below to the City of Fort Collins, Colorado, and
WHEREAS, the City Council has found and determined and does hereby
find and determine that said petition is in substantial compliance with the
provisions of Colorado Revised Statutes, 1963, S 137-21-6, as amended, and
WHE::7-_1S, the owners of one hundred per cent of the property to be .
annexed have petitio:ied for said annexation, and
WHEREAS, not less than one-sixth of the perimeter of the area to be
annexed is contiguous with the City of Fort Collins and a community of interest
exists between the territory to be annexed and the City of Fort Collins and the
territory to be annexed is urban or will be urbanized in the near future and
such territory is integrated or is capable of being integrated with the City
of Fort Collinc, and
WHEREAS, none of the provisions of Colorado Revised Statutes, 1963,
139-21-4, as onended, are violated by the annexation of zhis territory to the
City oc Vort Collins, and
WHEREAS, no election is required under the provision of Colorado
Revisac Statutes, 1963, $ 139-21-6 (2) and no additional terms and corcitions
are to be imposed in connection with this annexation, and
WHEREAS, the territory is eligible for annexation and the City Council
de�i ea to annex the same to the City of Fort Collins.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS:
Section 1. That all of the territory more particularly described as
situate in the County of Larimer, State of Colorado, to-wit:
A tract of land located in the NE} of Section 16, Township
7 North, Range 69 West of the 6t' P. M., Larimer County,
Colorado, being more particularly described as follows:
Beginning str_the NE corner of said tract, from which the
NE corner of Section 16, Township 7 North, Range 69 West
of the 6t' P. M., Colorado bears N. 62039'45" E. a distance
of 2837.21 feet; thence S. 0025' E. a distance of 1325.41 feet
to the centerline of West Elizabeth Street; thence N. 89045'
W. along the centerline of said street, a distance of 45.97
feet to the SW corner of the tract; thence N. 0'25' W. a
distance of 1325.54 feet; thence S. 89'35'30" E. a distance
of 45.97 feet to the point of beginning;
ba and it hereby is annexed to the City of Fort Collins and made a part of said
City, to be known ass the Valley Hi Second
Annexation to the City of Fort Collins.
Section 2. T: at in annexing said territory to the City of Fort
Collins, the City of Fort Collins does not assume any obligation respecting the
construction of dater mains, sewer lines, gas mains, electric service lines,
streets or any ot..er services or utilities in connection with the territory
hereby rnnexed except as may be provided by the ordinances of the City of Fort
Collins.
Introduced, considered favorably on first reading, and ordered
published this 10" day of February, A. D. 1966, and to be presented for
final passage on the 3rd day of March, A. D. 1966.
