BEING AN ORDINANCE ANNEXING CERTAIN TERRITORY TO THE CITY
OF FORT COLLINS, COLORADO
WHEREAS, heretofore a written petition, together with four prints of
an annexation map, was filed with the City Clerk of the City of Fort Collins
requesting the annexation of certain territory more particularly described
below to the City of Fort Collins, Colorado, and
WHEREAS, the City Council has found and determined and does hereby
find and determine that said petition is in substantial compliance with the
provisions of Colorado Revised Statutes, 1963, 9 137-21-6, as amended, and
WHEREAS, the City of Fort Collins is the sole owner of the property
to be annexed and said property is not solely a public street or right of way,
and,
WHEREAS, not less than one-sixth of the perimeter of the area to be
annexed is contiguous with the City of Fort Collins and a community of interest
exists between the territory to be annexed and the City of Fort Collins and the
territory to be annexed is urban or will be urbanized in the near future and
such territory is integrated or is capable of being integrated with the City
of Fort Collins, and
WHEREAS, none of the provisions of Colorado Revised Statutes, 1963,
9 139-21-4, as amended, are violated by the annexation of this territory to the
City of Fort Collins, and
WHEREAS, no election is required under the provisions of Colorado
Revised Statutes 1963 1 139-21-6 (2) and no additional term and conditions
are to be imposed in connection with this annexation, and
WHEREAS, the territory is eligible for annexation and the City Council
desires to annex the same to the City of Fort Collins I-
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS
Section 1 That all of the territory more particularly described as
situate in the County of Larimer, State of Colorado, to-wit
A tract of land situate in the SW} of Section 2, Township 7
North, Range 69 West of the 6`b P M , Larimer County
Colorado, which, considering the South line of said Section
2 as bearing East and West and with all bearings contained
herein relative thereto, beginning at the West 1/16 corner
on the South line of said Section 2 and run thence N 00 02
E 565 12 feet, thence S 66 17 E 405 79 feet, thence S
86 25 E 954 10 feet to the East line of the SA of said
Section 2 thence along said East line South 10 00 feet
thence S 84*29 W 702 70 feet thence S 28*53 30 E
55 30 feet, thence S 01*01 W 215 86 feet to the South
line of said Section 2, thence along said South line West
648 86 feet to the point of beginning excepting therefrom
that portion of the above described property more particularly
described as beginning at a point which bears N 00 02 E
246 18 feet and again S 89*58 E 50 00 feet from the
West 1/16 corner on the South line of Section 2 and run
thence N 00 02 W 171 25 feet thence S 89*58 E 162 26
feet, thence S 66*17 E 116 50 feet thence S 00*02'
W 124 45 feet, thence N 89*58 W 268 96 feet to point
of beginning,
be and it hereby is annexed to the City of Fort Collins and made a part of said
City, to be known as the Service Center
Annexation to the City of Fort Collins
Section 2 That in annexing said territory to the City of Fort
Collins, the City of Fort Collins does not assume any obligation respecting the
construction of water mains, sewer lines, gas mains, electric service lines,
streets or any other services or utilities in connection with the territory
hereby annexed except as may be provided by the ordinances of the City of Fort
Collins
Introduced, considered favorably on first reading, and ordered
published this 261 day of May, 1966, and to be presented for
final passage on the 161*" day of June, A D 1966
