HomeMy WebLinkAbout071 - 11/23/1966 - ADOPTING A FIRE PREVENTION CODE PRESCRIBING REGULATIONS GOVERNING CONDITIONS HAZARDOUS TO LIFE AND P ORDINANCE N0. 71 , 1966 BEING AN ORDINANCE ADOPTING A FIRE PREVENTION CODE PRESCRIBING REGULATIONS GOVERNING CONDITIONS HAZARDOUS TO LIFE AND PROPERTY FROM FIRE OR EXPLOSION AND ESTABLISHING A BUREAU OF FIRE PREVENTION AND PROVIDING OFFICERS THEREFOR AND DEFINING THEIR POWERS AND DUTIES. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 Adoption of Fire Prevention Code Pursuant to the authority conferred by Section 7, Article 2 of the Charter of the City of Fort Collins and by Article 34 of Chapter 139 of the Colorado Revised Statutes, 1963, as amended, there is hereby adopted by the City of Fort Collins for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion, that certain code known as the Fire Prevention Code recommended by the American Insurance Association being particularly the 1965 edition including the October, 1966 revision thereofland the whole thereof save and except such portions as are hereafter deleted, modified or amended (by Section 7 of this ordinance) of which code not less than three copies have been and now are filed in the office of the Clerk of the City of Fort Collins and may be inspected at regular business hours or purchased by the public at a price not to exceed $2.40 per copy and the same are hereby adopted and incorporated as fully as if set out at length herein and from the date on which this ordinance shall take effect the provisionsthereof shall be controlling within the limits within the City of Fort Collins. Section 2. Establishment and Duties of Bureau of Fire Prevention. (a) The Fire Prevention Code shall be enforced by the Bureau of Fire Prevention in the Fire Department of the City of Fort Collins which is hereby established and which shall be operated under the supervision of the Chief of the Fire Department. (b) The Chief in charge of the Bureau of Fire Prevention shall be appointed by the City Manager on the basis of examination to determine his qualifications. (c) The Chief of the Fire Department under the direction of the City Manager shall appoint an assistant Chief and such other officers and employees of such rank and grade as the City Manager shall deem necessary I (d) A report of the Bureau of Fire Prevention shall be made annually and transmitted to the City Manager It shall contain all proceedings under this code with such statistics as the Chief of the Fire Department may wish to include therein The Chief of the Fire Department shall also recommend any amendments to the code which in his judgment shall be desirable i Section 3 Definitions. (a) Whenever the word "municipality" is used in the Fire Prevention Code it shall be held to mean the City of Fort Collins, Colorado (b) Wherever the term "corporation council" is used in the Fire Prevention Code it shall be held to mean the City Attorney of the City of Fort Collins. Section 4. Establishment of Limits of Districts in Which Storage of Explosives and Blasting Agents is to be Prohibited The limits referred to in Section 12.5b of the Fire Prevention Code in which storage of explosives and blasting agents is prohibited are hereby established as follows All of the City of Fort Collins except any which is zoned either I-L - Limited Industrial District or I-G - General Industrial District, under the zoning ordinances of the City of Fort Collins, as now established or as from time to time hereafter changed or amended Section 5 Establishment of Limits of Districts in Which Storage of Flammable Liquids in Outside Above Ground Tanks is to be Prohibited (a) The limits referred to in Section 16 22a of the Fire Prevention Code in which storage of flammable liquids in outside above ground tanks is prohibited are hereby established as follows All of the City of Fort Collins except any which is zoned either I-L - Limited Industrial District or I-G - General Industrial District, under the zoning ordinances of the City of Fort Collins, as now established or as from time to time hereafter changed or amended (b) The limits referred to in Section 16 51 of the Fire Prevention Code in which new bulk plants for flammable or combustible liquids are prohibited are hereby established as follows All of the City of Fort Collins except any which is zoned either I-L - Limited Industrial District of I-G - General Industrial District, under the zoning ordinances of the City of Fort Collins, as now established or as from time to time hereafter changed or amended. -2- Section 6 Establishment of Limits in Which Bulk Storage of Liquified Petroleum Gas is to be Restricted The limits referred to in Section 21.6a of the Fire Prevention Code in which bulk storage of liquified petroleum gas is restricted are hereby established as follows All of the City of Fort Collins except any which is zoned either I-L - Limited Industrial District or I-G - General Industrial District, under the zoning ordinances of the City of Fort Collins, as now established or as from time to time hereafter charged or amended Section 7. Amendments Made in the Fire Prevention Code The Fire Prevention Code is amended and changed in the following respects (a) Article 16 is amended and changed by adding thereto the following Sections "Section 16 13 1. Fees for Permits and Occupation Tax The following fees for permits shall be charged and collected under this ordinance For each tank installed, $5 00, for each pump installed, $5 00 The operator of each service station shall obtain an annual permit for each pump used in the operation of such filling station and shall pay for each said permit an annual license fee of $10.00 The owner of each installed private pump shall obtain an annual permit for the same and shall pay therefore an annual license fee of $5 00 In construing this ordinance the word "pump" shall be construed to mean and shall mean dispenser and the fee required herein shall be payable for each dispenser " "Section 16 1016. Storage of Transport Vehicles and Tank Wagons It shall be unlawful to store or cause to be stored any transport vehicle or any tank wagon in any part of the City of Fort Collins except within an I-L - Limited Industrial District or an I-G - General Industrial District as defined by the zoning ordinances of the City of Fort Collins as now established or as hereafter amended " "Section 16.1017 parking or Stopping of Transport Vehicles or Tank Wagons. It shall be unlawful to stop or cause to