HomeMy WebLinkAbout038 - 12/12/1957 - ANNEXING PROPERTY KNOWN AS THE WEST LAKE AND PROSPECT STREETS CONSOLIDATED ANNEXATION r t ORDINANCE NO, 38 _ 1957 ACCEPTING AND APRROVING THE PLAT OF WHAT IS KNOWN AS THE WEST LAKE AND PROSPECT STREETS CONSOLIDATED ANNEXATION TO THE CITY OF FORT COLLINS, COLORADO, AND AUTHORIZING THE AN- NEXATION OF ALL THE TERRITORY EMBRACED IN SAID PLAT TO THE CITY OF FORT COLLINS AND TO BE INCLUDED WITHIN THE LIMITS AND JURISDICTION THEREOF, PURSUANT TO THE AUTHORITY CONTAINED IN ARTICLE 11, CHAPTER 139, COLORADO REVISED STATUTES 1953 WHEREAS, heretofore a written petition has been presented to the Council of the City of Fott Collins in substantial compliance with the pro- visions of Article 11, Chapter 139, Colorado Revised Statutes 1953 by Thirty- one (31) individuals purporting to be 51.77 of the land owners of the area involved and further purporting to be the owners of 55.37 of the area of land embraced in what is known as the West Lake and Prospect Streets Consolidated Annexation to the City of Fort Collins, wherein and whereby said petitioners and applicants petitioned the City of Fort Collins for the annexing of all the territory embraced in what is known as the West Lake and Prospect Streets Consolidated Annexation to the City of Fort Collins, Colorado, Comprising the lands shown in the plat thereof attached to said petition and more particularly described as hereafter set forth, and WHEREAS, said petition was accepted by the Council of the City of Fort Collins by resolution passed and adopted on the loth day of October, 1957, and WHEREAS, notice for hearing on the 14th day of November, A. D. 1957, on an ordinance approving the annexation of said territory and including the same within the limits and jurisdiction of the City of Fort Collins was duly published as provided by law, and WHEREAS, the Council of the City of Fort Collins has found that the petition and the documents attached thereto meet the requirements of Article 11, Chapter 139, Colorado Revised Statutes 1953, and WHEREAS, no proceedings for an election to determine the question of annexation have been initiated by written counter-petition as provided by law and no objection to annexation having been made, 4 BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 That after due consideration of the petition for annexation, that the petition for the annexation of all the territory in what is known and described as the West Lake and Prospect Streets Consolidated Annexation to the City of Fort Collins, Colorado, as shown by the plat thereof annexed to said petition and which is more particularly described as follows, to-wit Part of the Southeast I of Section 14 and Northeast I of Section 23, bothcin Township 7 North, Range 69 West of the 6th P M , Larimer County, Colorado, contained within boundary lines which begin at the Southwest corner of the Southeast I of said Section 14 and run thence Northerly 612 6 feet, along the West line of the Southeast I of said Section 14, to the North line of Lake Street, thence Easterly 363 4 feet, more or less, along the North line of Lake Street to the Southwest corner of Steelets Subdivision of Tract No 5 of Emights Subdivision, thence North 575 2 feet, along the West line of Steelets Subdivision, thence West 363 4 feet, more or less, to the West line of the Southeast 4 of said Section 14, thence North 130 feet, along the West line of the Southeast I of said Section 143, to the Northwest corner of the South j of the Southeast I of said Section 143, thence Easterl v696 8 feet, more or less, along the North line of the South j of the Southeast j of said Section 14, to the Northeast corner of said Steele's Subdivision, thence South 702 3 feet, more or less, to the North line of Lake Street, thence East 666 8 feet, more or less, along the North line of Lake Street, to the Southwest corner of Lot 2, said Emights Subdivision, thence North 696 4 feet, more or less, to the Northwest corner of Lot 2, said Emights Subdivision, thence East 333 k feet, more or less, to the Northeast corner of Lot 2, said Emights Subdivision, thence South 100 feet, thence East 80 feet, 75rocnce 4rdh sb fee i, fe fhevea F�,� e3 e-y.$ thence South 541 feet, more or less, to the North line of Lake Street, thence East, along the North line of Lake Street, 44 feet, thence North 190 feet, thence East 1o6 feet to the west right-of-way line of the Colorado and Southern Railway Compaziy, thence North along said right-of-oway line 501 feet, more or lose, to the Northeast corner of Lot 1 in said Emi.ght's Subdivisions/ thence East 100 feet to the East right-of-sway line of the Colorado and Southern Railway Company, which point is the Northwest corner of Block 1, L C Moorets First Addition to the City of Fort Collins, Colorado, according to the plat dated duly 9, 1921, thence South, along the West line of said Block 1, L C Mooret's First Addition, 327 feet, more or less, to the Northwest corner of Block 2, Wiardts Addition to the City of Fort Collin, according to * plat dated October 29, 1921 • 2 - ' a thence South along the West line of Blocks 2 and 1 said Wiard's Addition, 993 feet, more or less, to the South line of the Southeast k of said Section 14 thence Westerly along the South line of the Southeast k of said Sec- tion 14 577 95 feet more or less, to a point 30' North of the Northeast corner of Lot 2 in the Hauser Subdivision, according to a plat filed May 17 1949, thence South 30 feet, more or less, to the Northeast corner of said Lot 2, thence Souhh 200 feet to the Southeast corner of said Lot 2, said Hauser Subdivision, thence West 225 feet to the Southwest corner of Lot 4 said Hauser Subdivision thence North 230 feet to the South line of the Southeast k of said Section 14, thence West along the South line of the Southeast J% of said Section 14, 1327 95 feet more or less, to the point of beginning containing an area of 47.74C acres more or less be accepted and approved and that the said territory be annexed and made a part of the City of Fort Collins and be included within the limits and ,jurisdiction thereof and that the City Clerk be and he is hereby authorized and directed to prepare certified copies of this ordinance, to each of which shall be attached a plat of said West Lake and Prospect Streets Consolidated Annexation to the City of Fort Collins, Colorado, and shall file one copy thereof in the office of the Clerk and Recorder of the County of Larimer and another copy thereof in the office of the Clerk of the City of Fort Collins, together with a certified copy of the said petition and another copy of said petition and approving or- dinance with the Secretary of State of the State of Colorado Section 3 That in accepting and approving the plat of the West Lake and Prospect Streets Consolidated Annexation to the City of Fort Collins the City of Fort Collins does not assume obligations respecting the construc- tion of water mains sewer pipes gas mains electric light lines or other ser- vices or utilities with respect to the service of said addition except as may be required and provided by the owners of property within the limits of said addition at their own expense and except as may be inititated by the owners of said property within the limits of said addition in compliance with the terms and provisions of Ordinance No 7, 1921, relating to local and public improvements, as amended -
