HomeMy WebLinkAbout068 - 11/17/1966 - REGULATION OF TRAFFIC UPON THE PUBLIC STREETS OF THE CITY AND ADOPTING BY REFERENCE THE MODEL TRAFF ORDINANCE NO 68 , 1966 BEING AN ORDINANCE FOR THE REGULATION OF TRAFFIC UPON THE PUBLIC STREETS OF THE CITY OF FORT COLLINS, COLORADO, AND ADOPTING BY REFERENCE THE 'MODEL TRAFFIC CODE FOR COLORADO MUNICIPALITIES' (1966) AS AMENDED HEREIN AND PROVIDING PENALTIES FOR THE VIOLATION OF THE SAME AND REPEALING CHAPTER 23 OF THE CODE OF ORDINANCES OF THE CITY OF FORT COLLINS, COLORADO, 19589 AS AMENDED BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS s Section 1 Pursuant to Chapter 139, Article 34, C R S , 1963, there is hereby adopted for the purpose of regulating traffic within the City of Fort Collins that certain ordinance known as the "Model Traffic Code for Colorado Municipalities ' ( 1966) officiallv approved and adopted and published as such by the Colorado Highwav Safet'v Council and hereinafter referred to as the "Municipal Traffic Code ', the same being adopted as if set out at length, save and except as sections thereof are deleted by -)ection 2 of this ordinance or amended in Section 3 hereof Section 2` The following sections or parts of sections of the ' Municipal Traffic Code' are herebv declared to be inapplicable to this municipality and are Ohereby expressly deleted Namely Section 13-4, Section 16-5 (c) , Section 17-6, Section 17-19 (0, Section 22-6, Section 22-7, Section 22-9, Section 26-1, Section 26-2, Section 27-2, Section 27-3, Section 27-4, Section 27-5. Section 27-6, Article XXVIII Section 3 The following sections, articles, schedules or parts thereof of the "Municipal Traffic Code" are hereby amended to read as follows (The words no change' indicate that there has been no change from the wording of the applicable parts of the ' Municipal Traffic Code' ) Section 2-2 Entering Stop or Yield Intersection (a) No change (b) No change (c) No ch,nee (d) Where stop signs have been erected on all corners at an intersection, the first vehicle arriving at the intersection shall, after having stopped, have the right of way, and when two vehicles have arrived at the intersection from different streets at approximately the same time, the driver of the vehicle on the right, having first stopped, shall have the right of way Section 3-2 Obedience to Railroad Signal (a) No change (b) No change. (c) The stopping requirements herein shall apply also when a railroad train approaching the street crossing emits an audible signal and such railroad train, by reason of its zpeed and nearness to such crossing, is an immediate hazard, or when an approaching train is plainly visible and is in hazardous proximity to such crossing, or when a human flagman gives or continues to give a sigral of the 11-3 Parking For Certain Purposes Prohibited No person shall park ayehicle upon a roadway for the principal purpose of (1) No change (2) No change (3) No change (4) Selling merchandise from such vehicle except in a duly established market place, or when so authorized or licensed under the ordinances of this municipality (5) Storage, or as junkage or dead storage for more than 72 hours (6) Occupancy thereof and no vehicle shall be perKed upon any lot or premise within the city limits for the purpose of occupancv thereof unless the same shall meet with all sanitary and building code requirements regulating the construction and occupancv of habitable buildings Section 12-4 All Night Parking No person except physicians or other persons on emergency calls shall park a vehicle on any street signed to p*ohibit all night parking for a period of time longer than 30 m..nutes between the hours of 2 00 A M and 6 00 A M of any day Section 13-1 Standing in Passenger Curb Loading Zone No person shall stop stand, or park a vehicle for any purpose or period of time other than for the expedious loading or unloading of passengers in anv place officially marked as a passenger curb loading zone during the hours when the regulations applicable to such curb loading zone are effective, and then only for a period not to exceed five minutes Section 13-3 Permits for Curb Loading Zones Whenever special permits are issued in accordance wi'h the Code of Ordinances of this municipality to establish or control the use of curb loading zone or to allow the backing of a vehicle to a curb for the purpose of loading or unloading merchandise or materials subject to certain conditions no permi*e or other person shall violate any of the special terms of any such permit -3- Section^13-5 Stopping# Standing or Parking of Buses and Taxi Cabs Regulate The operator of a bus or taxi cab shall not stop, stand or park upon any street in any business district at any place other than at a bus stop, or taxi cab stop, respectively, except that this provision shall not prevent the operator of any such vehicle from temporarily stopping in accordance with other stopping, standing, or parking regulations at any place for the purpose of or while actually engaged in the expeditious loading or unloading of passengers Section 15-2 Obedience to Official Devices (a) The driver of any vehicle shall obey the instructions of any official traffic control device applicable thereto placed in accordance with the provisions of this ordinance, unless other- wise directed by a police officer, subject to the exceptions granted the driver of an authorized emergency vehicle as provided in this ordinance (b) The drivers of all vehicles when traveling along any street adjacent to which is Located any school building used for school purposes, except police or fire department vehicles while being operated in an emergency in the performance of public duty, shall at all times have such vehicles under control so as not to endanger pedestrians traveling through or across said streets in the vicinity of such school and upon signal of any person authorized by the Chief of Police, shall come to a complete