Being an Ordinance amending Ordinance No 31 - 1964 and relating
to the vacation of certain streets in University Shopping Center
WHEREAS the Plat of University Shopping Center in the City of Fort
Collins Colorado recorded in the office of the Clerk and Recorder of Larimer
County Colorado in Book 1262 at Page 293 shows certain roads including
roadways that are the extreme boundary lines of said subdivision and
WHEREAS the owners of the property in the above mentioned Plat
abutting on said streets have heretofore petitioned the Council of the City of
Fort Collins to cause the same to be vacated and
WHEREAS it appears that said streets have never been opened to the
use of the Public and the City of Fort Collins has never expended any public
funds on said streets and said streets are not needed for any public purpose and
WHEREAS it further appears that the rights of the inhabitants of the City
of Fort Collins will in no way be prejudiced or injured by the vacation of said
streets and
WHEREAS it was the intention of Ordinance No 31 - 1964 to vacate said
streets and said Ordinance No 31 - 1964 erroneously described the same
NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF FORT COLLINS
Section 1 That Ordinance No 31 - 1964 be and the same is hereby
amended to provide that certain streets more particularly described as follows
to-wit
A portion of the service roads shown on the Plat of University
Shopping Center a Plat of which is on file in the office of the
County Clerk and Recorder of Larimer County which tract is
more particularly described as beginning at a point which bears
West 70 00 feet and again South 00 18' E 125 00 feet from the
Northeast corner of the Southeast 4 of Section 23 Township 7
North Range 69 West of the Sixth P M County of Larimer State
of Colorado and run thence S 00 18' E 1132 98 feet thence
West 55 08 feet thence along the arc of a 15 00 foot radius curve
to the left a distance of 23 64 feet the long chord of which bears
N 44 �1' E 21 27 feet thence N 00 18' W 1062 98 feet thence
along the arc of a 15 00 foot radius curve to the left a distance of
23 48 feet the long chord of which bears N 45 09' W 21 16 feet
thence West 110 08 feet thence N 00 18' W 110 08 feet thence
along the arc of a 15 00 foot radius curve to the left a distance of
23 48 feet the long chord of which bears N 45 09' W 21 16 feet
