ARTICLE V AND FOR THE SUBMISSION TO A VOTE OF THE TAX- PAYING ELECTORS OF (1) AN INITIATED ORDINANCE RELATING TO THE ACQUIRING OF A TRANSPORTATION SYSTEM AND (2) OF A PROPOSED ORDINANCE RELATING TO THE ACQUIRING OF A TRANSPORTATION SYSTEM AS SUBMITTED BY THE CITY COUNCIL DECLARING AN EMERGENCY WHEREAS a proposed ordinance has been submitted to the City Council by petition bearing the signatures of 275 qualified electors, requesting the Council to submit the same to a vote of the taxpaying electors and WHEREAS the City Clerk has certified to the City Council that the petition is adequate to require the calling of a special elec- tion and WHEREAS the City Charter requires the submission to a vote of the taxpaying electors of the question presented by such ordinance as to whether the Council shall purchase and acquire the transporta- tion system and WHEREAS it is the opinion of the City Council that its own proposal for the acquiring of a transportation system should be presented at said city election and WHEREAS it is the further opinion of the City Council that a further question should be submitted to the qualified electors amending the provisions of the Charter of the City of Fort Collins relating to the maximum mill levy and WHEREAS the Council is authorized under the provisions of Section 3, Article XVII of the City Charter and Section 5 of Article XX of the State Constitution to submit at a special election any proposed ordinance and any measures or charter amendment to the voters BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 That a special election be and the same is hereby called as provided by law and held in the several precincts in the City of Fort Collins, on Tuesday, October 22, A D 1957, at which election there shall be submitted to the qualified electors a proposed charter amendment changing the provisions of Section 7, Article V of the City Charter, and at which election there shall further be submitted to the taxpaying electors (1) a proposed initiated ordinance relating to the acquiring of a transportation system, and (2) a proposed ordinance re- lating to the acquiring of a transportation system as submitted by the City Council, all of which is under and pursuant to Section 3, Article XVII of the City Charter and Section 5, Article XX of the State Consti- tution Section 2 The said election shall be held at the following places in said precincts in the City of Fort Collins, to-wit Precinct A-1 - City Hall Precinct B-1 - IdcClure & Son - 218 rest Mountain Ave Precinct B-2 - Laporte Avenue School Precinct 13-3 - Calvary Baptist Church Precinct B-4 - Community Fouse at C-ty Park Precinct C-1 - Courthouse Precinct C-2 - Junior High School Precinct C-3 - presbyterian Church Precinct C-4 - Washington School Precinct C-5 - A H Dunn School Precinct D-1 - Remington School Precinct D-2 - Bethlehem Lutheran Church Precinct D-3 - Laurel School Precinct E-1 - State Armory Drecinct E-2 - Mame Harris School Precinct :z�-3 - St Johns Lutheran Sunday School Annex Section 3 The polls shall be opened at the hour of 7 00 o'clock A If and shall remain open continuously and be closed at the hour of 7 00 o'clock P M of said day Section 4 The said election shall be held and conducted as nearly as may be in the manner prescribed by law in the case of elections for municipal officers Each elector offering to vote in the said elec- tion must be a qualified elector and must be registered under the appli- cable provisions of the Citj Charter and laws of the State of Colorado Section 5 The City Clerk shall give notice of registration by advertisement in the Fort Collins Coloradoan, the official newspaper - 2 - of the City of Fort Collins Colorado and by posting a printed notice of registration on the outside of the City Hall to the effect that reg- istration will be held in the City all as provided by law and the City Council finds and determines that such notice is sufficient adequate and reasonable notice to all qualified electors to register for said special election to be held on October 22, 1957 Section 6 Upon passage and adoption of this Ordinance the City Clerk shall publish notice and call said election as herein author- ized in accordance with law Section 7 The City Clerk shall prepare the ballots to be used at the aforesaid election as provided by Section 7 Article XVI of the City Charter and under the direction of the Board of Elections and the City Clerk shall give the required notice of the election as provided by Sec- tion 5 Article XVI of the City Charter and shall arrange the polling places matters of registration and all other details necessary for the election That registration for voting will be open as soon as conveni- ent and continue open until the closing of the office at 5 00 o'clock P M on October 12, 1957 The Charter