stop and when continuing shall do so with due regard to the safety of all pedestrians upon said street or portion thereof The signal to stop may be given either by a person holding a stop signal or having his arms extended, or by the placing of a traffic stop sign or signal in said street or immediately adjacent thereto Section 15-3 Official Devices Required for Enforcement Purposes (a) No provision of this ordinance for which signs or markings are required shall be enforced against an alleged violator if at the time and place of the alleged violation any official sign or marking is not in proper position and sufficiently legible to be seen by an ordinarily prudent person (b) No change Section 15-5 Traffic Control Signal Legend Whenever traffic is controlled by traffic control signals exhibiting different colored lights, or colored arrow, successively one at a time or in combination as declared in the traffic control manual adopted by the State Department of Highways, only the colors Green, Yellow and Red shall be used, except for special pedestrian control signals carrying a word legend as provided in Section 15-8 and said lights, arrows and combinations otherwise directed by a pedestrian signal pedestrians facing such signal are thereby advised that there is insufficient time to cross the roadway but any pedestrian lawfully within the intersection at change Section 15-6 Flashing Signals (a) No change (1) When a red lense is djuminated with rapid intermittentflashes drivers of vehicles shall stop before entering the nearest cross walk at an intersection or at a limit line when marked or if none then before entering the intersection or precedinn past such signal, and the right to proceed shall be subject to the rules applicable after making a stop at a stop sign Section 17-3 License application Application for a bicycle license shall be made upon a form provided for this municipality and shall be made to an issuing department designated by the City Manager A license fee of $1 50 shall be paid to this municipality before each license is granted No renewal of license shall be necessary unless said license shall have been revoked or suspended for violation of this ordinance Section 17-4 Issuance of License (a) The issuing department upon receiving a proper application and payment of license fee therefor s authorized to issue a bicycle license which shall be effective upon issuance (b) The authorized official issuing a license shall not issue a license for anv bicycle when he knows or has reasonable grounds to believe that the applicant is not the owner of or entitled to the possession of such bicycle (c) The issuing department shall keep a record of the number of each license, the date issued, the name and address of the person to whom issued and the number of the frame of the bicycle for which issued and a record of all bicycle license fees collected by it License fees so collected shall be remitted monthly to the City Clerk who shall give a receipt therefore Section 17-5 Attachment of License Plate (a) The issuing department upon issuing a bicycle license shall also issue a license bearing Vie license number assigned to the bicycle and the name of this municipality (b) The person to whom such license is issued shall cause the same to be firmly attached to the frame of the bicycle for which issued in such a position as to be plainly visible (c) No person shall remove a license from a bicycle except upon a transfer of ownership or in the event the bicycle is dismantled and no longer operated upon a street or bicycle path in this municipality Section 17-7 Transfer of Ownership Upon the sale or other transfer of the licensed bicycle the licensee shall remove the license and shall either surrender the same to the issuing department or may, upon proper application, have said license assigned to another bicycle owned by the applicant -5- Section 17-8 Rental Agencies A rental agency shall not rent or offer any bicycle for rent unless the bicycle is licensed and a license is attached thereto as provided herein and unless such bicycle is equipped with lamps, breaks and other equipment required in this article Section 17-15 Entering or Emerging From Alley or Driveway The operator of a bicycle emerging from an alley, driveway or building shall upon crossing a sidewalk or sidewalk area extending across any alley way or driveway yield the right of way to all pedestrians approaching on said sidewalk or sidewalk area and upon entering the roadway shall ield the the right of way to all vehicles approaching on said roadway Section 17-17 Parking Bicycles shall be parked in such a manner as to afford the least obstruction to pedestrian or motor vehicle traffic Section 18-10 Vehicles Weighed, Excess Removed (a) Any police officer having reason to believe that the weight of a vehicle and load is unlawful is authorized to require the driver to stop and submit to a weighing of the same either by means of a portable or stationary scales and shall require that such vehicles be driven to nearest public scales in the event such scales are within five miles (b) No change (c) No change Section 20-12 Permits Required for Parades, Processions and Sound Trucks No funeral procession or parade excepting the forces of the United States Armed Services and military forces of this state and the forces of the police and fire department shall occupy, march or proceed along any street or roadway except in accordance with the permit issued by the Chief of Police and such other regulations as are set forth herein which may apply No sound truck or other vehicle equipped with amplifier or loud speaker shall be driven upon any street for the purpose of selling, offering for sale, or advertising in any fashion except in accordance with a permit issued by the Chief of Police Section 22-1 Penalty Assessments (a) No change (b) Unless another penalty is expressly provided herein every