APPROPRIATING THE SUM OF $8,000 00 FOR THE FISCAL YEAR
1957 FOR THE MAKING OF REPAIRS TO THE ARTHUR DITCH
CANAL AND DECLARING AN EMERGENCY
WHEREAS a portion of the canal of the Arthur Irrigation Ditch
located in the alley between West Mountain Avenue and Oak Street has re-
quired extensive repairs and reconstruction due to weather and other con-
ditions and
WHEREAS it is necessary that the City of Fort Collins make
such repairs and do such reconstruction work and
WHEREAS, funds for such purpose were not appropriated for the
year 1957 and it is necessary that the council provide for payment of
the expenses of such repairs and reconstruction the actual necessity of
which has been caused by casualty, accident or unforseen contingency
arising after the passage of the annual appropriation ordinance and
WHEREAS the necessity for making such repairs and reconstruc-
tion is a case of emergency for the actual preservation of the public
peace, health safety or property
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
Section 1 That there be and there is hereby appropriated for
the expenses of making repairs and doing reconstruction work to the
canal of the Arthur Irrigation Ditch lying between West Mountain Avenue
and Oak Street the sum of Eight Thousand Dollars ($8 000 00) which
said sum shall be and is hereby transferred for said purpose out of the
general fund surplus
Section 2 In the opinion of the City Council of the City of
Fort Collins the making of said repairs and doing said reconstruction
work is necessary for the actual preservation of the public peace health
safety or property- and it is therefore declared that an emergency exists
and that this ordinance shall take effect upon its passage under and by
virtue of the authority contained in Sections 6 and 7 of Article II of
the City Charter
Introduced read at length and adopted by the unanimous vote of
all the members of the City Council at a special meeting held this 6th day
of June A D 1957