be stopped any transport vehicle or tank wagon at any place within the City of Fort Collins except in an I-L - Limited Industrial District or an I-G - General Industrial District, as defined by the zoning ordinances of the City of Fort Collins as now established or as hereafter amended or for the purpose of making a delivery unless said stop should be necessary for the emergency repairs to said transport vehicle or tank wagon or in obedience to traffic regulations " "Section 16 1018 Tank Capacity of Tank Vehicle No tank vehicle shall make delivery of flammable liquids if such vehicle shall have a total tank capacity in excess of 3,500 gallons, except as follows In industrial districts or in business or residential districts on federal designated highways tank full trailers or semi trailers may deliver gasoline to bulk plants or service stations, provided the service stations are equipped with at least 10,000 gallon storage tanks and provided further that such tank vehicles are equipped with automatic shut off or over flow device which has been approved by the American Insurance Association and provided further that in making delivery the tank vehicle must be completely off the street and sidewalk area " -3- M1 AS (b) Article 16 is amended and changed so that Section 16.103 shall read as follows "Section 16.103 Permit Required and License Fee Therefor. No person shall engage in the business of delivering flammable or combustible liquids from tank vehicles without a permit. Such permit shall be obtained from the City Clerk of the City of Fort Collins. Eachapplication for such permit shall be accompanied by the sum of $25.00 for the first tank vehicle and $7.50 for each additional tank vehicle owned and used by the applicant which said sums shall be in payment of the annual license fee for said permit (c) Article 28 is amended by adding to Section 28 1 subsection (e) thereunder as follows: ' ) Hours of Burning All fires which may be lighted for the burning of material outside of the fire limits shall be extinguished by the person lighting the same before 8 00 P M on the same day on which said fire was lighted." (d) Article 28 is amended by adding thereto Section 28 15 as follows "Section 28.15. Smoking in Bed Prohibited in Certain Occupancies Smoking in bed in hotels, motels, rooming houses or any building of multiple occupancy where a life hazard exists is unlawful. Smoking in bed may be permitted in nursing, convalescent or old age homes only where proper facilities are provided. Smoking in bed shall not be permitted in sleeping quarters or dormitories except at such time as supervision is provided." (e) Article 13 is bereby deleted from said code. Article 16 is amended and changed by adding to Section 16«12 the Subparagraph A.1 as follows A.1 Attendant as related to a self-service station shall mean a competent person in the vicinity ableto observe and capable of rendering assistance in case of need who, while on duty, is performing no other services except those incident to the sale of petroleum products at the self-service station. Unattended shall mean lacking such attendant " the Chief of the Bureau of Fire Prevention thereon shall be entered upon the records of the department and a signed copy shall be furnished the applicant. Section 9 Appeals. Whenever the Chief of the Fire Department shall disapprove an application or refuse to grant a permit applied for or when it is claimed the provisions of the code do not apply or that the true intent and meaning of the code have been misconstrued or wrongly interpreted the applicant may appeal from the decision of the Chief of the -4- Fire Department to the City Council within 30 days from the date of the decision appealed Section 10 New Materials, Processes or Occupancies Which May Require Permits. The City Manager, The Chief of the Fire Department and the Chief of the Bureau of Fire Prevention shall act as the committee to determine and specify, after giving affected persons an opportunity to be heard, any new materials, processes or occupancies which shall require permits in addition to those now enumerated in said code. The Chief of the Bureau of Fire Prevention shall post such list in a conspicuous place in his office and distribute copies thereof to interested persons. Section 11. Penalties. (a) Any person who shall violate any of the provisions of this code or fail to comply with any of said provisions or who shall violate or fail to comply with any order made thereunder or who shall build in violation of any detailed statement of specifications or plans submitted and approved thereunder or any certificate or permit issued thereunder and from which no appeal has been taken or who shall fail to comply with such order as affirmed or modified by the City Council of the City of Fort Collins or by a court of competent jurisdiction within the time fixed herein, shall severally for each and every violation and non-compliance respectively, be guilty of a misdemeanor punishable a9 provided in Section 12-6 of the Code of Ordinances of the City of Fort Collins, Colorado, 1958, as amended. The imposition of one penalty for any violation shall not excuse the violation or permit it to continue and all persons shall be required to correct or remedy such violation or defects within a reasonable time and when not otherwise specified each ten days that prohibited conditions are maintained shall constitute a separate offense. (b) The application of the above penalties shall not be held to prevent the enforced removal of prohibited conditions. Section 12 Repeal of Conflicting Ordinances. All former ordinances or parts thereof conflicting or inconsistent with the provisions of this ordinance or of the code hereby adopted are hereby repealed including specifically sections 9-1 through section 9-16 inclusive of the Code of Ordinances of the City of Fort Collins, Colorado, 1958, as amended, provided that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this ordinance -5- t and, AmND ORDINANCE 710 19669 ON FINAL READING BI j.NSERTING AFTER fM WORDS AND FIGURESt "...the 1965 edition thereof . The City Council hereby declares that should any section, paragraph, sentence or word of this ordinance or the code hereby adopted be declared for any reason to be invalid it is the intent of the City Council that it would have passed all other portions of this ordinance independent of the elimination therefrom of any such portion as may be declared invalid. Section 14.