person found guilty of a violation of anv provision of this ordinance may be punished by a fine of not more than $300 00 or by imprisonment for not more than 90 days and if in the opinion of the municipal judge he deems it advisable the right to drive a vehicle upon the streets of the City of Fort Collins may be revoked for a period not to exceed six months (c) A municipal judge having jurisdiction to hear traffic cases shall designate the specified offenses under the traffic ordinances of this municipality and state traffic laws in respect to which payments of fines may be accepted by the traffic violations bureau in satisfaction thereof and shall specify by suitable schedules the amount of such fines for first, second and subsequent offenses provided such fines are within the limits declared by law and shall further specify what number of offenses shall require appearance before the Court -6- Section 22-2 Forms and Notices of Arrest or Appearance, (a) The municipality shall provide books to include traffic summons for notifying alleged violators to appear and answer to charges of violating traffic laws and ordinances (b) No change (c) No change Section 22-5 Procedure Upon Arrest (a) Except wnen permitted by this ordinance to keep in custody a person arrested for a violation of any of the traffic ordinances or where any lawful bail is required any police officer upon making an arrest for violation of the traffic ordinances of this municipality sh-ill take the name, address and operators license number of the alleged violator and the registration number of the motor vehicle involved and shall issue to him in writing on the form provided by this municipality a summons or notice to answer to the charge against him at a place and at a time to be specified in the notice 'he officer serving a copy of the summons or notice upon the alleged ,iolator shall release such person from custody (b) fn every case of arrest where it appears period of 72 hours o- more and presumed to be abandored under the conditions prescribed by Section 13-5-71 C R S , 1963, as amended, such officer shall require that the driver or person in charge of the vehicle love the same to a position off the paved or improved or main traveled part of such street or alley or the officer may cause the same to be removed, placed in storage in the nearest garage time of or at the scene of the accident or thereafter by interviewing participants or witnesses, to issue summons and notices for traffic violations in connection with traffic accidents and to assist in the prosecution of those persons charged with violations of law or ordinance causing or contributing to accidents Section 23-7 Annual Traffic Safety Report The police department shall annu-ily change (5) No change Section 23-8 Office of the Traffic Engineer (a) The office of Traffic Engineer is hereby established The Traffic Engineer shall be appointed by the City Manager of this municipality and shall exercise the powers and duties provided in this ordinance (b) In the absence of such appointment or at such time as the Traffic Engineer may be absent from the municipality or unable to perform his duties the said duties shall be vested in the Chief of Police or other municipal official as determined and authorized by the City Manager of this Municipality Section 23-10 Division of Authority over Streets which are State Highways (a) All traffic and parking restrictions on streets which are a part of the state highway system shall be regulated and enforced by this municipality subject to the provisions of any agreement heretofore or hereafter entered into between the municipality and the State Department of Highways or any ordinance heretofore enacted by this municipality governing this subject (b) No change (c) No change Section 23-12 Official Traffic Control Records (a) No change (b) Said records shall include schedules of streets and parts of streets that signs giving notice of such regulation were erected Section 24-1 Traffic Violations Bureau Created (a) The municipal court having jurisdiction to hear traffic cases in this municipality may establish a traffic violations bureau to assist the court with the clerical work of traffic cases (b) No change Section 4 At least three copies of the "Model Traffic Code for Colorado Municipalities",(1966), are on file at the office of the City Clerk and may be inspected at regular business hours In add+tion, copies are available for distribution and sale to the public at a price not to exceed $ 75 per copy Section 5 If any part of parts of this ordinance are for any reason held to be invalid or unconstitutional, such decision shall not affect validity or constitutionality of the remaining portions of this ordinance The City Council hereby declares that it would have passed this ordinance and each part or parts thereof irrespective of the fact that an) one part or parts be declared invalid or unconstitutional Section 6 All former traffic ordinances of this municipality are hereby repealed including particularly Chapter 23 of the Code of Ordinances of the City of Fort Collins, Colorado, 1958, as amended, and all ordinances or parts of ordinances in conflict with or inconsistent with the provisions of this ordinance are hereby repealed except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this ordinance Section 7 This ordinance may be known and cited as the Municipal Traffic Ordinance Section 8 This ordinance shall take effect from and after the 1st day of December 1966 Section 9 Pursuant to the provisions of Article 2, Section 7, of the Charter of the City of Fort Collins the City Council hereby directs the Citv Clerk to publish the title of this ordinance together with a comprehensive summary of the substance of this ordinance and a statement that the text is -9- r available for public inspection and acquisition in the office of the City Clerk in lieu of publishing this ordinance in full