amendment submitted hereby to the quali- fied electors by the Council for an election shall be placed upon ballots which shall be uniform in size and color and shall contain printed there- on in legible type the measures submitted for a vote, which ballots shall be arranged substantially as follows Special City Election Fort Collins Colorado October 22 1957 Voters desiring to vote for the proposed charter amendment shall mark a cross X in ink in the blank space to the right and opposite the words 'For the Charter Amendment Voters desiring to vote against such proposed charter amendment shall mark a cross X in the blank space to the right and opposite the words Against the Charter Amendment If you wrongfully mark tear or deface this ballot return it to the Judges of Election and obtain another - 3 - no 1 r r r r r r Proposed Amendment of Section 7, Article V of the City Charter r r r i Section 7, Article V of the City Charter shall be amended to r r read as follows "MAXIMUM MILL yVY The mill levy shall not r r exceed sixteen mills on each dollar of assessed valuation of r r taxable property within the City for all purposes Any mill r r levy in excessof sixteen mills aforesaid shall be absolutely r r void as to the excess and it shall be unlawful for the assessor r r to extend and for the treasurer to collect any such excess" r r r r r r For the Charter Amendment r r r r r r Against the Charter Amendment r r r r r r i Section 8 The question of acquiring a transportation system by the City of Fort Collins, as proposed by an initiated ordinance and as pro- posed by an ordinance submitted by the City Council shall be submitted to the qualified taxpaying electors for an election, shall be placed upon a separate ballot, the ballots for which shall be uniform in size and color and shall contain printed thereon in legible type the measures submitted and shall be substantially the follonring form Special City Election Fort Collins, Colorado October 22, 1957 INSTRUCTION TO VOTERS Voters desiring to rote for the ordinance submitted by the City Council shall mark a cross X in ink in the blank space to the right and opposite the words "For the Ordinance" Voters desiring to vote against such ordinance shall make a cross X in the blank spaces to the right and opposite the words 'Against the Ordinance ' Voters desiring to vote for the initiated ordinance shall mark a cross X in ink in the blank space to the right and opposite the words "For the Initiated Ordinance" Voters desiring to vote against the initiated ordinance shall mark a cross X in ink in the blank space to the right end opposite the words "Against the Initiated Ordinance " If you wrongfully m rk, tear or deface this ballot return it to the Judges of Election and obtain another 140 1 , t t r Ordinance No 30 1957, as submitted by the City Council r relating to the acquiring of a bus transportation system t r by the City of Fort Collins, providing for funds therefor, t r and submission thereof to the taxpaying elections of the t t City of Fort Collins t , t r For the Council Ordinance r , r , Against the Council Ordinance r fit r r r t , t , No 2 t r Initiated Ordinance No 2 1957, an ordinance pertaining t r to the purchase of new municipal transportation buses, paying t for said buses and setting up a plan for the operation and t maintenance of a municipal transportation system for the t t Cit of Fort Collins r , r r For the Initiated Ordinance t r t r Aga_nst the Initiated Ordinance r , r t r r r , t r Section 9 The City Clerk shall make publication and give such notice and do all acts and things in such manner and form and at such times as are pres- cribed by the applicable provisions of the Constitution and Laws of the State of Colorado and by the Charter of the City of Fort Collins The ballots cast at such election shall be canvassed and the results ascertained, determined and certified in accordance with the requirements of the applicable provisions of the Constitution and laws of the State of Colorado and the Charter of the City of Fort Collins Section 10 In the opinion of the City Council, a emergency exists for the actual vreservat_on of the public peact-, health, safety and property, since it is necessary in order to determine the budget requirements for the fiscal year 1958, that the said election be called at as early a date as possible ffithin the time required by the City Charter and the said Constitu- tion Accordingly, this Ordinance shall take effect upon its passage under and by virtue of the authority contained in Sections Six (6) and Seven (7) Article II of the City Charter IntrodLiced., read at length and adopted by the unaimous vote of all the members of the City Council as an emergencv ordinance at a regular meeting held this 12th day of Sebtember., A D 1957 Mayor ATTEST City Clerk
